Assessment District on Various City streets
Introduction
This report requests that the city council hold a pUblic hearing on
the establishment of an assessment district for the construction of
concrete gutters and street resurfacing on various city streets.
Background
On February 27, 1990, the City council adopted Resolution No. 7980
(CCS) setting a public hearing for March 27, 1990 to hear any protests
concerning the construction of concrete gutters and street resurfacing
on:
loth street - Colorado Avenue to Wilshire Blvd
12th street - Colorado Avenue to Wilshire Blvd
17th street - Arizona Avenue to California Avenue
Ocean Park Boulevard - 25th street to 31st street
Notices of the public hearing were mailed to property owners and
posted on March 19, 1990, in accordance with state law.
No residential properties will be assessed for gutter construction or
street resurfacing.
Consistent with present policy for assessing
commercial properties, this assessment will be a cash
assessment and

no bonds will be issued. Commercial property owners will be assessed
the full cost for the construction of the gutters. This cost is
estimated at $9.50 per lineal foot based on recent contract prices.
Commercial property owners will also be assessed approximately
one-half the cost of the street resurfacing. It is estimated that the
assessment will be $7.50 per lineal foot. This charge will be
approximately 10-20% of the total cost of the resurfacing depending on
the width of the street. The proposed assessment is designed so that
each commercial property owner would pay the same unit assessment cost
regardless of the width of the street on which their property fronts.
For a commercial property owner with a 50-foot lot, the total
estimated assessment would be $375.00 for resurfacing and $475.00 for
gutters.
Budget/Financial Impact
Appropriation authority for the construction of this work is in the
"streets, Traffic Control and Parking" capital Improvement Program
category, Account No. 01-770-421-25290-8917-99152 I "street
Resurfacing". This project will be part of the 1989-90 street
Resurfacing Project.
The assessments for gutter installation and street resurfacing will
generate approximately $25,000 in revenues which will be deposited in
Revenue Account No. 01-500-4011-00000-0124-10000. Cash revenues will
be received in FY 1990-91. Any unpaid assessments will be placed on
the 1991-92 tax roll.
Recommendation
It is recommended that the City Council:
1. Open the public hearing;
2. Close the public hearing and acknowledge any protests; and
3. Adopt
the
attached
Resolution
establishing
a
gutter
construction and street resurfacing district on the above named
City streets.

This letter is legal notice as required by the Improvement Act of
1911 proceedings under which the above work will be done.
You are hereby notified that the city council of the City of
Santa Monica, California, adopted Resolution No. 7980 (CCS) on
February 27, 1990, declaring its intention to resurface streets
and construct gutters on various city streets ad 1 isted above,
declaring the work to be of more than local ordinary public
benefit, and that a portion of the expense thereof shall be
assessed upon a district. Commercial property owners will be
assessed approximately $9.50 per lineal foot for gutter
construction and $7.50 per lineal foot for street resurfacing.
RESIDENTIAL PROPERTIES WILL NOT BE ASSESSED.
A public hearlng regarding the proposed improvement will be held
at 7:30 P.M., March 27, 1990, in the Council Chambers, City Hall,
1685 Main street, Santa Monica, California 90401. All protests
regarding this matter must be filed in writing in the Office of
the City Clerk before said time, and all protests so filed will
be considered by the City Council at that time. Each protest must
contain a description of the property in which each signer
thereof is interested.
The total project cost is estimated to be approximately
$1,148,477. The amount to be assessed upon the district for this
improvement is approximately $25,000. Records available indicate
you own property in the above district. Requests for copies of
the Resolution of Intention which contain further particulars on
this assessment and all questions regarding the proposed
improvement may be directed to Bill Zein in the Office of the
city Engineer at 458-8721.

WHEREAS, written notices of said improvements have been given
in the manner required by law; and
WHEREAS / any and all written obj ections and protests to the
work or the extent of the district to be assessed were heard and
considered by the City Council,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. The public convenience and necessity requires the
construction of concrete gutters and street resurfacing along:
loth Street between Colorado Avenue and Wilshire Blvd:
12th street between Colorado Avenue and Wilshire Blvd;
17th Street between Arizona Avenue and California Avenue: and
Ocean Park Boulevard between 25th street and 31st Street,
all within the City of Santa Monica.
SECTION 2 .
All protests and obj ections of every kind and
nature to the construction of concrete gutters and the street
resurfacing along:
10th street between Colorado Avenue and wilshire Blvd.:
12th street between Colorado Avenue and wilshire Blvd.:
17th street between Arizona Avenue and California Avenue: and
Ocean Park Boulevard between 20th Street and 31st street,
as described in Section 1, all within the City of Santa Monica, be,
and the same are hereby, overruled and denied.
SECTION 3. Pursuant to streets and Highways Code Section 5880,
the street Superintendent is directed to commence the construction of
concrete gutters and street resurfacing above-described after a sixty
(60) day period wherever the property owners have not started the
gutter construction and street resurfacing themselves.
SECTION 4.
The city Clerk shall certify to the adoption of
this ReSOlution, and thenceforth and thereafter the same shall be in
full force and effect.

We, Bruce and Monique Friedman.are writing this letter to voice our
strong opposition to the proposed repaVing of 12th Street, (Resolutton
of Intentlont79~O).the street on which we live. Our opposition 1s
fueled by many significant factors:
1) Twelfth Street does not need to be repaved. As daily,repeated tra-
velers of 12th Street,we know this as fact.
2} The tl,148,477 earmarked tor this project could be better used to
fund desperately needed anti-drug and anti-gang law enforcement task
forces throughout the City of Santa Monica; Olympic Park and Santa
Monica High School. especially warrant such task forces. (The money
c~uld also be used to shelter, clothe and feed the Santa Monica home-
less, many of whom live out of vehioles parked on 12th Street.)
J) Parking availability on 12th Street 1s already in a crisis situa-
tion. This needless repaving project would terrifyingly worsen the
situation. Parking on 12th Street is already hampered by Santa Monica
Ford, which parks its excess and employee vehicles on 12th Street, the
design center on Colorado and 12th Street which,though enlarging its
parking lot to include the sidewalk. still has &any employees and visi-
tors who consistently park on 12th Street, b7 tna construction activi-
ty occurring across the street from our residence, by the_arohitectur-
al firm/also across the street/which has yet to provide parking for
its visitors or even employees, and by the postal workers who use 12th
Street tor parking their personal vehicles. (Our building only prOVides
one acesslble parking space for our three bedroom apartment. which hous-
es three drivers who each own a car.)
Consequently this unnecessary repaving project would force us to park
blocks away from our resldenee,( even if 12th Street 1s excluded trom
the project,resldents from streets which are being repaved will park on
12th Street). This is frightening considering our separate,evenlng com-
mlttments and the tact that we will be forced to repeatedly walk our
drug and gang infested streets alone. Indeed we may only be winconven-
ienced" by this repaving project, (needles8 though it 1s), for a number
of weeks. but the memory of an assault, robbery or rape will devastate
a lifetime.
