ThIS report requests the CIty CouncIl to hold a publIC hearIng to
determIne the converaer.ce and necessIty of street lIghts and to
order the work on Berkeley and 14th Streets between Santa MonIca
and WIlshIre Boulevards, HIll Street between 23rd and 25th
Streets, 26th Street from PICa Bouleva:"d to Pearl Street, and
CalIfornIa Avenue between 18th and 20th Streets.

On August 13, 1985, staff presented street lIght petItIons for
the above streets wIth the requIsIte number of resIdents'
signatures to the CIty CouncIl. The petItIons were reVIewed by
the Rent Control Board staff. The CIty Council adopted
ResolutIon No. 7065 (eCS) settIng publIC hearIng for the purpose
of determInIng whether publIC convenIence and necessIty requI:"e
the construct lOr. of stieet lIghtIng and declar'lng Its IntentIon
to construct street lIghtIng and appurtenant work.
The resolutIon set a publIC hear'ing for September 10, 1985 t at
WhICh tIme any Interested party may address the proposed work or
Improvements. NotIces of PublIC HearIng were maIled to each 7-,4
property owner and posted on each street In the manner prescrIbed SEP 1 0 1985

You are hereby notifled that the Clty Council of the Clty of
Santa Monlca, Callfornla, adopted Resolutlon No. 7065 ( CCS ) on
August 13, 1985, declaring lts lntentlon to construct street
lightlng and appurtenant work In the above named area, determlning
that bonds be lssued to represent the cost therefor, declaring
the work to be of more than local ordlnary publlC beneflt, and
that the expense thereof shall be assessed upon a distrlct.
A publlC hearing regardlng the proposed lmprovement wlll be held
at 7:30 P.M., September 10, 1985, In the Councll Chambers, Clty Hall,
1685 Maln Street, Santa Monica. All protests regardlng this matter
must be flIed ln writing ln the Offlce of the Clty Clerk before
sald tlme, and all protests so flIed wlll be consldered by the
Clty Councll at that tlme. Each protest must contain a descrlption

ASSESSMENT PAYMENT PROCEDURES
Th.....ough the State of Callforrna Improvement Act of 1911 , it IS
possIble for a majOrIty of the property owners of a neIghborhood
to obtaIn Improvements such as street lIghtIng. The Act provIdes
that the costs of the Improvements such as surveYIr:ig, preparIng
plans. constructIO!"l costs, preparIng CouncIl resolutIons,
advertIsIng, InspectIon and preparElg the assessment and bor.ds
may be assessed to the property owner.
The CIty CouncIl's past POlICY was to I'1Itiate a str eet lIghtIng
dIstrict If 60% of the property owners petitIoned for street
lIghts. Unde..... !"Jew procedures adopted by the CIty CounCIl and the
Rent Control Board, ter,ants also may petItion for street lIghts.
1'1 thIS l'1sta!1Ce, the petItIon must be sIgned by 60% of the
reSidents In a street lIghting dIstrIct.
The City CounCIl presently assesses property owr,ers one-half the
cost of Installing the street lIghtIng. The City pays the
remaInder of the cost. In addItIon. the CIty prese!ltly pays all
maI"ter.:ance costs and the cost of the e!"]ergy to light the street
lights. By actIOr. of the City Cou!"lcIl and Rent Control Board,
when tenants circulate the petItior., the property owner may pass
through the cost to the teYla!'lts over a 10 year perIod WIth each
unIt Or:! a property paying the same cost. IY] most Instances,
monthly charges WIll be less tha'1 $2.00 per apa.....tment ur;It and
less than $7.00 for a Single famIly house. THERE IS NO CHARGE TO
EITHER PROPERTY OWNERS OR TENANTS UNTIL THE STREET LIGHTS ARE
INSTALLED AND WORKING.
The Improveme!1t Act provIdes that the property OW'1er may pay the
assessment:
1. By Cash. Cash payments may be made wIthIr. 30 days after
the assessment IS confIrmed. After 30 days, cash
payments may still be made but Interest must be charged.

the work descrIbed In saId ResolutIon of IntentIon to be done on
Berkeley and 14th Streets between Sant a MonIca and WllshH'e

Any and all of said protests and ObjectIons of every
kInd and r,ature to the proposed work or to the extent of the

SECTION 2. The City Council hereby fInds and determInes
further that "Special Assessment InvestigatIon, LimitatIon and
MajOrIty Protest Act of 1931" shall not apply to the makIng of
saId Improve~ent.
SECTION 3. The improvements shall be conducted under the
Improvemer.t A.;t of 1911 , which IS DivisIon 7 of the Streets and
Hlgn'".;ay Code of t.h e St.ate of Cal~foi'nla. and the St.reet.
Super"l7!tel1dent and the City Attorney presented to the saId CIty
Counc:al the Resolutlon of Intention requlred by said Improvement
Act to IDltlate the proceedings for said Improvement.

EvenIng Outlook, a newspaper pUblIshed and Circulated In saId
CIty.
SECTION 5. Refel"ence hereby IS made to saId Resolution
of Intention for a descrIptIon of the work, the assessment
dIstrIct, the bonds to be issued and for further partIculars.
SECTION 6. The CIty Clerx shall certIfy to the adoptIon
of thIS ResolutIon, and thenceforth and thereafter the same shall
be In full force and effect.

I hereby protest the construction of street
lights on Berkeley Street between Santa Moni-
ca and Wilshire Blvds.
I do not wish to live under the Hollywood
glare of street lights when I presently feel
the neighborhood is perfectly safe without
lights as is.
I feel strongly about this --as perhaps other
residents do, but I do not have the ability
or time to canvas the neighborhood for a door
to door survey.
Postpone construction until a thorough vote
has been taken.

Upon receipt of the City Clerkls July, 1985 letter I contacted the General
Services Office for price information. Between $300 and $500 was quoted.
the same as when the petltion was clrculated. Upon receipt of" the August
letter I again called the City Clerk I s office and this time the cost had
risen to $775.00. Upon questioning this exorbitant amount, it was explained
a street light would be installed on 2Jrd, which has no homes to light. No
where in the petition was 2Jrd stfeet mentioned, nor was the light mentioned
at the time I talked to the City Clerk1s office.
Slnce this Ii neighborhood venture. a petition signed by at least 60~g of the
neighborhood, the cost of any additional lighting should be pl"orated to a.ll
residences on Hlll Street.
T am therefore protesting the assessment for a useless light that was not
petitioned nor signed for.
