Introduction - '
This report requests that the City Council hold a public hearing for
the assessment of costs to r~pair damaged sidewalks, driveways and
curbs at various locations within the City. It is recommended that
the Cit~r Council ad~pt the attached Resolution confir~ning tha
assessment of costs.

On Decen~ber 12, 1990t the City Cauncil set a public hearing for
January 8, 1991, on the assess~aent of costs to repair damaged
sidewalks, driveways and curbs within the City of Santa Monica.
Notices were sant on December 28, 1990 to property awners in~arming
them of the public hearinq in aacordance with the legal requirements
of Chapter 22 of the Improvement Act of 1911,
Budget~Financial Impact
This assessment district wi11 generate revenues to the City over the
next two years in the amaunt of $6,994.50. Any unpaid assessments
will be placed on the 1991-2992 property tax bills.

It is recommended the City Counci.l:

OF OBSTRUCTIONS, PERF~RMEfl UNDER PR~VI~IONS DF DIVISION 7,
CHAPTER 22, SECTIQNS 5600 TO 5630, OF THE STREETS AND HIGHWAYS
CODE OF THE STATE OF CALIFORNIA (SR-91-166)
P~arsuant to the provisions of Division 7, Chapter 22, Sec~ion~
5600 to 5630, af ~he Streets and Highways Code of the State of
~
California, the foll~wing work wa~ caused to b~ dane by the Street
Supsrintendent:
The re~noval (only) of 10 square feet o~ parkway area at $3.00
per square foot.
The remo~al and rep3.acement of 84 lineal feet of curbing at
$10.50 per lineaZ foot.
The rer~oval and replacement of i50 squara feet ot sidewalk in
driveway area at $7.50 per square foot,
The remava~ and replacement of 859 square feet of sidewalk at
$6.0~ per square foat;
The removal and replacement of 102 square feet of driveway
apran at $7.50 per square foot;
The total cost of the above wark was $7,914.00.
The total propased assessment for the abave sidewalk and curb
damage is $3,957.~0 or 50 percent af the tatal cost. The other 50
percent of the cost is being paid by the City as the abvve repairs
were caused by tree root damage.
The removal and replacement af 100 square feet sidewalk in
driveway area at $7.5a per square foot.
The remaval and replacement af 350 square ~'eet of sidewalk at
$6.00 per square foo~;
The removal and replacement of 25 square feet of driveway
apron at $7.50 per square foot;
The total cost of the above wark was $3,037.50.
The tota~ proposed ass~ssment of the above sidewalk and curb
damage is $3,037.50 or 10~ percent of the tota~ cost of the abave
repairs wer~ not caused by tree r~ot damage.
Reference is made to th~ attached sheets for a description of
the real property in front of which the work has been done, the
proposed assessment aga~nst each property, and a description of tha
work done in frant af each property.

A RESaLUTION OF THE CIfiY COUNCIL OF THE CITY OF
SANTA MONICA CONFIRMING TFiE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIRS TO
DAMAGED SIDEWALKS, DRIVEWAYS AND CURBS (SR-91-166)
WHEREAS, the Superintendent of Streets of the City of Santa
Manica, pursuant to Sectians 5600-5630 of the 3treets and Highways
Cade, commenced proceadings to cause the repair of damaged sidewalks,
driv~ways and curbs in the City of Santa Monica at 1535 Ya1e 5treet,
2143 22nd Street, 2131 22nd Street, 2137 22nd Street, 224 24th Street,
703 18th Street, 1131 Ariaona Avenue, 1127 Santa Monica Boulevard,
i2D~ Santa Mani.ca BouZevard, Z443 12th Street, 3230 Santa Monica
Boulevard, 1305 i2th 5treet, 1802 Santa Monica Boulevard, ~434 18th
St~eet, 1438 ~8th Street, all within the City of Santa Monica; and
WHEREAS, sixty days after said order was served, the work had not
been completed by the awners or persons in passession of the affeated
properties, and the Superintendent of Streets caused the work to be
done; and
WHEREAS, the Superintendent af Streets gave notice as required by
Section 561G of the Streets and Highways Code; and
WHEREAS, the Sup~rintendent af Streets did file with the City
Council of the City af Santa Manica a repart of r~pairs and costs as
required by Section 5fi17 af the Streets and H~ghways Code; and
WHEREAS, upan the day and hour fixed for hearing by ResoZution
Number 8137 (CCsy, the City Council of the City ~f Santa Monica heard
and passed upon the report of the Superintendent of Streets together
~ .
~ with all objectians and pratests as required by Section 5618 of the
Streets and Highway Code,
NOW, THEREFORE, THE CITY COi7NCIL OF THE CITY QF SANTA MONICA DOES
RESOLVE A5 FOLLOWS:
SECTION 1. The report of the Superintendent of Streets heretofore
filed and abovE-described be, and the same hereby is, confirmed.
SECTION 2. All protests and objectians of every kind and nature
to the report of the Sup~rintendent of Streets be and the same hereby
are, overruled and denied.
SECTION 3. The cast of the repairs, as set forth in the report of
the Superintendent of Streets, shall be assessed against the
properties therein described, which praperties front the aidewalk upon
which the repairs were made.
SECTION 4. If such assessment is not paid within the time
permitted by law, the same shali constitute a special assessment
against and Iien on the groperties therein described in the amount set
fo~th in the report of the Superintendent of Streets, which lien shall
continue until the ass~ssment and all interest thereon is paid or
until it is discharged of record.
SECTION 5. If the assessment ~s not paid within the time
permitted by law, the Superintendent of Streets, in accordance with
Section 5628 of the Streets and Highway Code, shall deliver a Notice
of Lien, prepared in the manner required by Section 5626 of the
Streets and Highways Code, to the County Auditor who shall col~ect the
assessment together with all other taxes against the property.

~ SECTION 6. The City Clerk shall certify to the adaption of this
Reso~ution, and thenceforth and thereafter the same shall be in full
force and effect.
