ThIS report requests the CIty CounCIl to approprIate funds l~ the
amourt of $12,000 to proceed WIth the resurfaCIng of Ozone Place
North between LIncoln Boulevard and HIghland Avenue, recommerds
the formatIon of aJ'l assessmert dIstrIct to assess property owrers
100% of the cost of the proJect, a~d requests a PublIC HearlPg be
set for July 23, 1985.
Background
For approxImately the last forty years, the CIty's POlICY
regardIng alley resurfaCIng has beer to assess the property
owrer s, whose propert I es are adJ acent to the all ey, for 100% of
the cost of resurfaCIng. To Implemert thIS POlICY an assessment
dIstrIct 1S formed, CIty staff deSIgns and bIds the proJect, ard
the cost of the resurfaCIng IS returned to the General Fund by
assessmerts to the property owrers.
The reasons for asseSSIng property owners for the full cost of
resurfacirg ar alley are:
1) Alleys are considered secordary access roads
(streets are prImary access);

If alleys were lncluded, thlS freque~cy would

4) Only about 70% of the C'lty has alleys and If
General Fupd mor.les are expended, a portlon of
resldents would Dot
beneflt from the Llty'S
General Fund expendlture.
There have been two except lons to thlS POllCY:
1) CDBG fund s
were used to pay for the cost of resurfaclng ln one CDBG-ellglble
area, and 2) sewer funds were used to resurface a~ alley where a
backfllll:'g and resurfaclng Job done by the Clty'S cont,actor
falled several years after lDstalllng the sewer.
Staff proposes the formatlon of an assessment dlstrlct for Ozope
Place North, the alley betweer. Ozore Street ard Navy Street,
Whlch 15 badly deterlorated and lS ln constant reed of repalr.
ReSldents whose property lS adJ acent to thlS alley frequently
COmplalt1 of potholes and dralnage problems and the cornplalnt5
have become more frequent SlDce a recent gas cornpa~y project In
the alley. The residents have asked for resurfaclng lmprovements
to the alley~

The dralrage
problem would be elImInated. The approxImate cost
per property owner would be $350.00.
A stamped post card (Attachmer.t 2) was er>closed WI th the letter
and staff asked that the resIdents and property owners return the
card

ApprOXImately 63% of the property owners resporded VIa post card.
Of those who responded, approXImately 59% were In favor of
resurfacIng and 30% were In favor of reconstruction.
On May 24, 1985, staff dIstrIbuted notIces of a neIghborhood
meetIng (Attachment 3) to be held on May 30, 1985, to the
reSIdents on Navy and Ozone streets whose propertIes border the
alley. NotIces were sent by ~all to off-sIte property owners.
Staff met WIth the neIghbors to see If a concer>sus could be
reached as to WhICh type of Improvement should be recommended to
the CIty CounCIl.
After dIscussIng the proJect, the reslderts
at the meetIng who orlglr>ally voted for reconstructing the alley

agreed to go

wIth the maJorIty who favored resurfacIng, the lower
cost method.
The proposed method of assessment was also dIscussed.
Staff
Informed the resIdents that the CIty has required partIcIpatIoP
from the Southern CalIfornIa Gas Company Ir the amount of
$3,500.00 SInce theIr recent excavatIons and patchIng have caused
a portloP of the problems In thIS alley.
The remaInder of the
cost IS proposed to be assessed to the property owners WIth CIty
contrIbutIon of engIneerIng and IPspectIon serVIces.
Staff
Informed the
resIderts of the avaIlabIlIty of lOW-Income
aSSIstance.
Staff has sent a memo to Rert Control askIng them to InvestIgate
the possIbIlIty of the landlord paSSIng through costs to te~ants,
slPce there are several rental unIts on Navy and Ozone Streets.
ThIS would be simIlar to the pass-through of costs for
streetlIghts that the Rert Control Board approved last year.
Budget/FIPanCIal Impact
The estImated proJect cost IS $10,000.
In accordance WIth
standard engIneerIng practice, cor>tlngencles F' the amount of
$2,000 should also be encumbered
The Southern CalIfornIa Gas
Company contributed $3,500 WhICh was receIved on Harch 26,1985,
and deposl ted In Account Ho. 01-906-140-000-000.

assessmepts. Staff IS requestlPg the CIty CounCIl to approprlate
funds

between Ozone and Kavy Streets. In the letter we explalned met~ods
available for lmprovlng the alley and enclosed a stamped postcard for
your response. Approx~nately 89% of those respond~ng want to e~ther
resurface or reconstruct the al1ey wlth the understand~ng t~at there
wlll be property owr.er assessrrents.
We would l~ke to ~eet wlth the res~dents to dec~de ~hlCh method of
lmprovement we should recc~mend to the Clty Co~r.cll. ~rs. Kennerly
at 703 Ozone has offered to let us use her house on May 3u, 1983,
at 7:00 p.m. for the neetlng.
