'-0 . . . 5()7-000 SEP 1 2 1989 GS:SES:LC:s Council Meeting: september 12, 1989 Santa Monica, California TO: Mayor and city Council FROM: City Staff SUBJECT: Recommendation to Approve Installation of streetlights in Proposed commercial Streetlight District and Set Public Hearing for October 10, 1989 INTRODUCTION This report requests that the City Council approve the installation of streetlights in two commercial areas, LincOln Boulevard from Colorado to Santa Monica and 7th Street from Colorado to Olympic Boulevard. The report also recommends that the city Council adopt the attached Resolution of Intention which sets a public hearing for october 10, 1989 and declare the City's intention to assess property owners for costs and issue bonds as security for unpaid assessments for the above street. Background The City's policy is to assess commercial property owners for certain public works improvements using the Improvement Act of 1911. These include gutter installation I street lightingl street resurfacing, and tree planting. In accordance with this policy, staff is recommending that the Council approve the establishment of a streetlight assessment district for the areas described below. property owners will be notified 15 days in advance of the public hearing in accordance with the Improvement Act of 1911 of the streets and Highway Code. A typical assessment for a \ \. - 1 - ~ . . . . . 50-foot commercial lot would be approximately $900.00 (estimated based on the cost of the last assessment district). Lincoln Boulevard between Colorado Avenue and Santa Monica Boulevard. Staff is recommending that the streetlighting system be upgraded on Lincoln Boulevard between Colorado Avenue and Santa Monica Boulevard. The streetlights on this portion of Lincoln Boulevard were installed more than thirty years ago and the light levels are at less than current standards. Since this is one of the principal entrance points to the City, staff believes that the streetlight system should be upgraded to include twelve additional poles and higher wattage luminaires on the eight existing poles. commercial property owners will be assessed 100% of the cost of the installation. 7th street between Colorado Avenue and Olympic Boulevard. The City is currently renovating the Richards Surgical property to house community service organizations and a homeless shelter. The entrance to the parking area on 7th Street is not currently lit. staff is recommending that streetlights be installed on 7th Street between Colorado Avenue and Olympic Boulevard for the safety and convenience of the facility's users. commercial property owners will be assessed 100% of the cost of the installation based on their frontage (approximately $11,070). The portion of the assessment for the City-owned property on the westerly side will be financed from the street lighting capital improvement project which is financed by the General Fund. - 2 - -- . . . This streetlighting district was originally presented to City Council as a part of the residential district which appears as Item 7-B on this agenda. Due to the omission of the commercial streets on the notices, those streets are excluded from the residential district and are presented to council as a separate district to ensure compliance with state law. BUdget/Financial Impact The total estimate for the project is $97,415. The proposed breakdown is as follows: Commercial property owner assessments $ 86,345 City's contribution 11/070 Total project estimate $ 97,415 Appropriation authority is available in Account No. 01-770-453-000-911 for the city's contribution. The remaining costs for the project will be paid through property assessments. Recommendation: It is recommended that the City Council: l. Approve the formation of an assessment district for installation of streetlights on: 7th street, Colorado Avenue to Olympic Boulevard; Lincoln Boulevard, Colorado Avenue to Santa Monica Boulevard; and 2. SECTION 2. The total estimated cost of the proposed improvement is Ninety-Seven Thousand Four Hundred and Fifteen Dollars ($97,415). SECTION 3. The proposed work or improvement in the opinion of City council of the city of Santa Monica is of more than local - or ordinary public benefit, and the City Council hereby proposes that the district in the city of Santa Monica to be benefited by said work or improvement and to be assessed to pay one-half of the cost and expense thereof, is shown upon a certain map indicating the exterior boundary thereof, which said Drawing No. 5364 is on file in the Office of the City Engineer. The map hereby is referred to and shall govern for all details as . e . to the extent of said assessment district. The assessment district includes in general the lots and parcels described in section 1 above but reference hereby is made to said Drawing for all details as to the extent of said assessment district and for any variation between the last mentioned general description and the extent of said assessment district as shown on said map. All public streets or alleys, or portions thereof I hereby are excepted from said district. SECTION 5. The city will pay a portion of the cost and expenses of the work described herein, and the City Controller is authorized and directed to pay the same immediately upon confirmation of the assessment by the City Council. SECTION 6. Serial bonds bearing interest at the rate of ten percent (10%) per annum shall be issued to represent each assessment of One Hundred Fifty Dollars ($150.00) or more remaining unpaid for thirty (30) days after the recording of the warrant.. Said serial bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the next September 1st following their date. Payments on the principal of unpaid assessments and interest shall be made by property owners to the city Treasurer and the same shall be disbursed by him or as provided in the "Improvement Act of 1911" hereinafter referred to. In accordance with streets and Highways Code Section 6442, the first two percent delinquency penalty authorized by such section shall be retained by the city Controller as the cost of servicing the delinquency. .. . . SECTION 7. Notice is hereby given that on Tuesday, the lOth day of October, 1989, at 7:30 P.M. , in the city Council Chambers located in city Hall, 1685 Main Street, Santa Monica, California, there shall be a pUblic hearing before said City Council for the purpose of determining whether the public convenience and necessity require the above described improvement and for the purpose of allowing any and all persons having any objections to the proposed work or improvement to appear and show cause why the said proposed work or improvement should not be carried out in accordance with said Resolution of Intention. Inquiries concerning this public hearing should be directed to the Department of General Services, Engineering Division, at (213) 458-8721. SECTION 8. The city Clerk shall give notice of the hearing by posting a copy of this Resolution in the manner described by streets and Highways Code Section 5065 and by publication as hereinafter provided. Any interested person may make protest against the proposed improvement in writing filed with the city Clerk at any time not later than the hour set for the hearing in the manner provided by streets and Highway Code Section 5220. - SECTION 9, The Superintendent of Streets shall cause to be conspicuously posted along the line of said contemplated work or improvement and also along all the open streets within the said district, notice of the passage of this Resolution of Intention in the manner and form prescribed by law. . . . . . The City Clerk hereby is directed to mail notices, in the manner and form prescribed by law, of the adoption of this Resolution to all persons owning real property in the hereinbefore described assessment district, whose names and addresses appear on the last equalized assessment roll for the City taxes or as known to the City Clerk. The City Clerk hereby is directed to publish this Resolution in The Outlook on two successive dates, the first publication is to be made not less than fifteen ( 15) days prior to the date of the above public hearing. Pursuant to Public Contract Code section 20433, the city council hereby states that the property owners may not contract for the improvements and that the City shall be responsible for letting and administering the construction contract for this district. The resolution set a public hearing for September 12, 1989, at which time any interested party may address the City council regarding the proposed work or improvements. Notices of Public Hearing were mailed to each property owner and tenant, and posted on each street fifteen days in advance of the public hearing (August 28, 1989) in the manner prescribed by state Law. A list of property owners will be available for review in the Council Chambers at the time of the public hearing. BUdget/Financial Impact The total estimate for the project is $287,820. The proposed breakdown is as follows: Residential property owner assessments 143,910 City's contribution 143,910 Total project estimate $ 287,820 Appropriation authority is available in Account No. 01-770-453-000-911 for the City's contribution. The remaining costs for the project will be paid through property assessments. Recommendation It is recommended that the city Council: l. Open the public hearing on the convenience and necessity and the Resolution of Intention; 2. Close the pUblic hearing; and 3. The Act provides that the costs of the improvements such as surveying, preparing plans, construction costs, prepar ing Council resolutions, advertising, inspection, and preparing the assessment and bonds may be assessed to the property owner. The City Council's past pOlicy was to initiate a street lighting district if 60% of the property owners petitioned for street lights. Under new procedures adopted by the City Council and the Rent Control Board, tenants also may petition for street lights. In this instance, the petition must by signed by 60% of the residents in a street lighting district. The City council presently assesses property owners one-half the cost of installing the street lighting. The City pays the remainder of the cost, approximately $400 per 50 foot-lot. In addition, the City presently pays all maintenance costs and the cost of the energy to light the street lights. By action of the City council and Rent Control Board, when tenants circulate the petition, the property owner may pass through the cost to the tenants over a 10-year period with each unit on a property paying the same cost. In most instances, monthly charges will be less than $2.00 per apartment unit. THERE IS NO CHARGE TO EITHER PROPERTY OWNERS OR TENANTS UNTIL THE STREET LIGHTS ARE INSTALLED AND WORKING. The Improvement Act provides that the property owner may pay the assessment: 1. By Cash. Cash payments may be made within 30 days after the assessment is confirmed. After 30 days, cash payments may still be made but interest must be charged. OR 2. By Installment Payments. Payments may be made in 10 annual installments plus interest which is billed semi-annually. The unpaid balance may be paid at any time an interest payment is due. Financial aid for low-to-moderate income property owners and tenants is available. To qualify for assistance, a short application form must be completed after the street lights are installed. WHEREAS, said improvement has been considered fully, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The public interest and convenience require, and the city Council of the city of santa Monica hereby orders, the work described in Resolution No. 7872 (CCS) to be done on: 24th street from pico Boulevard to Pearl street; Franklin from Northerly city limits to City reservoirs; Ashland Avenue from 4th street to 6th street; 15th street from Broadway to Colorado Avenue; Harvard street from Montana Avenue to Wilshire Boulevard; Delaware Avenue from stewart street to Warwick Avenue; pine street from Lincoln Boulevard to 7th street; and lOth street at Ashland Avenue, all within the City of Santa Monica. Any and all of said protests and objections of every kind and nature to the proposed work or to the extent of the district to be assessed be, and the same hereby are, overruled and denied. SECTION 2. The City council hereby finds and determines further that "Special Assessment Investigation, Limitation, and Majority Protest Act of 193111 shall not apply to the making of said improvement. SECTION J. The improvements shall be conducted under the Improvement Act of 1911, which is Division 7 of the streets and Highway Code of the State of California, and the Street
