SUBJECT: Hold PubliC Hearing on Proposed Street LIghtIng
District on EuclId Between Brentwood Terrace and
Marguerita
Introduction
Th1S report requests the CIty Council to hold a publiC hear1ng to
determIne the convenIence and necessity of street lights and to
order the work on Euclid Street between Brentwood Terrace and
Marguerita.
Background
On September 11 , 1984, staff presented street light petItions for
Eucl1d Street, w1th the requisite number of reSIdents'
slgnatures,to the CIty Counc1l. The petitlons were revIewed by
the Rent Control Board staff. The CIty Counc1l adopted
Resolution No. 6915 (CCS) setting publ1C hearing for the purpose
of determIning whether pUblIC convenience and necessity reqUire
the construction of street lightIng and declaring 1ts intentIon
to construct street llghting and appurtenant work.
The resolution set a public hearing for October 9, 1984, at Wh1ch
tIme any Interested party may address the proposed work or
Improvement. NotIces of Public Hearing were maIled to each
property owner and posted on each street 1n the manner prescrIbed
by State law on September 28, 1984.

Budget/FInancIal Impact
ApproprIation authorIty for FY 1984-85 IS avaIlable In the amount
of $398,000 for the CIty'S share of the street light InstallatIon
cost In Capital ProJects Account Nos. 01-770-453-000-902 and
01-770-453-000-903. A prelimInary estimate of the total cost of
this street lighting proJect IS $50,000 wIth the CIty'S share of
the cost beIng $25,000. When Included wIth the cost of the
streetlighting district approved by Council on September 11 ,
1984, the CIty'S total FY1984-85 commItment to fund
streetllghting distrIcts IS $215,000.
RecommendatIon
It IS recommended that the City CouncIl
1 . Open the publIC hearing on the convenience and neceSSIty
and the Resolution of Intention;
2 . Close the publIC hearing and acknowledge any protests; and
3. Adopt the attached resolutIon fInding that the public
convenience and neceSSIty reqUIre the constructIon and
ordering the work.

You are hereby notifled that the Clty Coune11 of the City of Santa Monlca,
Cal1forn1a, adopted Resolution No. 6915 (CCS) on September 11, 1984, declaring
lts intentlon to construct street 11ghtlng and appurtenant work in the above
named area, determining that bonds be issued to represent the cost therefor.
declar1ng the work to be of more than local ord1nary public benef1t, and
that the expense thereof shall be assessed upon a d1strlct.
A public hearlng regard1ng the proposed improvement will be held at 7:30 P.M.,
October 9, 1984, ln the Council Chambers, Clty Hall. 1685 Main Street, Santa
Mom ca . All protests regarding thlS matter must be flled ln writ1ng in the
Office of the City Clerk before sald t1me, and all protests so f11ed wll1 be
considered by the Clty Councll at that tlme. Each protest must contain a des-
criptlon of the property in WhlCh each signer thereof 15 interested.
The total proJect cost is estlmated to be approximately $50,000. The amount
to be assessed upon the d1strict for this lmprovement 1S approximately 525,000.

INFORMATION SHEET FOR PASS-THROUGH OF COSTS
Through the State of Callfornla Improvement Act of 1911, It is
possIble for a maJorIty of the property owners of a neIghborhood
to obtaIn Improvements such as street lightlng. The CIty
Councll's past policy was to InItiate a street llghtlng distrIct
If 60% of the property owners petItIoned for street lIghts.
Under new procedures adopted by the CIty Council and the Rent
Control Board, tenants also may petItion for street lIghts. In
thlS Instance, the pet1tIon must be signed by 60% of the
resIdents In a street lIghting dIstrict. Street lIght petItIons
have been receIved for the areas lIsted on the attached letter.
The CIty Council will assess resIdent1al property owners one-half
the cost of installing the street lightIng. The Clty will pay
the remaInder of the cost. In additlon, the Clty presently pays
all maintenance costs and the cost of the energy to lIght the
street lIghts. By actIon of the CIty Council and Rent Control
Board, If approprIate, the property owner will automatIcally be
able to pass through the cost to the tenants over a 10 year
perIod with each unIt on a property paYIng the same cost. In most
Instances, monthly charges WIll be less than $2.00 per apartment
unIt and less than $5.00 for a sIngle family house. THERE IS NO
CHARGE TO EITHER PROPERTY OWNERS OR TENANTS UNTIL THE STREET
LIGHTS ARE INSTALLED AND WORKING.
The Improvement Act provides that the property owner may pay the
assessment:
1. By Cash. Cash payments may be made withIn 30 days after
the assessment IS confirmed. After 30 days, cash
payments may still be made but Interest must be charged.
OR
2. By Installment Payments. Payments may be made 1n 10
annual installments plus lnterest WhICh 1S bIlled sem1-
annually. The unpaId balance may be paid at any tIme an
Interest payment IS due. (Interest also may be passed
through to tenants.)
FInancial aid for low-to-moderate Income property owners and
tenants is avaIlable. To qualIfy for aSSIstance, a short
applIcation form must be completed after the street lights are
Installed. For further InformatIon, contact the OffIce of
Community and EconomIc Services at 458-8701.

MONICA, IN ACCORDANCE WITH RESOLUTION OF
INTENTION 6915 (CITY COUNCIL SERIES)
WHEREAS, the CIty CouncIl of the CIty of Santa MonIca,on
the 11 th day of September, 1984, passed and adopted Its
ResolutIon of IntentIon, beIng ResolutIon No. 6915 (CCS) ,
declarIng Its IntentIon to order the work descrIbed thereIn to be
done, WhICh sald Resolutlon of Intentlon duly and legally was
publlshed as reqUIred by law and notice of saId l.mprovement has
been gl.ven In the manner reqUIred by law and all wrItten
ObjectIons and protests to the proposed work or the extent of the
dIstrIct to be assessed were heard and conSl.dered by the CIty
CounCIl; and
WHEREAS, a publIC hearIng has been held duly and
regularly pursuant to ResolutIon 6915 (GCS) and the laws and
ConstItution of the State of CalifornIa on the proposed
construction of street llghtIng and appurtenant work thereto, as
descrIbed in the ResolutIon of IntentIon No. 6915 (CCS), on
EuclId Street between Brentwood Terrance and Margueritaj and
WHEREAS, said improvement has been conslderc fully,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:

SECTION 1. The public interest and convenlence require,
and the Clty Councll of the CIty of Santa MonIca hereby orders,
the work described In said Resolution of IntentIon to be done on
EuclId between Brentwood Terrace and Harguerita, all wIthIn the
CIty of Santa MonIca.
Any and all of saId protests and obJectIons of every
kind and nature to the proposed work or to the extent of the
dIstrict to be assessed be and the same hereby are overruled and
denIed.
SECTION 2. The CIty Council hereby finds and determInes
further that the "SpecIal Assessment InvestigatIon, LImItatIon
and MajOrIty Protest Act of 1931" shall not apply to the making
of saId Improvement.
SECTION 3. The Improvements shall be conducted under
the Improvement Act of 1911, WhICh IS DIVISIon 7 of the Streets
and HIghways Code of the State of CalIfornia, and the Street
SuperIntendent and the City Attorney presented to the saId CIty
Council the Resolution of IntentIon required by saId Improvement
Act to InItIate the proceedIngs for saId Improvement.
SECTION 4. The City Clerk hereby IS dIrected to post a
notIce for five days on or near the door of the CounCll Chambers
of the CIty Hall invltlng sealed proposals or bIds for dOIng the
work ordered and r ~errlng to the speCIfIcatIons on file and to
publISh a notice InVItIng such proposals for two days In the
EvenIng Outlook, a newspaper publIshed and CIrculated In saId
CIty.

SECTION 5. Reference hereby 1S made to sa1d ResolutJ.on
of IntentJ.on for a descr1ption of the work, the assessment
