SUBJECT: Hold Public Hearing on Proposed streetlighting District
for Alta Avenue between First Court and Fourth street
Introduction
This report requests that the City council hold a public hearing
to determine the convenience and necessity of streetlights and to
order the work on A1ta Avenue between First Court and Fourth
street.
Background
At the request of residents, staff prepared a streetlight
petition for Alta Avenue between 4th street and First Court. The
petition was circulated and returned, and the Council accepted
the petition on April 28, 1987, along with streetlight petitions
for other streets. However, property owners on Alta Avenue did
not receive proper notice of the public hearing due to staff
error. To rectify this oversight a public hearing was set for
October 13, 1987. Notices were sent fifteen days in advance of
the meeting to all property owners of the street, a notice was
published in the newspaper, and the street was posted in
accordance wi th the Improvement Act of 1911. After the public
hearing and Council approval of the installation, the contractor
will be instructed to proceed with the construction of
streetlights on Alta Avenue.

BUdget/Financial Impact
Alta Avenue was included in a streetlight district with several
other streets. The contract to perform the work was awarded at
the city Council meeting of September B, 19B7. I f Al ta Avenue
streetlights are not approved by the City Council this evening,
a change order will be issued to the contract eliminating Alta
Avenue lights and the City will receive a deduction of $19,855.
Recommendation
It is recommended that the City Council:
l. Open the pUblic hearing on the convenience and
necessity of the Resolution of Intention;
2. Close the public hearing;
3. Acknowledge any protests and adopt the attached
resolution finding that the public convenience and
necessity require the construction and ordering the
work.

This letter is legal notice as required by the 1911 Improvement
Act proceedings under which streetlights are to be constructed on
Alta Avenue from First Court to Fourth Street.
You are hereby notified that the City Council of the City of
Santa Monica, California, adopted Resolution No. 7491 (CCS) on
September 8, 1987, declaring its intention to construct street
lighting and appurtenant work on Alta Avenue from First Court to
Fourth street, determining that bonds be issued to represent the
cost therefore, declaring the work to be of more than local
ordinary public benefit, and that the expense thereof shall be
assessed upon a district.
A public hearing regarding the proposed improvement will be held
at 7:30 pm, October 13, 1987, in the Council Chambers, city Hall,
1685 Main Street, Santa Monica. All protests regarding this
matter must be filed in writing in the Office of the city Clerk
before said time, and all protests so filed will be considered by
the City Council at that time. Each protest must contain a
description of the property in which each signer thereof is
interested.
The total project cost is estimated to be approximately $21,500.
The amount to be assessed upon the district for this improvement
is approximately $10,750. Records available indicate you own
property in the above district. Requests for copies of the
Resolution of Intention which contain further particulars on this
assessment and all questions regarding the proposed improvement
may be directed to Jean Stanley in the Office of General Services
at 458-8721.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA FINDING THAT THE PUBLIC
CONVENIENCE AND NECESSITY REQUIRE THE
CONSTRUCTION OF STREETLIGHTING AND ORDERING
WORK ON ALTA AVENUE BETWEEN FIRST COURT AND
FOURTH STREET IN ACCORDANCE WITH RESOLUTION OF
INTENTION NO. 7491 (CITY COUNCIL SERIES)
WHEREAS, the City council of the City of Santa Monica,
..
on the 8th day of September, 1987, passed and adopted its
Resolution of Intention, being Resolution No. 7491 (CCS),
declaring its intention to order the work described therein to be
done, which said Resolution of Intention duly and legally was
published as required by law and notice of said improvements has
been given in the manner required by law and all written
objections and protests to the proposed work or the extent of the
district to be assessed were heard and considered by the city
Council; and
WHEREAS, a pUblic hearing has been held duly and
regularly pursuant to Resolution No. 7491 {CCS} and the laws and
Constitution of the State of California on the proposed
construction of street lighting and appurtenant work thereto, as
described in the Resolution of Intention No. 7491 (CCS), on Alta
Avenue between First Court and Fourth street; and
WHEREAS, said improvement has been considered fully,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:

SECTION 1. The public interest and convenience require,
and the City Council of the city of Santa Monica hereby orders,
the work described in said Resolution of Intention to be done on
Alta Avenue between First Court and Fourth Street in the city of
Santa Monica.
SECTION 2. Any and all of said protests and objections
of every kind and nature to the proposed work or to the extent of
the district to be assessed be, and the same hereby are,

overruled and denied.
SECTION 3. Special Assessment Investigation, Limitation
and Majority Protest Act of 1931 shall not apply to the making
of said improvements.
SECTION 4. The improvements shall be conducted under the
Improvement Act of 1911, which is Oi vision 7 of the streets and
Highway Code of the state of California, and the Superintendent
of streets and the City Attorney presented to the city Council
the Resolution of_ Intention required by Improvement Act of 1911
to initiate the proceedings for said improvements.
SECTION 5. The City Clerk hereby is directed to post a
notice for five days on or near the door of the Council Chambers
of the City Hall inviting sealed proposals or bids for doing the
work ordered and referring to the specifications on file and to
publish a notice inviting such proposals for two days in the
Evening Outlook, a newspaper pUblished and circulated in said
city.

SECTION 5. Reference hereby is made to said Resolution
of Intention for a description of the work, the assessment
district, the bonds to be issued and for further particulars.
SECTION 6. The City Clerk shall certify to the adoption
of this Resolution, and thenceforth and thereafter the same shall
be in full force and effect.
