Proposed Concrete Gutter Construction on Broadway Between
Ocean Avenue and Llncoln Boulevard (G-8D-l)
Introduction
ThlS report requests the C1ty Council to hold a public hearing for
constructlon of concrete gutters on Broadway between Ocean Avenue and
Lincoln Boulevard and to adopt the attached resolution under the provlsions
of Chapter 27 of the Improvement Act of 1911.

The City Council at its meeting on January 22, 1980, adopted Resolution of
Intentlon No. 5464 for the subject gutter construction (Item 6J). This
resolution set a public hearing for February 26, 1980. Notices were posted
along Broadway as required. Wrltten notices were mailed to the property
owners abutt1ng the proposed project, designating the tlme and date of the
hearlng and the approximate cost to them.
This construction is part of a complete reconstruction of the street whereby
the street will be repaved, curbs repa1red where needed, handlcapped ramps
installed, and 51dewalks replaced where needed.
The City wlll lnvite blds and award the contract for the constructlon to
the lowest responslble bidder. The estimated cost to the property owner
is $5.00 per front foot.

The property owners may do the construction work themse1ves. Those property
owners who wish to perform thelr own work must commence the work within 60
days from the date of adoption of the resolution orderlng the work. If
the work is do~e by any property owner, there will be no assessment to
that property.
Recommendation
It 1S recommended that the City Council:
1. Hold the public hearlng in accordance with the Resolution of
Intention No. 5464 (CC5);
2. Close the public hearing; and
3. Adopt the attached resolution ordering the work.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA DECLARING ITS INTENTION TO CONSTRUCT
GUTTERS ALONG BROADWAY BETWEEN OCEAN AVENUE AND
LINCOLN BOULEVARD WITH THE CITY OF SANTA MONICA
WHEREAS, the Clty Council of the City of Santa Monlca is
empowered by Section 5370, et seq. of the Streets and hlghways Code
of the State of California to construct gutters at varlOUS locatlons
withln the City of Santa Monlca;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ~ONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. That the publ1C lnterest requlres and lt 1S the
lntention of the City Counell of the Clty of Santa Monlca to order the
following work to be done, to Wlt:' The constructlon of concrete gutters
along Broadway from Ocean Avenue to L1ncoln Boulevard all 1n the Clty of
Santa Monlca. The estimated essessment cost of the ~mprovement is $5.00
per front foot.
SECTION 2. That said proposed work or lmprovement in the
opinlon of the C1ty Council of the Clty of Santa Monlca lS of more than
local or ordinary public beneflt, and sald Councl1 hereby proposes that
the distrlct ln the City of Santa Monlca to be beneflted by sald work or
improve~ent and to be assessed to pay the cost and expense thereof,
includes all of the property abutt1ng Broadway between Ocean Avenue and
Lincoln Boulevard.
SECTION 3. Notlce hereby 15 glven pursua~: to said Sect~on
5870 et seq. that on February 26, 1980, at the hour of 7:30 0 m. 1n the
Counell Chanbers l~ the Clty Hall of S31d C.ty of Santa ~onlca. sltuated
at 1585 Ma1n St. 1n sa1a Clty, any arc all persons haVing any oDJectlons

to the proposed work or lmprovement may appear before the Clty Council
and show cause why the sald proposed work or lmprovement should not
be carried out ln accordance with saId Resolutlon of Intentlon.
SECTION 4. The Superintendent of Streets immediately shall
cause to be consplcuously posted along the llne of said contemolated
lmprovement notice of the passage of thlS Resolutlon of Intentlon 1n the
manner and form prescrlbed by law.
The City Clerk hereby is directed to maln notice, in the
manner and form prescrlbed by law, of the adoption of thlS resolution to
all persons ownlng real property in the hereinbefore described assessment
district, whose names and addresses appear on the last equallzed assessment
roll for city taxes or as known to the City Clerk.
SECTION 5. The Clty Clerk shall certlfy to the adoptlon of
thlS resolutlon and thenceforth and thereafter the same shall be in full
force and effect.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA ORDERING THE CONSTRUCTION OF CONCRETE
GUTTERS ON BROADWAY BE~AEEN OCEAN AVENUE AND LINCOLN
BOULEVARD) IN ACCORDANCE WITH RESOLUTION OF INTENTION
NO. 5464 (CITY COUNCIL SERIES)
WHEREAS) the City Council of the City of Santa Mon1ca, on the
22nd day of January, 1980~ passed and adopted its Resolution of Intention,
being Resolution No. 5464 (City Councl1 Series), to order the work described
there1n to be done, which in accordance w1th sald Resolution of Intention
duly and legally notices were posted along the line of the proposed project
and written notices of said improvement have been given in the manner
required by law and any and all written obJections and protests to the work
or the extent of the district to be assessed were heard and considered by
the City Council.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. That the public interest requires, and the City
Council of the City of Santa Monica hereby orders the construction of
concrete gutters described in said Resolution of Intention to be done along
Broadway between Ocean Avenue and Lincoln Boulevard within the C1ty of Santa
Monica. That all of said protests and objections of every kind and nature to
the proposed work or to the extent of the district to be assessed be and the
same hereby are overruled and denied.
SECTION 2. That Street Superintendent hereby 1S directed to
commence the construction of concrete gutters above described after a
60-day period wherever the property owners have not started the gutter
construction themselves.

SECTION 3. The City Clerk hereby is directed to post a
notice for five days on or near the door of the Council Chambers of the
City Hall invlting sealed proposals or bids for dOlng the work ordered
and referring to the specifications on file in the Office of the City Engineer
and to publlSh a notlce invitlng such proposals for two days in the Evening
Outlook, a newspaper publlshed and circulated in said Clty.
SECTION 4. Reference hereby is made to sald Resolution of
Intention for a map of the assessment district~ and for further particulars.
SECTION 5. The City Clerk shall certify to the adoption of
thlS resolution and thenceforth and thereafter the same shall be ln full
force and effect.
