SUBJECT: Public Hearing to Confirm Streetlight Assessments for
31st Street between Ocean Park Boulevard and Pearl
street
Introduction
This report requests that the City Council hold a public hearing
to confirm streetlight assessments for 31st street between Ocean
Park Boulevard and Pearl street.
Background
Streetlight petitions from residents of 31st street were accepted
by the City Council on January 14, 1986 and a public hearing was
set for February 25, 1986. The public hearing was held and the
Council ordered the project to proceed. Staff designed the
project and a contract to construct the streetlights was awarded
on September 9, 1986.
The work is complete and assessments are due. In accordance with
state law, a public hearing must be held to confirm the
assessments and on July 14, 1987, Council set the public hearing
for August 11, 1987. A Notice of pUblic Hearing with the amount
of assessment was sent to each property owner 15 days in advance,
and the notice was published in the Evening Outlook for two
consecutive days 15 days in advance of the public hearing.

Budget Financial Impact
Thirty-first street was part of the streetlight project confirmed
on May 26, 1987. However, due to a staff error, 31st street was
left off the staff report. The city's cost for 31st Street is
$14,942.33 and $13,619.10 will be assessed to property owners.
Presently, there are sufficient funds at Account No.
01-770-453-000-905 for the city's share.
A detailed assessment report will be presented at the public
hearing.
Recommendation
It is recommended that the City council:
1- Open the public hearing:
2. Close the public hearing; and
3. Acknowledge any protests and adopt the attached
Reso1ution~ confirming the assessments.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA APPROVING THE ASSESSMENT
DIAGRAM AND CONFIRMING AN ASSESSMENT FOR 31ST
STREET BETWEEN OCEAN PARK AND PEARL STREET
WHEREAS, the City of Santa Monica, pursuant to Section
5100 et seq. of the streets and Highways Code, commenced
proceedings to construct streetlighting and appurtenant work on
31st Street between Ocean Park and Pearl Street; and
WHEREAS, the proceeding is more fully described in the
Resolution of Intention adopted by the City Council on January
14, 1986, being Resolution Nll11lher 7171 (CCS); and
WHEREAS, the contract for the above-described work has
been fulfilled to the satisfaction of the Superintendent of
streets; and
WHEREAS, the Superintendent of Streets has made an
assessment to cover the sum due for the work performed and
specified in the contract~ and
WHEREAS, the assessment has been filed with the city
Clerk; and
WHEREAS, the City Clerk gave notice as required by
Sections 5362 and 5363 of the Streets and Highways Code; and
WHEREAS, upon the day and hour fixed for hearing by the
City Clerk, the City Council of the City of Santa Monica heard
and passed upon any and all objections, appeals, and protests,

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. That all objections, appeals, and protests
of every kind and nature be, and the same hereby are, overruled
and denied.
SECTION 2. That the diagram of property affected and
benefited by the construction of a high-pressure sodium street
lighting system and appurtenant work on 31st street between Ocean
Park and Pearl Street in the City of Santa Monica, as more fully
described in Resolution No. 7141 (CCS) and therein declared to be
the property to be assessed to pay the expense of the
improvements, is approved and the City Clerk is directed to
execute the certificate on the diagram certifying such approval
and to deliver the diagram to the Superintendent of streets.
SECTION 3. That the assessment for the replacement of
the streetlighting system and appurtenant work on 31st Street
between Ocean Park and Pearl as more fully described in
Resolution Nnm_her No. 7141 (CCS), be, and the same hereby is,
confirmed and approved.
SECTION 4. That the Superintendent of Streets shall
forthwith attach a warrant to said assessment bearing the date of
this confirmation.
SECTION 5. That the assessment roll, warrant and
diagram shall be recorded in the Office of the Superintendent of
Streets, and immediately thereafter the City Clerk shall file a

copy of the assessment diagram in the Office of the county
Recorder, and thereafter shall record in said Office of the
County Recorder a Notice of Assessment, all in the manner and
form prescribed by Section 3114 of the streets and Highways Code
of the state of California.
SECTION 6. That the city Clerk shall certify to the
adoption of this Resolution, and thenceforth and thereafter the
same shall be in full force and effect.
