SR-507-000 (40) . . . 7 ~ t , " 50?-ooo cx;;7' 0 1 89 GS:SES:LC:srstltl council Meeting: October 10, 1989 Santa Monica, California TO: Mayor and City Council FROM: city staff SUBJECT: Hold Public Hearing on Proposed streetlighting District on: Lincoln Boulevard from Colorado Avenue to Santa Monica Boulevard and 7th Street from Colorado Avenue to Olympic Boulevard Introduction This report requests the city Council to hold a public hearing to determine the convenience and necessity of streetlights and to order the work on: Lincoln Boulevard from Colorado Avenue to Santa Monica Boulevard and 7th street from Colorado Avenue to Olympic Boulevard Background On September 12, 1989, the City Council adopted Resolution No. 7900 (CCS) setting a public hearing for the purpose of determining whether public convenience and necessity require the construction of streetlighting and declaring its intention to construct streetlighting and appurtenant work. The resolution set a public hearing for October 10, 1989, at which time any interested party may address the city council regarding the proposed work or improvements. Notices of Public Hearing were mailed to each commercial property, and posted on each street fifteen days in advance of the public hearing (September 25, 1989) in the manner prescribed by State Law. Copies of the petitions and maps of the proposed assessment district will be available in the council Chambers at the time of the Council Meeting. Proposed Commercial street Light District The city's pOlicy is to assess commercial property owners for certain public works improvements using the Improvement Act of 1911. These include gutter installation, street resurfacing, and tree planting. In accordance with this policy, staff is recommending that the Council approve the establishment of a streetlight assessment district for the areas described below. staff believes that by including these areas with the residential areas above, the City could take advantage of economies of scale and reduce the per front foot cost for all involved. Property owners will be notified 15 days in advance of the public hearing. A typical assessment for a 50-foot commercial lot would be approximately $900.00 (estimate based on the cost of the last assessment district) . Lincoln Boulevard between Colorado Avenue and Santa Monica Boulevard. Staff is recommending that the streetlighting system be upgraded on Lincoln Boulevard between Colorado Avenue and Santa Monica Boulevard. The streetlights on this portion of Lincoln Boulevard were installed more than thirty years ago and the light levels are at less than current standards. Since this is one of the principal entrance points to the City, staff believes that the streetlight system should be be upgraded to - 3 - . . CA 90401.3295 September 18, 1989 (213) 458-8211 NOTICE OF ASSESSMENT This letter is legal notice as required by the 1911 Improvement Act proceedings under which streetlights are to be constructed on Lincoln Boulevard from COlorado Avenue to Santa Monica Boulevard and on 7th street from Olympic Boulevard to Colorado Avenue. Commercial property owners will be assessed one hundred percent (lOO%) of the cost of the installation based on their frontage. The cost is approximately $18.00 per linear foot based on recently completed streetlight projects. For example, a 50-foot commercial property included in the district would be approximately 50' x $18.00 ~ $900. You are hereby notified that the City council of the city of Santa Monica, California, adopted Resolution No. 7900 (CCS) on September 12, 1989, declaring its intention to construct streetlighting and appurtenant work in the above named area, determining that bonds be issued to represent the cost therefor, declaring the work to be of more than local ordinary public benefit, and that the expense thereof shall be assessed upon a district. A public hearing regarding the proposed improvement will be held at 7:30 P.M., October 10, 1989, in the Council Chambers, city Hall, 1685 Main Street, Santa Monica. All protests regarding this matter must be filed in writing in the Office of the City Clerk before said time, and all protests so filed will be considered by the City Council at that time. Each protest must contain a description of the property in which each signer thereof is interested. The total project cost is estimated to be approximately $97,415. The amount to be assessed upon the district for this improvement is approximately $86,345. Records available indicate you own property in the above district. The public interest and convenience require, and the City Council of the City of Santa Monica hereby orders, the work described in Resolution No. 7900 (CCS) to be done on: Lincoln Boulevard from Colorado Avenue to Santa Monica Boulevard and on 7th Street from Olympic Boulevard to Colorado Avenue, all within the city of Santa Monica. Any and all of said protests and objections of every kind and nature to the proposed work or to the extent of the district to be assessed be, and the same hereby are, overruled and denied. SECTION 2. The City Council hereby finds and determines further that "Special Assessment Investigation, Limitation, and Majority Protest Act of 1931" shall not apply to the making of said improvement. SECTION 3. The improvements shall be conducted under the Improvement Act of 1911, which is Oivision 7 of the streets and Highway Code of the state of California, and the street superintendent and the City Attorney presented to the said City Council the Resolution of Intention required by said Improvement Act to initiate the proceedings for said improvement.
