Introduction
ThIS report requests that the CIty CouncIl hold a publIC hearlng
for the assessment of costs of gutter constructIon and street
resurfaCing on varlOUS City streets.
Background
On January 28, 1986, the City CounCll set a publIC hearIng for
February 25, 1986, on the assessment of costs of gutter
constructlon and street resurfaCIng on:
MIchIgan Avenue from Cloverfleld to the easterly end
Broadway from 17th Street to Cloverfleld
Nebraska from Stewart Street to Centloela Avenue
CommercIal/IndustrIal Portions of:
32nd Street from PICO Boulevard to Ocean Park Boulevard
33rd Street from Pico Boulevard to Ocean Park Boulevard
The construction work was done as part of the 1985-86 street
resurfaclng proJect.
IndIVldual letters statIng estImated cost of improvements and the
date of the public hearing were mailed to each property owner In
the dlstr lct on February 14, 1986.
The publIC hear lng must be
held pursuant to Sectlon 58ij2 of the Callfornla Streets and
HIghways Code.

No resIdentIal propertIes WIll be assessed for gutter
constructIon or street resurfacIng. Consistent with present
pol~cy for assess~ng commercIal propertIes, thIS assessment w~ll
be a cash assessment and no bonds wll1 be Issued. The commercIal
property owners w~ll be assessed the full cost for the
construction of the gutters. ThIS cost IS estImated at $9.00 per
lIneal foot based on recent contract prices. Staff proposes as
In prevIous years that the commercIal property owners be assessed
approxImately one-half the cost of the street resurfaclng. It is
estImated that the assessment w~ll be $ 7.00 per llneal foot.
ThlS cnarge w~ll be approximately 30-50% of the total cost of the
resurfacing dependIng on the w~dth of the street. 'rhe proposed
assessment is deSIgned so that each commerCIal property owner
would pay the same unlt assessment cost regardless of the WIdth
of tne street on which theIr property fronts. For a commerclal
property owner WIth a 50-foot lot, the total estImated assessment
would be $350.00 for resurfacIng and $450.00 for gutters.

ThIS assessment dIstrIct Wlll generate approxImately $108,639.85
and w~ll be depOSIted In Revenue Account 01-906-124-000-000. Any
unpaId assessments WIll be placed on the 1987 property tax b~ll.

STREErs REGARDING GUTTER CONSTRUCTION AND S'rRBET
RESURFACING ON VARIOUS CITY STREETS
~'lHEREAS, the Street Supen.ntendent of tne CIty of Santa
MonIca, pursuant to Section 5870 et seq. of the Streets amd
HIghways Code, commenced proceedIngs to cause gutter constructIon
and street resurfaCIng on:
MIchIgan Avenue from Clover fIeld to the easterly end
Broadway from 17th 3treet to Cloverfleld
Nebraska from Stewart Street to Centlnela Avenue
CommerCIal/Industrial PortIons of:
32nd Street from PICa Boulevard to Ocean Park Boulevard
33rd Street from PICO Boulevard to Ocean Park Boulevard
~~HEREAS, the Super Intendent of Streets served the notice
reqUIred by SectIon 5876 of the Streets and Hlgnways Code and the
CIty Council of the CIty of Santa MonIca held the hearIng
reqUIred by SectIon 5878.1 of tne Streets and Highways Code; and
WHEREAS, SIxty (60) days after the notIce was served, the
work had not been completed by the owners or persons In
posseSSIon of the affected properties, and the SuperIntendent of
Streets caused the work to be donej and
WHEREAS, the Super intendent of Streets gave the notIce
required by SectIon 5881 of the Streets and HIghways Code; and
WHEREAS, tne SuperIntendent of Streets dId fIle WIth the
CIty CouncIl of the City of Santa Monica hIS report of

constructIon and cost as requIred by SectIon 5882 of the Streets
and HIghways Code; and
WHEREAS, upon the day and hour fIxed for hearIng by
Resolut Ion Number 7147 (CCS), tne CIty Counc il of the CI ty of
Santa Monica heard and passed upon the report of the
SuperIntendent of Streets together with all obJectIons and
protests as requIred by SectIon 5883 of the Streets and HIghways
Code;
NOw, THEREFORE, THE CITY COUNCIL OF 'rat: CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOwS:
SECTION 1. That the report of the SuperIntendent of
Streets heretofore flIed and above-descr Ibed be and the same IS
hereby confIrmed.
SECTION 2. That all protests and obJectIons of every kInd
and nature to the report of the SuperIntendent of Streets be and
the same are hereby overruled and denied.
SECTION 3. That the cost of constructIon, as set forth In
the repor t of the Super In tenden t of Str eets, shall be assessed
agalnlst tne propertIes therein descrIbed, WhICh propertIes front
upon the gutters and resurfaced streets so constructed.
SECTION 4. That If such assessment IS not paId WIthIn the
time permItted by law, tne same shall constitute a speCIal
assessment agaInst and lien on the propertIes therein described,
In the amount set forth In the report of the SuperIntendent of
Streets, WhICh lIen shall contInue untIl the assessment and all
Interest thereon IS paid or until It IS dIscharged of record.

SECTION 5. That lf the assessment is not paid withIn the
tIme permitted by law, the SuperIntendent of Streets, ln
accordance wIth SectIon 5893 of the Streets and Hlgnways Code,
shall dellver a NotIce lf LIen, prepared 1n the manner requIred
by Section 5891 of the Streets and HIghways Code, to the County
Auditor who shall collect the assessment together wIth all other
taxes against the property.
SECTION 6.
That the Clty Clerk shall certify to the
adoptIon of thlS resolutIon and thenceforth and thereafter the
same shall be 1n full force and effect.

To the Honorable Members of the City CounCLl:
We are the owners of the property commonly known as 1819
Broadway, and more speciflcal1y descrlbed as:
Lot L, Block 156, Santa Monlca, Callfornla.
We respectfully object to the proposed assessment against our
property for the cost of installation of gutters and street
resurfacing for the followlng reasons:
1. The notIce of the hearlng of the report of the
Superintendent of Streets is lnsufflcient.
Section 5878 of the Streets and Hlghways Code provldes
that said notlce may be given by mall. The Instant
notlce was glven by mail.
Under Section 5870 of the Streets and HIghways Code when
notice by mail may be given, it must be mal1ed at least
15 days prior to the date flxed for the hearing. The
lnstant notIce did not comply with said Sectlon.
The requlrement of notlce lS ]urlsdictlonal and part of
due process of law.
2. Assuffilng, without concedlng, that the notlce of hearing
is suffic~ent, the duty of the owner to construct or to
pay for the cost of constructlog curbs and pavements,
only appl1es to a case where no prevlOus curbs and
pavement have theretofore been constructed.

(a) Any street resurfaclog needed 1S due to the fact
that the CIty elther dId, or permitted to be done, the
dlgging of a trench, and lmproper filllng thereof, along
Broadway, and that particular portion on which our
property fronts. Broadway was arbitrarlly selected for
such trenching.
The trenchlng beneflted the entlre Clty and had no
1mmed1ate or exclusive benefit for our property. We, as
owners, were never glven the opportun1ty of protest1ng
said constructlon.
(b) At the locatIon of our property, there 1S no foot
traffic. Broadway, 1n that area, merely serves as a
conduit for automobile traffic from East to West and vice
versa. Only the general publlC, using the street for
transportatlon benefits from sald lmprovements.
The instant reconstruction and resurfac1ng does not in
any way lmprove or benefit our property or the adJacent
property, for the reason that our property 15 ent1rely
occupied by a body repair shop, and the adJacent
property, constituting the rest of the block, 15 used
solely to store automoblles.
6. Lastly, your Resolution authorizlng the work and the
assessment for the cost thereof, discrlminates unfairly
and unlawfully agaInst commerclal property, ln that it
arbitrarily exempts property used in the same block (as
well as In the same area) for resldentlal purposes.
Obviously, residential property ln that block and area
recelves greater beneflts from the reconstruction and
resurfaclng.
Sections 5870 et seq. of the Streets and Highways Code
does not authorlze such arbItrary and unfa1r
d15crlmlnatlon.
We respectfully petltlon the Council to sustaln objectlons to
the proposed assessments, and to ellminate our property from
the proposed assessments.

Sect~on 5875 of the Streets and Highways Code prov~des
for the duty on the part of the landowner to construct or
to pay for the construction. It refers to cases where a
part of a block has been improved and impl~c~tly appl~eS-
to the owner or owners of that port~on of the block ~n
wh~ch no sidewalks or curbs have been constructed
theretofore.
Th~s is specif~cally spelled out ~n SectIon 5876
provid~ng for Notice to Construct. Th~s Section states
that such Not~ce shall be sent to
... the owner or persons in possession of the
property frontIng on that port~on of the street in
such block in wh~ch no sldewalks or curbs have been
constructed theretofore....
The term "sidewalks or curbs" includes "gutters",
"driveways" and "pavements to the center line of the
street". Sectlon 5871, Ibid.
Nothing 1n Chapter 27 of the Streets and Highways Code
authorizes the CIty Council and/or the Superlntendent of
Streets to assess the owner for subsequent reconstruction
of curbs and gutters or repavement of the street on which
sald owner's property fronts.
3. In the instant case, the street on WhlCh our property
fronts was fully paved, and gutters constructed prior to
the 1nstant reconstruct1on and resurfacing of the
street. Therefore, the C~ty ~s without authority to
assess us for the cost of the sald reconstruction and/or
repaving.
4. Furthermore, as to the gutters, our property has several
wide drlveways and substantlally less than 150 feet of
the frontage had curbs and gutters reconstructed. The
assessment for this portlon lS, therefore, exceSSlve.
5. Agaln a5sum~ng, wlthout conceding, the authority to
assess for reconstruction of gutters and/or resurfacing
of the street on WhlCh our property fronts, equltable
conslderatlons militate aga1nst this particular
assessment.
