Resolution of Intention to Construct Concrete Gutters on
Broadway from Ocean Avenue to Lincoln Blvd.
Introductlon
ThlS report recommends that an assessment district be formed to construct
concrete gutters on Broadway from Ocean Avenue to Lincoln Blvd.
Background
Many of the streets in Santa ~1onica were constructed without concrete gutters
during the period from 1920 to 1950. The asphalt paving at the gutter line
has severely eroded and is a continuous malntenance problem on these streets.
Since 1965 the City has constructed concrete gutters on most streets at City
expense as a part of the resurfacing program. The most recent streets where
this was done were Idaho from 4th to 12th and 23rd Street from Ocean Park Blvd.
to Ashland.
Because of the large numbers of streets which requlre improvements and because
the amount of repair work that can be done using gas tax funds has been
severely eroded by lnflatlon, the staff believes that it is necessary to assess
the costs of the gutters to property owners, and to retain the policy of the
Clty paying for the resurfaclng with gas tax funds. It should be noted that
the staff has been requlring concrete gutters to be installed by developers
since 1978 as a condltion of approval.

The Improvement Act of 1911 provides methods whereby all improvements
including resurfaclng, street lights, street trees, curbs. sidewalks, gutters,
sewers and other improvements may be assessed to abutting property owners.
If the Council adopts the policy of assessing for gutters, as recommended,
and a contlnuatlon of the POllCY of the City paYlng for resurfacing, the
costs wlll be distrlbuted approximately 1/3 to the property owner and
2/3 to the City for a typical street. The assessments wlll be $5.00 per
foot or $750.00 for a typical commercial lot on Broadway (150 ft. frontage)
based on recent bids by private contractors.
Recommendation
It is recommended that the Council adopt the Resolution of Intention setting a
Public Hearing for February 26. 1980.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA DECLARING ITS INTENTION TO CONSTRUCT
GUTTERS ALONG BROADWAY BETWEEN OCEAN AVENUE AND
LINCOLN BOULEVARD WITH THE CITY OF SANTA MONICA
WHEREAS, the Clty Councll of the City of Santa Monica lS
empowered by Section 5870, et seq. of the Streets and Highways Code
of the State of California to construct gutters at various locations
withln the City of Santa Monlca;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. That the public interest requires and it is the
intention of the City Council of the Clty of Santa Monlca to order the
followlng work to be done, to wit: The constructlon of concrete gutters
along Broadway from Ocean Avenue to Lincoln Boulevard all in the City of
Santa Monica. The estimated essessment cost of the lmprovement lS $5.00
per front foot.
SECTION 2. That said proposed work or improvement in the
opin10n of the City Council of the C1ty of Santa Monica is of more than
local or ordinary public benefit, and said Council hereby proposes that
the district in the City of Santa Mon1ca to be benefited by said work or
improvement and to be assessed to pay the cost and expense thereof,
lncludes all of the property abutt1ng Broadway between Ocean Avenue and
Lincoln Boulevard.
SECTION 3. Notice hereby 1S glven pursuant to sald Sect10n
5870 et seq. that on February 26, 1980, at the hour of 7:30 p.m. 1n the
Council Chambers in the Clty Hall of said City of Santa Monlca, sltuated
at 1685 Main St. In sald City, any and all persons having any obJections

to the proposed work or lmprovement may appear before the Clty Council
and show cause why the sald proposed work or improvement should not
be carrled out in accordance with sajd Resolutlon of Intention.
SECTION 4. The Superlntendent of Streets immediately shall
cause to be conspicuously posted along the llne of said contemplated
improvement notice of the passage of this Resolutlon of Intentlon in the
manner and form prescribed by law.
The Clty Clerk hereby is dlrected to main notice. in the
manner and form prescrlbed by law, of the adoption of thlS resolutlon to
all persons owning real property in the hereinbefore descrlbed assessment
dlstrict, whose names and addresses appear on the last equalized assessment
roll for city taxes or as known to the City Clerk.
SECTION 5. The City Clerk shall certify to the adoption of
this resolutlon and thenceforth and thereafter the same shall be in full
force and effect.
