Background The street Resurfacing Program approved for FY1986-87 includes gutter construction, street resurfacing and other construction on various residential, commmercial and industrial areas of the city. Pursuant to current city policy, an assessment district is formed to include only commercially or industrially-zoned properties fronting on the streets to be improved with concrete gutters and street resurfacing (residential properties are not assessed). The proposed assessed costs are: 1) 100% of the cost of gutter construction estimated at $9.50 per front foot, and 2) approximately 50% of the cost of street resurfacing estimated at $7.00 per front foot. The total proposed assessment is $16.50 per front foot if both items are constructed in front of a property. (Some properties presently have concrete gutters. ) The areas to be included in the assessment district are: 7th street between Wilshire and San vicente 22nd Street between Michigan and Pennsylvania Princeton between Wilshire and Santa Monica Yale Street between Wilshire and Santa Monica 18th Street between wilshire and Santa Monica 7-8 JAN 1 3 1987 e e On December 9, 1986, the city council appproved the formation of the assessment district and set a public hearing for January 13, 1987, to hear any protests. In accordance with the Improvement Act of 1911, the fOllowing noticing procedures were followed: 1) notices were mailed to commercial property owners fifteen days in advance of the public hearing (December 29, 1986) , 2) notices were posted on the subject properties, and 3) the Resolution of Intention adopted December 9, 1986, was published on December 23 and 24 in the Evening Outlook. Budget/Financial Analysis The assessment district will generate revenues of approximately $40,000 for FY 1987-88. A detailed breakdown of assessments will be available upon confirmation of assessments after the work has been completed. Recommendation It is recommended that the City Council: 1. Open the public hearing on the convenience and necessity and the Resolution of Intention; 2. Close the public hearing and acknowledge any protests; and 3. Adopt the attached resolution finding that the public convenience and necessity require the construction and ordering the work done. TOTAL COPIES 3' '. e e RESOLUTION NO. 7359(CCS) (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA FINDING THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE STREET RESURFACING AND CONSTRUCTION OF GUTTERS IN ACCORDANCE WITH RESOLUTION OF INTENTION NO. 7341 (CITY COUNCIL SERIES) WHEREAS, the City Council of the City of Santa Monica, on the 9th day of December, 1986, passed and adopted its Resolution of Intention, being Resolution No. 7341 (CCS), declaring its intention to order the work described therein to be done, which said Resolution of Intention duly and legally was published as required by law and notice of said improvement has been given in the manner required by law and all written objections and protests to the proposed work or the extent of the district to be assessed were heard and considered by the city Council; and WHEREAS, a public hearing has been held duly and regularly pursuant to Resolution 7341 (CCS) and the laws and Constitution of the state of California on the proposed street resurfacing and construction of gutters and appurtenant work thereto, as described in the Resolution of Intention No. 7341 (CCS) on: 7th street between Wilshire and San vicente 22nd Street between Michigan and Pennsylvania Princeton between Wilshire and Santa Monica Yale Street between WilShire and Santa Monica 18th Street between Wilshire and Santa Monica WHEREAS, said improvement has been considered fUlly, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: e e .. SECTION 1. The public interest and convenience require, and the City Council of the city of Santa Monica hereby orders, the work described in the Resolution of Intention to be done on: 7th street between Wilshire and San Vicente 22nd street between Michigan and Pennsylvania Princeton between Wilshire and Santa Monica Yale Street between Wilshire and Santa Monica 18th street between Wilshire and Santa Monica all within the City of Santa Monica. Any and all of said protests and objections of every kind and nature to the proposed work or to the extent of the district to be assessed be, and the same hereby are, overruled and denied. SECTION 2. The City council hereby finds and determines further that the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931" shall not apply to the making of said improvement. SECTION 3. The improvements shall be conducted under the Improvement Act of 1911, which is Division 7 of the Streets and Highways Code of the state of California, and the Superintendent of streets and the ci ty Attorney presented to the ci ty Council the Resolution of Intention required by said Improvement Act to initiate the proceedings for said improvement. SECTION 4. A Notice Inviting Bids will be published for two days in the Evening Outlook, a newspaper published and circulated in said city. SECTION 5. Reference hereby is made to said Resolution of Intention No. 7341 for a description of the work, and the assessment district. " e e 'I SECTION 6.
