petltlons for the above streets. It also recommends adopting a

Background
At the request of resl.dents and a communl.ty group, streetll.ght
petltlons were prepared by Cl.ty staff for the blocks llsted
above. The petltlons were cl.rculated and completed street ll.ght
petltlons were returned. They have been reviewed by City staff
and are ln accordance wl.th the Clty'S mlnimum requlred number of
sl.gnatures (60% of the total res1dentl.al unl.ts). Rent Control
staff has also reviewed and approved the petltions for
conformance to thelr regulatl.ons.

The petItion for HIll Street between 23rd and 25th Streets was
prevlously submltted as part of the streetllght dIstrict approved
on September 10, 1985. However, at the publlc hearIng a resIdent
of Hill Street protested the validity of the petltIon. The
resldent stated that Slnce the petIt10n had been cIrculated, some
of the res1dents had moved out of the area and others had asked
that thelr names be removed from the petition. Clty staff
returned the petit10n and notIfIed the res1dents on HlII Street
that their street would be lncluded 1n the next dlstrict. The
petltIon has been reclrculated and returned to CIty staff.
Seventy-nIne percent of the residents of Hill Street are 1n favor
of 1nstalling streetlIghts. This fIgure does not lnclude
resldents who withdrew theIr names.
On December 19, 1985, a meetIng was held wlth the resldents of
the above streets (WIth the exceptIon of Franklin between
WIlshIre and L1pton - see follOWIng paragraph) to dlSCUSS the
types of streetlIghts ava1lable. The reSIdents deCIded on the
C1ty'S standard style of streetlIght. LocatIons of the
streetlIghts were also dIscussed.
On December 20, 1985, staff was approached by a resident of
FranklIn Street between Wilsh~re and Llpton who requested that
theIr block be 1ncluded In thlS dIstrlct. Staff adv~sed the
reSIdent that a meet~ng dIscuss1ng the types of lIghts avaIlable
had already been held and the standard style of streetllght had
been selected by those In attendance. Note: If every reSident
on thIS portion of Frankl1n (23) selected another type of 11ght,
the maJority (35) would st111 be for the standard streetlIght. A

petition was prepared on December 20, 1985, and was returned to
staff on December 31, 1985. It conta~ned the requ~red amount of
s~gnatures and was approved by Rent Control staff.

Budset/Flnaoc1al Impact
Appropr1ation author1ty 1S avallable 1n the amount of $234,065.78
1n Account Nos. 01-770-453-000-902 (budgeted 10 1983-84) and
01-770-453-000-903 (budgeted 10 1984-85) for the Cl.ty's share of
street light installat~on. On September 10, 1985, the Clty
Councll approved a streetllght proJect WIth the Clty'S estimated
cost beIng $91,500. ApproXlmately $142,565 remains aval.lable.
No add1tlonal funds were budgeted for FY 1985-86.

$227,410. At the t1me of the award of contract, CIty staff 15

MONICA SETTING A HEARING FOR THE PURPOSE OF DETERMINING --
WHETHER OR NOT THE PUBLIC CO NVENI ENCE AND NECESSITY
REQ Ul RE THE CONSTRUCTION OF STREET LIGHTING AND
DECLARING ITS INTENTION TO CONSTRUCT STREET LIGHTING AND
APPURTENANT WORK ON VARIOUS CITY STREETS AS SHOWN ON
CITY DRAWING NO. 5349, WITHIN THE CITY OF SANTA MONICA.
WHEREAS, the City Council of the City of Santa Mon~ca
-
proposes to in~tiate proceedings under the Improvement Act of
1911 for the ~mprovements to streetlighting; and
WHEREAS, Sect10n 19 of' Ar tic 1 e XVI of the California
-
Constl.tution p r-o v ide s that certain specified debt limitation and
majorl.ty protest provisions shall not apply if, after the giving
of such reasonable notice by publication and post1ng and the
holdl.ug of such publl.c hearing as the Ci ty Council oft he City of
Santa Monica shall have prescri bed, the City Council by no less
than four-fl. ft hs vote of all members thereof, finds and
determines that the public convenience and necessity require the
proposed improvement to be made; and
WHEREAS, Streets and Highways Code Section 2804 provides
that the "Special Assessment, Investigation, Limitation and
Maj ority Protest Act of 1931" shall not apply to any proceeding
otherwise subject thereto when said improvement proceeding is by
a charter city and said city has complied with the provisions of
Section 19 of Article XVI of the California Constitution; and
WHEREAS, the Ci ty of Santa Monica is a charter city of
the State of Califorul.a,

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF S ANT A
MONICA DOES RESOLVE AS FOLLOWS:

SECTION 1. The C~ty Council proposes to initiate
~-
proceedings for the 1nstallation of streetlighting aud
appurtenant work on the street shown on City Dr awl ng No. 5349 and
generally known as :
9th, 12th and Pr1nceton Streets between Wilsh~re and ~
Santa MOU1ca
Yale and Harvard between Santa Mo ni c a and Colorado
Hill Street between 23rd and 25th Streets
22nd Street between Pica and Pearl
31st Street between Pearl and Ocean Park
Franklin from Wilshire tOo the Northerly City Limits

SECTION 2. The total estl.mated cost of the proposed
improvement is $454,821.00.
SECTION 3. Improvements shall be conducted under the
Improvement Act of 1911 , which is DiviS10n 7 of the Streets and
Highways Code of the State of California.
SECTION 4 . The proposed work or improvement in the
opinion of City Council of the City of Santa Monica is of more
than local or ordinary public benefit, and the City Council
hereby proposes that the district in the C1 ty of Santa Monica to
be benefitted by said work or improvement and to be assessed to
pay one-half of the cost and expense thereof, is shown upon a
certain map indicating the exterior boundary thereof, which said
Drawing No. 5349 is on file in the Office of the City Engine er .
The map hereby is referred to and shall govern for all details as
to the extent of said assessment district. The assessment

d~strict ~ncludes in general the lots and parcels described in
Section 1 above but reference hereby is made to sa~d Drawing for
all details as to the extent of said assessment district and for
any variation between the last mentioned general descr~ption and --
the extent of said assessment district as shown on said map. All -
public streets or alleys, or portions thereof, hereby are
excepted from sa~d district.

SECTION 5. The City will pay a portion of the cost and
expenses of the work described herein, and the City Controller is
authorized and d~rected to pay the same immed~ately upon

confirmat~on of the assessment by the City Council.

SECTION 6. Ser i al bonds bearing interest at the rate of
12% per annum shall be ~ s s ue d to represent each assessment of
$150.00 or more remaining unpa~d for 30 days after the recording
of the Warrant. Sa~d serial bonds shall extend over a per~od
ending nine years from the second day of January next succeed~ng
the next September 1st following their date. Payments on the
principal of unpaid assessments and ~nterest shall be made by
property owners to the City Tre as ure r and the same shall be
disbursed by him or as provided in the "Improvement Act of 1911"
here~nafter referred to. In accordance with Streets and Highways
Code Section 6442, the first two percent delinquency penalty
authorized by such section shall be retained by the City
Controller as the cost of servicing the del~nquency.
SECTION 7. No tic e is hereby given that On Tuesday, the
11th day of February, 1986, at 7:30 P.M. , in the Council Chambers

located in the City Hall, 1685 }lain Street. Santa Monica,
California, there shall be a public. hear~ng before said City
Counc~l for the purpose of determining whether the public 0
conven~ence and necessity requ~re the above descr~bed improvement ~-
and for the purpose of allowing any and all persons having any
obj ections to the proposed work or improvement to appear and show
c a us e why the said proposed work or improvement should not be
carr~ed out in accordance with said Resolution of Intention. ~
Inquiries concerning thI.s public hearing s h 0 ul d be d1.rected to
the Department of General Services at 458-8221.

SECTION 8. The City Clerk shall give notice of the

hearing by posting a copy of this resolution in the manner
described by Streets and Highways Code Section 5065 and by
publ1.cation as hereinafter provided. Any person interested may
make protest against the proposed improvement ~n writ1.ng filed
with the City Clerk at any time not later than the hour set for
the hearing 1.n the manner provided by Streets and H1.ghway Code
Section 5220.
SECTION 9. The Superintendent of Streets shall cause to
be conspicously posted along the line of said contemplated work
or improvement and also along all the open streets within the
said district, notice of the passage of t hI. s Resolution of
Intention in the manner and form prescribed by law.
The City Clerk hereby 1.S directed to mail notices, in
the manner and form prescrI.bed by law, of the adoption of this
resolution to all persons owning real property in the
hereinbefore described assessment district, whose names and

addresses appear on the last eq uali zed assessment roll for the
City taxes or as known to the City Clerk.

SECTION 10. The City Clerk hereby is directed to

publish this resolution in the Evening Outlook on two successive
dates, the first publication is to be made not less than ten days
prior to the date of the above public hearing.
SECTION 11. Pursuant to Public Contract Code Section -
20433, the City Council hereby states that the property owners
may not contract for the improvements and that the Ci ty shall be
respons1ble for lett1ng and administering the construction
contract for t hi. s district.
SECTION 12- The Ci t Y hereby declares that Community
Development Bloc k Gr ant funds may be applied for payment of
assessments on property owned or resided in by low to moderate
income households.
SECTION 13. The City Clerk shall certify to the
adoption of this resolution and thereafter the same shall be in
full force and effect.
