Introduction
This report requests that City Councll hold a public hearlng for construction
of concrete gutters on Colorado Avenue from Ocean Avenue to Llncoln Boulevard
and to adopt the attached resolutlon under the provisions of Chapter 27 of
the Improvement Act of 1911.
Background
The City Council at lts meeting on April 22, 1980, adopted Resolution of
Intention No. 5566 for thlS gutter constructlon (Item 6-K). This resolution
set a pub11C hearlng for May 27, 1980. Notlces were posted along Colorado
Avenue, Written notices were mailed to the property owners abuttlng the
proposed proJect, deslgnatlng the time and date of the hearlng and the approx-
lmate cost to each owner.
The Clty wl11 invlte bids and award the contract for the construction to the
lowest responsible bidder. The estlmated cost to the property owner is $5.00
per front foot.
The property owners may do the constructlon work themselves. Those property
owners who wish to perform thelr own work must commence the work wlthin 60 days
from the date of adoption of the reso1utlon orderlng the work. If the work is
done by any property owner, there wlll be no assessment to that property.

Introductlon
T~lS re~ort recommends the formatlon of an assessment distrlct to construct
concrete gutters on Colorado Avenue from Ocean Avenue to Llncoln Boulevard.
It also requests the Council to set a pub11C hearing for May 27, 1980.
Background
rany of the streets in Santa Monica were constructed without concrete gutters
durlng ~he perlod fram 1920 to 1950. The asphalt paving at the gutter 11ne
has severely eroded and is a contlnuous ~aintenance proble~ on these streets.
Slnce 1965 the Clty has constructed concrete gutters on most streets at City
expense as a part of the resurfacing program. The most recent streets where
thlS was done are Idaho from 4th to 12th, and 23rd from Ocean Park to Ashland.
Because of the large numbers of streets which require improve~ents and because
the amount of repair work which can be done uS1ng gas tax funds has been severely
eroded by lnflatlon. the staff belleves lt is necessary to assess the costs
of the gutters to property owners, and to retaln the policy of the City paYlng
for the resurfacing wlth gas tax funds. It should be noted that the staff
has bee~ requlrlng concrete gutters to be lnstailed by developers Slnce 1978
as a condition of approval.

lncludlng resurfacing, street lights, street trees, curbs, sldewalks, gutters.
sewers, and other lmprovements ~ay be assessed to abutt,ng property owners.
The assessments wlll be 55.00 per feot or $75C for a typical commercial lot
on Colorado Ave. (150 ft. frontage) based on recent bids by pr,vate contractors.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MO~ICA DOES
RESOLVE AS FOLLOWS:
SECTION 1. That the public interest requires and it is the lnten-
tion of the City Council of the City of Santa Monica to order the followlng
work to be done, to Wlt: The construction of concrete gutters along Colorado
Avenue from Ocean Avenue to Lincoln Boulevard all 1n the City of Santa Monlca.
The estlmated assessment cost of the improvement is $5 00 per front foot.
SECTION 2. That sald proposed work or lmprovement in the opinio~
of the Clty Council of the Clty of Santa Monica is of more than local or
ordinary public benef1t, and sald Councl1 hereby proposes that the district
in the City of Santa Monica to be benefitted by sald work or 1mprove~ent
and to be assessed to pay the cost and expense thereof. includes all of the
property abutting Colorado Avenue between Ocean Avenue and llncoln Boulevard
SECTION 3. Notice hereby is glven pursuant to sald Section 5870
et seQ. that on May 27, 1980, at the hour of 7:30 p.m. in the Councl1
Chambers 1n the City Hall of sald C1ty of Santa Mcnlca, situated at 1685
Maln St. In sald Clty. any and all persons havlng any Ob]ectlons to the

proposed work or lmprovement may appear before the City Councll and show
cause why the said proposed wor~ or lmprovement should not be carried out
in accordance with said Resolutlon of Intentlon.
SECTION 4. The Superintendent of Streets-immedlately shall cause
to be conspicuously posted along the 11ne of said contemplated lmprovement
notice of the passage of thlS Resolution of Intentlon ln the manner and form
prescribed by law.
The City Clerk hereby is directed to mail notlce, in the manner
and form prescribed by law, of the adoptlon of this resolution to all
persons owning real property in the herelnbefore described assessment district
whose names and addresses appear on the last equalized assessment roll for
Clty taxes or as known to the Clty Clerk.
SECTION 5. The City Clerk shall certify to the adoption of thlS
resolutlon and thenceforth and thereafter the same shall be in full force
and effect.

WHEREAS, the Clty Council of the C1ty of Santa Monlca, on the
22nd day of April, 1980, passed and adopted its Resolut1on of Intentlon,
belng Resolution No. 5566 (City Council Series), to order the work descrlbed
there1n to be done. WhlCh 1n accordance with said Resolutlon of Intention

duly and legally notices were posted along the 11ne of the proposed project
and wrltten notices of said improvement have been glven in the manner requlred
by law and any and all written obJections and protests to the work or the
extent of the distrlct to be assessed were heard and consldered by the City
Council .
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONiCA DOES
RESOLVE AS FOLLOWS:
SECTION 1. That the public 1nterest requlres, and the City Councll
of the Clty of Santa Monica hereby orders the construction of concrete gutters
descrlbed 1n sald Resolutlon of Intentlon to be done along Colorado Avenue from
Ocean Avenue to Lincoln Boulevard \'Ilthln the City of Santa ["lonlca. That all
of sald protests and objections of every kind and nature to the proposed work
or to the extent of the dlstrlct to be assessed be and the same hereby are
overruled and denied.
SECTION 2. That Street Superlntendent hereby is directed to commence
the construction of concrete gutters above descrlbed after a 50-day perlod
wherever the property owners have not started the gutter constructlon themselves.

SECTION 3. The C1ty Clerk hereby lS dlrected to post a notlce
for flve days on or near the door of the Council Chambers of the C1ty Hall
invitlng sealed proposals or bids for doing the work ordered and referrlng
to the speciflcatlons on fl1e In the Offlce of the City Englneer and to
publish a notlce lnv1t1ng such proposals for two days ln the Evenlng Outlook,
a newspaper published and c1rculated in sald City.
SECTION 4. Reference hereby 1S made to sald Resolutlon of
Intention for a map of the assessment dlstrlct. and for further particulars.
SECTION 5. The City Clerk shall certlfy to the adoption of th1S
resolutlon and thenceforth and thereafter the same shall be In full force and
effect.
