ThIS report requests that the Clty Co un c i 1 accept the petitlon
and ado pt a ResolutIon to notlfy property owners of the request
of streetllghtlng, set a public hearIng, and deolare Its
IntentIon to assess property owners for costs and Issue bonds as
securIty for unpald assessments for the 300 and 400 blocks of
EuclId Street.

Property owners In the 300 block of EuclId requested a str eet
lIghting petItIon fer the 300 and 400 blocks of EuclId Street.
ReSIdents of 63% of the unlts ( SIngle-famIly homes) SIgned the
petltlon. The petItlon was returned to the Clty on August 30,
1984 . (See Attachment A).
Staff IS now submittlng thlS petItion to CounCil so that It can
be Included In the bId package fer the current streetllghtlng
dl.strlct establIshed on August 14, 1984 . If the 300 and 400
blocks of Euclid are not Included In thIS bid package,
Installatlon of lights on EuclId WIll be delayed untIl such tIme
as a suffICIent number of petItlons for addItIonal streets have
been receIved to warrant formatIon of the next street lightlng
dlstrlct. In accordance wlth prevlously adopted Council POllCY,

The CIty CounCIl Initiates proceedIngs to construct streetllghts
and assess property owner s for streetllght InstallatIon by
settIng a Public Hear Ing and adoptlng a Resolution to construct
streetllghtlng.
The attached ResolutIon sets the Public Hearing for October 9,
1984 . NotIce of a PublIC HearIng WIll be maIled to each property
c wn e r and WIll be posted on the street in the manner prescrIbed
by State law.
Budget/FinancIal Impact
Approprlatlon authorIty for FY 1984-85 IS avaIlable In the amount
of $398,000 for the CIty'S share of the streetlIght InstallatIon
cost in CapItal PrOjects Account Nos. 01-770-453-000-902 and
01-770-453-000-903. A prelIminary estImate of the cost of thIS
streetllghtlng project IS $50,000 wIth the CIty'S share of the
cost beIng $25,000. When Incl uded wIth the cost of the
streetllghtlng dIstrIct approved by CounCIl on August 14, 1984,
and scheduled for publIC hearIng or the September 11 , 1984,
agenda, thIS wo U 1 d brIng the Clty'S total FY 1984-85 commitment
to fund streetllghting districts to $215,000.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA SETTING A HEARING FOR THE PURPOSE OF DETERMINING
WHETHER OR NOT THE PUBLIC CONVENIENCE AND NECESSITY
REQUIRE THE CONSTRUCTION OF STREET LIGHTING AND
DECLARING ITS INTENTION TO CONSTRUCT STREET LIGHTING AND
APPURTENANT WORK ON THOSE STREETS SHOWN ON CITY DRAWING
NO. 5344, ALL WITHIN THE CITY OF SANTA MONICA.
WHEREAS, the CIty Council of the CIty of Santa Monica
proposes to InItIate proceedIngs under the Improvement Act of
1911 for the installatIon of street lIghting; and
WHEREAS, Section 19 of Article XVI of the Californla
ConstItution provides that certaIn specifIed debt lImitatIon and
majOrity protest prOVISIons shall not apply If, after the gIving
of such reasonable notIce by publicatIon and postIng and the
holding of such publiC hearIng as the City CounCIl of the City of
Santa Monlca shall have prescrIbed, the CIty CounCil by no less
than four-fifths vote of all members thereof, fInds and
determInes that the public convenIence and neceSSIty reqUIre the
proposed improvement to be made; and
WHEREAS, Streets and HIghways Code SectIon 2804 prOVIdes
that the "Special Assessment, Investigation, LImltatlon and
MajOrIty Protest Act of 1931" shall not apply to any proceeding
otherwl.se subject thereto when saId improvement proceedlng IS by
a charter CIty and saId CIty has complied wIth the provlslons of
SectIon 19 of Article XVI of the Callfornla ConstItution; and

WHEREAS, the City of Santa MonIca IS a charter CIty of
the State of CalIfornIa,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION l. The CIty CouncIl proposes to InItIate
proceedIngs for the construction of street lIghtIng and
appurtenant work on those streets shown on CIty DrawIng No. 5344
and generally known as the 300 and 400 blocks of EuclId Street.
SECTION 2. The total estimated cost of the proposed
Improvement IS $50,000.
SECTION 3. Improvements shall be conducted under the
Improvement Act of 1911, WhICh IS DIVIsIon 7 of the Streets and
HIghways Code of the State of CalIfornia.
SECTION 4. The proposed work or Improvement In the
opinIon of CIty CouncIl of the CIty of Santa MonIca IS of more
than local or ordinary publiC benefIt, and the CIty CouncIl
hereby proposes that the dIstrIct In the CIty of Santa Monica to
be benefitted by saId work or Improvement and to be assessed to
pay one-half of the cost and expense thereof, IS shown upon a
certaIn map IndIcatIng the exterior boundary thereof, WhiCh said
Drawing No. 5345 IS on fIle in the OffIce of the CIty EngIneer.
The ~ap hereby is referred to and shall govern for all detaIls as
to the extent of said assessment dIstrIct. The assessment
dIstrict includes in general the lots and parcels descrIbed In
SectIon 1 above but reference hereby IS made to said Drawing for

all detalls as to the extent of saId assessment distrIct and for
any varIatIon between the last mentIoned general descrIptIon and
the extent of said assessment dlstrict as shown on saId map. All
public streets or alleys, or portIons thereo f , hereby are
excepted from saId dIstrIct.
SECTION 5 . The City wIll pay one-half the cost and
expenses of the work descrIbed hereIn, and the CIty Controller is
authorIzed and dIrected to pay the same ImmedIately upon
confIrmatIon of the assessment by the CIty CouncIl.
SECTION 6. SerIal bonds bearing Interest at the rate of
12% per annum shall be Issued to represent each assessment of
$150.00 or lJlore remainIng unpaId for 30 days after the recordIng
of the '..larrant. SaId serIal bonds shall extend over a perIod
endIng nIne years from the second day of January next succeedIng
the next September 1st following theIr date. Payments on the
prInCIpal of unpaid assessments and Interest shall be made by
property owners to the CIty Treasurer and the same shall be
dIsbursed by hIm or as prOVIded in the "Improvement Act of 1911"
hereInafter referred to. In accordance WIth Streets and HIghways
Code Section 6442, the fIrst two percent delInquency penalty
authorIzed by such sectIon shall be retaIned by the CIty
Controller as the cost of serVIcIng the delInquency.
SECTION 7 . Notice is hereby gIven that on Tuesday, the
9th day of October, 1984, at 7:30 P.M. , In the CouncIl Chambers
located In the CIty Hall, 1685 MaIn Street, at 7:30 P. M. , in the
CouncIl Chambers located In the City Hall, 1685 MaIn Street,

Santa Honlca, CalIfornIa, there shall be a publIC hearlng before
saId CIty CouncIl for the purpose of determlnlng whether the
pUblIC convenIence and neceSSIty requIre the above descrIbed
Improvement and for the purpose of allOWIng any and all persons
having any obJectlons to the proposed work or 1mprovement to
appear and show cause why the saId proposed work or Improvement
should not be carried out In accordance wIth saId Resolutlon of
IntentIon. InqulrIes concern1ng thIS publIC hearlng should be
directed to the Department of General ServIces at 458-8287.
SECTION 8 . The CIty Clerk shall glve notIce of the
hearIng by postIng a copy of thIS resolutIon 1n the manner
descrIbed by Streets and Hlghways Code Section 5065 and by
publIcatIon as hereInafter prOVIded. Any person Interested may
make protest agalnst the proposed Improvement In wrltlng flled
WIth the CIty Clerk at any tIme not later than the hour set for
the hearIng In the manner prov Id ed by Streets and Hl.ghway Code
SectIon 5220.
SECTION 9. The SuperIntendent of Streets shall cause to
be consplcously posted along the lIne of saId contemplated work
or Improvement and also along all the open streets wIthIn the
saId dlstrlct, notlce of the passage of thls ResolutIon of
Intent10n In the manner and form prescribed by law.
The Clty Clerk hereby lS d J.r ected to mall notIces, In
the manner and form prescrlbed by law, of the adoptlon of thIS
resolution to all persons ownlng real property In the
herelnbefore described assessment distrlct, whose names and

addresses appear on the last equalized assessment roll for the
CIty taxes or as known to the Clty Clerk.
SECTION 10. The City Clerk hereby 1S dIrected to
publish this resolution 1n the Evenlng Outlook on two succeSSlve
dates, the first publicatlon lS to be made not less than ten days
prior to the date of the above public hearing.
SECTION 11. Pursuant to PubllC Contract Code SectIon
20433, the City Councll hereby states that the property owners
may not contract for the Improvements and that the Clty shall be
responsIble for letting and adminlstering the constructlon
contract for thlS dlstrict.
SECTION 12 . The CIty hereby declares that Communlty
Development Block Grant funds may be appl1ed for payment of
assessments on property owned or res1ded In by low to moderate
1ncome households.
SECTION 13. The Clty Clerk shall certlfy to the
adoptIon of this resolut10n and thereafter the same shall be 1n
full force and effect.
