SUBJECT: Public Hearing on Confirmation of Assessments for
streetlight System Replacement on La Mesa
Introduction
This report requests that the City council hold a public hearing
for the confirmation of assessments for the streetlight system
replacement on La Mesa.
Background
On April 23, 1985, the City council approved replacing the
deteriorated streetlight system on La Mesa Drive and assessing
property owners for a portion of the cost. A public hearing was
held on May 28, 1985, and Council ordered the work to be done.
The work is complete and assessments are due. In accordance with
State law, a public hearing must be held to confirm the
assessments and on March 24, 1987, the City Council set the
public hearing for April 28, 1987. A Notice of Public Hearing
with the amount of assessment was sent to each property owner 15
days in advance (April 13, 1987) of the public hearing. Also,
the notice was published in the Evening Outlook for two
consecutive days 15 days in advance of the public hearing.
BUdget/Financial Impact
The total cost of the project is $237,855 (construction cost plus

incidentals). The City's share has been encumbered at Account
Nos. 01-770-453-000-903 and 01-770-453-000-904 in the amount of
$132,704. The City's cost is $122,677.85 and $115,177.15 will be
assessed to property owners.
A detailed assessment report will be available at the public
hearing.
Recommendation
It is recommended that the city Council:
1. Open the public hearing;
2. Close the public hearing; and
3. Acknowledge any protests and adopt the attached
Resolutions confirming the assessments.

The installation of streetlights on the above named street has
been completed and the cost of your assessment is shown above.
Pursuant to the Improvement Act of 1911 of the california streets
and Highways Code, this letter is notification that the City
Council, pursuant to Resolution of Intention No. 7393 (CCS)
adopted on March 24, 1987, has scheduled a hearing to hear and
pass upon the report of the Superintendent of Streets of the cost
of the installation, in connection with the above-described
project, together with any objections and protests, if any, which
may be raised by any property owner liable to be assessed for the
cost of such streetlight installation and any other interested
persons.
The hearing will be held as follows:

Any protests or objections must be in writing and must be filed
with the City Clerk on or before the time set for the hearinq.
Upon confirmation of the report of the Superintendent of Streets,
as provided for in Improvement Act of 1911 of the California
Streets and Highways Code, the cost of the streetlight
installation will be assessed against your property, and you will
be notified of the manner of payment. Please contact Jean

Rent Control regarding pas-though of assessed costs to tenants.
The City will provide financial assistance for low-to-moderate
income persons. If your income is less than $16,900 for a family
of one person, $19,300 for two persons, $21,750 for three persons
or $24,150 for four persons, call Rey Espana at 458-8701 for
information on this program.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA APPROVING ASSESSMENT DIAGRAM
AND CONFIRMING ASSESSMENT FOR LA MESA
I WHEREAS, the City of Santa Monica, pursuant to section
5100 et seg. of the streets and Highways Code, commenced
proceedings to construct streetlighting and appurtenant work on
La Mesa and;
WHEREAS, the proceeding is more fully described In the
Resolution of Intention adopted by the City council on April 23,
1985, being Resolution Number 7006 (CCS) ; and
WHEREAS, the contract for the above described wo=k has
been fulfilled to the satisfaction of the Superintendent of
Streets; and
WHEREAS, the Superintendent of streets has made an
assessment to cover the sum due for the work performed and
specified in the contract, and;
wrIEREAS, the assessment has been filed with t~e City
Clerk; and
w""HEREAS , the City Clerk gave the notice reqJired by
Section 5362 and 5363 of the streets and Highways Code; and
~iliEREAS , upon the day and hour flxed for hearir-g by the
City Clerk, the City council of the city of Santa MOI:lCa heard
and passed upon any and all objections, appeals, and protests,

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. That all objections, appeals, and protests
of every kind and nature be the same are hereby overruled and
denied.
SECTION 2. That the diagram of property affected and
benefited by the construction of a high-pressure sodium street
lighting system and appurtenant work on La Mesa in the city of
Santa Monica, as more fully described in Resolution 7006 (CCS)
and therein declared to be the property to be assessed to pay the
expense of the improvements, is approved and the city Clerk is
dlrected to execute the certificate on the diagra~ certifying
such approval and to deliver the diagram to the Superlntendent of
streets.
SECTION 3. That the assessment for the replacement of
the streetlight system and appurtenant work on La Mesa, as more
fully described in Resolutlon Number 7006 (CCS) , be and the same
hereby is confirmed and approved.
SECTION 4. That the Superintendent of Streets shall

the assessment diagram in the Office of the County Recorder, and

thereafter shall record in said Office of the county Recorder, a
Notice of Assessment, all in the manner and form as prescribed by
Section 3114 of the streets and Highways Code of the State of
California.
SECTION 6. That the City Clerk shall certify to the
adoption of this Resolution, and thenceforth and thereafter the
same shall be in full force and effect.

lS only 110 feet w1de.
The assessment 15 not belleved to be proper as no llghtlng
1n my area has been accompllshed.
It is requested that the area be revlewed and that my
assessment be re-consldered.
