JUL 2 3 f9as TO: Mayor and CIty CouncIl FRO ~1 : CIty Staff SUBJECT: PublIC HearIng on ResurfacIng Ozone Place North between LIncoln Boulevard and HIghland Avenue IntroductIon ThIS report requests the CIty CouncIl to hold a publiC hearIng or the establIshment of an assessment dIstrIct for the resurfacing of Ozone Place North between LIncoln Boulevard and HIghland Avenue. Background In March, 1985 staff was approached by resIdents regardIng Ozone Place North, the alley between Ozone Street and Navy Street from LIncoln Boul ev ard and HIghland Avenue, WhICh IS badly deterIorated and IS In constant need of repaIr. ReSIdents whose property IS adjacent to thIS alley frequently complaIned of potholes and draInage problems and the complaInts have becofTIe more frequent SInce a recent gas company project In the alley. The resIdents have asked for resurfacIng Improvements to the alley. ThIS portIon of the CIty IS very level and there IS very lItle slope In the alley from block to block. ThIS has contributed to standIng water and deterIoratIon of the pavement. On Apr 11 26, 1985, staff sent a let tel (Attachment 1) to the resIdents and property owners of Navy and Ozone Streets whose ?-c:. JUt 2 ~ 19ft - , - . . ~rope~ty IS adJacent to the alley. The letter explaIned optIons regardIng ImprovIng the alley: 1) The alley can be resurfaced with 1" to 1-1/2" thIckness of asphalt at a cost of about $10,000. The cost per property owner WIll be approxImately $100.00. The resurfacIng wIll have a lIfe of approx Imately 10 years, but WIll not prov Ide for draInage as well as If reconstructIon IS done. It may result In some puddles remaInIng but wIll of course be much better than the eXIstIng. 2) The alley can be reconstructed WIth 3" of asphalt on 6" cru shed rock and WI th a concrete gu t t er In the cent er. ThIS wIll cost approxImately $35,000 and wll1 have a 11 fe of 25+ years. The draInage problem would be elIminated. The approXImate cost per property owner would be $350.00. A stamped post card (Attachment 2) was enclosed WIth the letter and staff asked that the resIdents and property owners return the card IndIcatIng theIr preference of alley Improvement. Approximately 63% of the property owners responded VIa post card. Of those who responded, approxImately 59% were In favor of resurfacIng and 30% were In favor of reconstructIon. On May 24, 1985, staff dIstrIbuted notIces of a neIghborhood meetIng (Attachment 3) to be held on May 30, 1985, to the resIdents on Navy and Ozone streets whose properties border the alley. NotIces were sent by mall to off-SIte property owners. Staff met WIth the neIghbors to see If a concensus could be reached as to WhICh type of Improvement should be recommended to - 2 - . . the C~ty Councll. After dlscussing the proJect, the reSIdents at the meeting who orIginally voted for reconstructIng the alley agreed to go wIth the majOrIty who favored resurfacing, the lower cost method. The proposed method of assessment was also discussed. Staff Informed the resIdents that the Clty has requlred partlclpatIon f~om the Southern CalIfornIa Gas Company In the amount of $3,500.00 SInce their recent excavatIons and patchIng have caused a portIon of the problems In thIS alley. The remaInder of the cost IS proposed to be assessed to the property owners. Staff lnformed the resldents of the avallabI1Ity of lOW-Income assIstance. For approxImately the last forty years, the Clty'S pollCY regardIng al1ey resurfacIng has been to assess the property owners, whose propert1es are adjacent to the alley, for 100% of the cost of resurfac1ng. To Implement thIS POllCY an assessment dlstrlct 1S formed, CIty staff deslgns and blds the proJect, and the cost of the resurfacing IS returned to the General Fund by assessments to the property owners. The reasons for assessing property owners for the full cost of resurfaCIng an alley are: 1) Alleys are cons1dered secondary access roads (streets are pr1mary access); 2) The C1 ty has very 11mI ted funds for resurfaCIng and IS on a 30 year cycle for street resurfaCIng ~ If alleys were Included, thIS frequency would increase to about 40 to 50 years. - 3 - 3) Gas Tax_ndS cannot be used for 4tey resurfaCing or reco~structlon; a~d 4) Only Fund not about 70% of the CIty has alleys and If General monies are expended, a portIon of resldents would benefIt from the CIty'S General Fund expendIture. There have been two exceptIons to thIS pollcy: 1) CommunIty Development Block Grant funds were used to pay for the cost of resurfaclt-:!g In one CDBG-ellglble area J (Ozone Place 15 rwt CDBG elIgIble) and 2) sewer funds were used to resurface ar:: alley where a backfilling and resurfaCIng Job done by the Clty'S contractor falled several years after InstallIng the sewer. On June 25,1985, the CIty CouncIl adopted ResolutIon No. 7041 (CCS) settIng a publIC hearIng for July 23,1985, to hear any protests concernIng the resurfaCIng of Ozone Place North between Llncolu Boul ev ard and HI gh 1 and Avenue. Not IC es of the publIC hearIng were maIled to property owners and posted on affected properties July 12, 1985, In accordance WIth State Law. ~udget/FInanclal Impact The estImated project cost IS $10,000. In accordance WIth standard engIneering pract Ice, contIngencIes In the amount of $2,000 should also be encumbered. The Southern Call forn 1 a Gas Company contrIbuted $3,500 WhICh was receIved on ~1arch 26,1985, and depos 1 ted in Account No. 01-906-140-000-000. The remaInder of the cost (approxImately $8,500) WIll be recovered by assessments. Cl ty CounCIl approprIated funds In the amount of $12,000 at Account Number 01-770-421-000-919 on June 25, 1985 to cover the cost of the project plus continger.cles. Assessmer>t revenue WIll be recorded In Revenue Account No. - 4 - . . 01-906-124-000-000, and FY1985-86 revenue estImate WIll be Increased by $8,500 In thIS account. Any unpaid assessments wIll be placed on the property owner's 1987 property tax bIll. RecommendatIon It is recommended that the CIty CouncIl: 1. Open the publIC hearIng; 2. Close the publIC hearIng and acknowledge any protests; 3. Adopt the attached ResolutIon establIshlngresurfacing dIstrict on Ozone Place North between LIncoln Boulevard and HIghland Avenue; and 4.
