Introduction
ThIS report requests that the Clty Councll accept petItIons and
adopt a ResolutIon to notIfy property owners of the constructIon
of such streetllghtlng, set a pUblIC hearIng, and declare Its
lntentIon to assess property owners for costs and issue oonds as
securlty for unpald assessments fo r the followIng areas:
1. Twenty-fifth Street between PICO and Pearl;
2. Strand between SIxth and LIncoln Boulevard;
3. PrInceton between Santa MonIca Boulevard and Colorado
Avenue; and
4. Stanford, Berkeley, FranklIn and Centinela Avenue all
between Santa Monlca Boulevard and Colorado Avenue;
5. Euclld Street between Broadway and Colorado Avenue.

The CIty CouncIl in~tiates InstallatIon of streetlIghts at the
request of resIdents. Requests usually are In the form of a
petItIon, SIgned by a majOrIty of property owners. However
OrdInance No. 1300 (CCS) allows tenants as well as property
owners to Initiate proceedIngs for the InstallatIon of
streetlights 1n thelr neIghborhood. Staff prepares the petitIons
for clrculatlon upon request by Interested CItIzens. SInce
CounCIl adopted OrdInance No. 1300, staff has receIved requests

After the pet1tlon 1S prepared, It 1S cIrculated among affected
resIdents by a ne1ghborhood coord1nator. To date, four pet1t1ons
have been returned wIth the requIred number (60%) of slgnatures
for the follow1ng streets:
1. Twenty-fifth Street between P1CO and Pearl;
2. Strand between SIxth and Lincoln Boul ev ard j
3. PrInceton between Santa MonIca Boulevard and Colorado
Avenuej and
4. Stanford, Berkeley, Frankl1n and Cent1nela Avenue all
between Santa MonIca Boulevard and Colorado Avenue.
D1agrams 1ndlcatIng the exact boundar1es of the Assessment
D1strlcts are posted 1n the CouncIl Chambers.
Upon receIpt and reView by staff, the Signed petIt10ns were sent
to the Rent Control staff. Rent Control staff revIewed the
pet1tIons and Issued d report statIng that the pet1tIons
contaIned a suffiCIent number of sIgnatures to qualIfy for
pass-through to tenants of streetl1ght 1nstallatlon costs
assessed to property owners (Attachment A). The Rent Control
Board adopted the RegulatIon allOWing pass-through of costs to
tenants on July 5, 1984.
1500 Block of EuclId
As part of the Community Development Block Grant (CDBG) public
hearing process, residents on the 1500 block of EUClId Street

requested that streetllghts be Installed uSlng CDSG funds. Staff
determined that thlS IS an eliglble CDBG proJect. However Slnce
avallable CDBG fund s were approved for other proJects It IS
proposed to use general fund s for thlS streetllghtlng proJect.
There IS no formal petltlon requestlng streetllghts for
submlSSlon to CouncIl Slnce thIS request resulted from the CDBG
hearlng process.
It 1S current Clty practlce to pay 100% of the res1dent1al shar e
of streetllght 1nstallat1on costs 1n CDBG eligible areas.
Therefore, res1dentlal and soclal service frontage on the 1500
block of Eucl1d wIll not be assessed. However, commercial
propertIes wlll be assessed. Staff recommends that thIS project
be Included 1n the proposed assessment dIstrIct to expedlte
constructIon of the streetllghts.

The CIty Counc 11 inItIates proceedIngs to construct streetllghts
and assess property owners for one-half the cost of streetllght
Installatlon by sett1ng a PublIC Hearlng and adopt1ng a
Resolut1on to construct streetllghtlng.
The attached Resolutlon sets the PubllC HearIng for September 11,
1984. Notlce of a Publlc Hearlng wlll be malled to each property
owner and posted on the street In the manner prescrIbed by State
law. In addltlon, staff WIll post a Notlce on the mallboxes of
each apartment bUlldlng.

Part of the assessment d1str1ct, Centlnela Avenue, borders the
C1ty of Los Angeles. Along two blocks of Cent1nela Avenue, the
C1ty llmit 110e is between the sldewalk and the parkway.
Streetl1ghts 1n these two blocks of parkway will actually be
located 1n the C1ty of Los Angeles. Th1S does not present a
maJor problem as the 1911 Act has provls1ons for sltuatlons such
as these. The Los Angeles C1ty Counc II wlll be requested to
adopt Santa Monica's Resolut1on of Intentlon to lnstall
streetllghts and the Los Angeles Street Llght1ng Englneer must
approve the street llghtlng pI an s for Cent1nela. In add1tlon,
the Clty of Los Angeles requlres a hold harmless agreement wlth
the C1ty. Thls will be revlewed by Santa Monlca's City Attorney.
Staff 13 currently working w1th the Clty of Los Angeles staff 1n
order to red uc e any potent1al adm1nlstratlve delays. It 1S
recommended that CounC2l InItIate proceedIngs for Installat10n of
streetllghts concurrent wlth staff's resolut~on of detalls to
lnstall llghtlng on these two blocks of Centlnela. If the
transactIons wlth the Clty of Los Angeles become too lengthy and
delays other streetlIght construction, these two blocks can be
deleted from the present dIstrIct and add ed to a future dIstrIct.

MONICA SETTING A HEARING FOR THE PURP~SE OF DETERfJlINING
WHETHER OR NOT THE PUBLIC CONVENIE'iCE AND NECESSITY
REQUIRE THE CONSTRUCTION OF STREET LIGHTING AND
DECLARING ITS INTENTION TO CONSTRUCT STREET LIGHTING AND
APPURTENANT WORK ON THOSE STREETS SHO\ofN ON CITY DRAWING
NO. 53~4, ALL WITHIN THE CITY OF SANTA MONICA.
WHEREAS, the City CouncIl of the City of Santa !"1on 1C a
proposes to inItIate proceed~ngs under the Improvement Act of
1911 for the Installation of street lighting; and
WHEREAS, SectIon 19 of Article XVI of the CalIfornIa
ConstItutIon provIdes that certaIn specIfIed debt llmItatlon and
maJority protest provisions shall not apply if, after the gIving
of such reasonable notlce by pUblIcatIon and postIng and the
holdIng of such publiC hearing as the City Councll of the CIty of
Santa MonIca sh all have prescrIbed, the CIty CouncIl by no less
than four- fIfths vote of all members thereof, fInds and
determines that the publiC convenience and necessity reqUire the
proposed Improvement to be made; and
WHEREAS, Streets and Hlghways Code Section 2804 provldes
that the "SpecIal Assessment, InvestIgation, LimItatIon and
Majority Protest Act of 1931" shall not apply to an y proceed lng
otherWIse subject thereto when said improvement proceeding is by
a charter CIty and said city has complIed With the prOVIsions of
SectIon 19 of Article XVI of the CalIfornIa Constltut~on; and

and generally known as:

4. The area bounded by Harvard Court, centerlIne of
Santa Monlca Boulevard, centerllne of Cent1nela and

SECTION 2. The total estImated cost of the proposed

SECTION 3 . Improve'llents shall be conducted under the
Il"lprovement Act of 1 9 1 1 , wh1ch is D1VISlon 7 of the Streets and
Hlghways Code of the State of Californla.
SECTION 4. The proposed work or lmprovement in the
oplnion of C1ty Councll of the C1ty of Santa MonIca 1S of more
than local or ord1nary publlC beneflt, and the Clty Councll
hereby proposes that the dlstrlct in the City of Santa Monica to
be benefItted by saId work or Improvernen t and to be assessed to
pay one-half of the cost and expense thereof, 1S shown upon a
certaln map 1ndlcatlng the exterIor boundary thereof, which saId
DrawIng No. 5344 lS on flle in the Office of the Clty Englneer.
The map hereby lS referred to and shall govern for all detalls as
to the extent of sald assessment dlstrlct. The assessment

publIC streets or alleys, or portIons thereof, hereby are
excepted from saId dIstrIct.
SECTION 5 . The CIty WIll pay one-half the cost and
expenses of the work descrIbed h~rein, and the CIty Controller IS
authorIzed and directed to pay the same immediately upon
confIrmatIon of the assessment by the CIty CounCIl. -
SECTION 6. SerIal bonds bearIng Interest at the rate of
12% per annul'1 shall be Issued to represent each assessment of
$150.00 or more remaIning unpaId for 30 days after the recordIng
of the warrant. SaId serIal bond s shall extend over a perIod
endIng nIne years from the second day of January next succeedIng
the next September 1 st follo~nng theIr date. Payments on the
prIncIpal of unpaId assessments and Interest shall be made by
property owners to the CIty Treasurer and the same shall be
dIsbursed by hIm or as provid~d In the "Improvement Act of 191111
hereInafter referred to. In accordance WIth Streets and HIghways
Code Section 6442, the first two percent delInquency penalty
authorIzed by such sectIon shall be retained by the CIty

SECTION 11. Pursuant to PubliC Contract Code SectIon

- PETITION TO INITIATE AN ASSESSMENT
DISTRICT FOR THE INSTALLATION OF

STREET lIGHTS
We~ the underslgned, hereby petition the Honorable City Council of the
City of Santa Monlca, to initlate the proceedings necessary for the
installation of a street lighting system on:
Strand Street Between Slxth Street and Llncoln Boulevard
under the provisions of the Improvement Act of 1911 and the actlons of the
Santa Monica City Council and the Santa Monica Rent Control Board. To be
presented to the Clty Council, the petltion must contain the slgnatures of
the residents in at least 60~ of the housing unlts on the above na~ed blocks.

It is understood that the owners of the property within the proposed
improve~ent district shall bear o~e-half the cost of the constructlQn of
the work. It is further understood that all such property owners xay pay
the costs of the work either through a cash payment or through installment
pa~ents bearing interest pald semi-annually until tpe full amount is
paid, and any unpaid assessments shall become a direct lien against the
particular property so assessed.
In addltion, it is understood that property owners wl1l be authorized by
the ~ent Control Board to pass on the costs of the street lightlng assess~ent
to the resldents of rental units on this block with each unit on a property
sharlng the cost equally. The a~ount charged to renters will be paid monthly
and spread over a ten year period. In most instances, monthly charges will
be less than $2.00 per apart~ent unit and less t~an $5.00 for a single fa~lly
house.

PETITION TO INITIATE AN ASSESSMENT
DISTRICT FOR THE INSTALLATION OF
STREET lIGHTS
We, the undersigned, hereby petition the Honorable Clty Councl1 of the
City of Santa Monica, to initiate the proceedings necessary for the
lnstallation of a street lighting system on:
TWENTY-FIFTH STREET BETWEEN PICO BOULEVARD ANV PEARL STREET
under the provisions of the Improvement Act of 1911 and the actlons of the
Santa Monica Clty Councl1 and the Santa Monlca Rent Control Board. To be
presented to the City Council, the petltion must contain the slgnatures of
the residents in at least 60% of the housing units on the above named blocks.
It 1S understood that the owners of the property within the proposed
lmprovement district shall bear one-half the cost of the constructlon of
the work. It is further understood that all such property owners may pay
the costs of the work either through a cash payment or through lnstallment
payments bearlng interest pald semi-annually until the full amount is
pald, and any unpaid assessments shall become a direct llen agalnst the
particular property so assessed.
In addition, it 1S understood that property owners will be authorized by
the Rent Control Board to pass on the costs of the street lightlng assessment
to the residents of rental units on this block wlth each unlt on a property
sharing the cost equally. The amount charged to renters will be paid monthly
and spread over a ten year period. In most instances, monthly charges wlll
be less than $2.00 per apartment unlt and less than $5.00 for a slngle famlly
house.
