Introduction
This report requests the City Council to hold a public hearing to
determine the convenience and necessity of streetlights and to
order the work on:
33rd street, Pearl to Ocean Park
5th street, Pacific to strand
18th street, California to wilshire Place North
19th street, California to Wilshire
11th street, washington to Idaho
23rd street, Pica to Pearl
Alta, 4th street to First Court
Background
On March 24, 1987, staff presented to city council streetlight
petitions for the above streets. The petitions were approved by
Rent Control and contained the required number of residents'
signatures. The City council accepted the petitions and adopted
Resolution No. 7392 (CCS) setting a public hearing for the
purpose of determining whether public convenience and necessity
require the construction of streetlighting and declaring its
intention to construct streetlighting and appurtenant work.

The resolution set a public hearing for April 28, 1987, at which
time any interested party may address the city Council regarding
the proposed work or improvements. Notices of Public Hearing
were mailed to each property owner and tenant, and posted on each
street fifteen days in advance of the public hearing (April 13,
1987) in the manner prescribed by state law. A list of property
owners will be available for review in the Council Chambers at
the time of the PUblic hearing.
BUdget/Financial Impact
The estimated cost for this streetlight district is $175,700.
The City'S portion is approximately $87,850. Appropriation
authority in the amount of $98,117.19 is available in Account
Nos. 01-770-453-000-903 and 01-770-453-000-905. In addition,
$44,318 will be unencumbered from other completed streetlight
projects.
Recommendation
It is recommended that the City council:
1. open the public hearing on the convenience and
necessity and the Resolution of Intention;
2. Close the public hearing;
3. Acknowledge any protests and adopt the attached
resolution finding that the public convenience and
necessity require the construction and ordering the
work.

This letter is legal notice as required by the 1911 Improvement Act
proceedings under which streetlights are to be constructed on 33rd
street between Pearl and Ocean Park, 5th street between Pacific and
Strand, 18th street between California and Wilshire Place North, 19th
street between California and Wilshire, 11th Street between Wash1ngton
and Idaho, 23rd street between pico and Pearl & Alta between 4th street
and First Court~
You are hereby notified that the City council of the City of Santa
Monica, California, adopted Resolution No. 7392 (CCS) on March 24,
1987, declaring its intention to construct street lighting and
appurtenant work in the above named area, determining that bonds be
issued to represent the cost therefor, deClaring the work to be of
more than local ordinary public benefit, and that the expense thereof
shall be assessed upon a district.
A public hearing regarding the proposed improvement will be held at
7:30 pm, April 28, 1987, in the Council Chambers, City Hall, 1685 f.fain
street, Santa Monica. All protests regarding this matter must be
filed in writing in the Office of the City Clerk before said time, and
all protests so filed will be considered by the City Council at that
time. Each protest must contain a description of the property in
which each signer thereof is interested.
The total project cost is estimated to be approximately $214,700. The
amount to be assessed upon the district for this improvement is
approximately $107,350. Records available indicate you own property
in the above district. Requests for copies of the Resolution of
Intention which contain further particulars on this assessment and all
questions regarding the proposed improvement may be directed to Jean
Stanley in the Office of General Services at 458-8721.

WHEREAS, the City Council of the city of Santa Mon~ca,
on the 28th day of April 1987, passed and adopted its Resolution
of Intention, being Resolution No. 7392 (CCS), declaring its
intention to order the work described therein to be done, v-lhich
said Resolution of Intention duly and legally was published as
required by law and notice of said improvement has been given in
the manner required by law and all written objections and
protests to the proposed work or the extent of the district to be
assessed were heard and considered by the city Counc~l; and
WHEREAS, a public hearing has been held duly and

WHEREAS, said improvement has been considered fully,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. The public interest and convenience require,
and the City council of the City of Santa Monica hereby orders,
the work described in said Resolution of Intention to be done on:
33rd Street, Pearl to Ocean Park
5th street, Pacific to strand
18th street, California to Wilshire Place North
19th Street, California to wilshire
11th Street, washington to Idaho
23rd Street, Pico to Pearl
Alta, 4th Street to First Court
all within the City of Santa Monica.
Any and all of sa~d protests and objections of every
kind and nature to the proposed work or to the extent of the
district to be assessed be and the same hereby are overruled and
denied.
SECTION 2. The City Council hereby finds and determines
further that IISpecial Assessment Investigation, Limitation and
Majority Protest Act of 1931'1 shall not apply to the making of
said improvement.
SECTION 3. T~e improvements shall be conducted under the
Improvement Act of 1911, which is Division 7 of the St~eets and
Highway Code of the state of California, and the S::.reet
Superlntendent and the Clty Attorney presented to the said Clty
Councll the Resolutlon of Intentlon re~~ired by said Improve~ent
Act to ini::.iate the proceedings for said improvement.

. SECTION 4. The City Clerk hereby is directed to post a
notice for five days on or near the door of the Council Chambers
of the City Hall inviting sealed proposals or bids for doing the
work ordered and referring to the specifications on file and to
publish a notice inviting such proposals for two days in the
Evening Outlook, a newspaper published and circulated in said
city.
SECTION 5. Reference hereby is made to said Resolution
of Intentlon for a description of the work, the assessment
dlstrlc"t, the bonds to be issued and for further particulars.
SECTION 6. The city Clerk shall certify to the adoption
of this Resolution, and thenceforth and thereafter the same shall
be In full fo~ce and effect.

As a member of the above Homeowners' ASSOCIatIon I WIsh to
protest the spec1al assessment be1ng created by the above
resolutIon.
The reason I am reg1ster1ng thIS protest IS due to the fact that
last year, under assessment #155 for streetllght Installatlons on
Callfornla Street between 18th and 20th Street, thlS property has
already paId for street llghts that were lnstalled at the south-
east corner of Cal1forola and 18th streets and on the north SIde
of Calliornla across the street from 1806 Callfornla. I feel
that thlS double assessment 18 lnequltable.
