SUBJECT: Recommendation to Form Gutter, street Resurfacing and
Tree Planting Assessment District for Colorado between
14th street and Cloverfield and Set Public Hearing for
March 10, 1987
Introduction
This report recommends that the City Council approve the
formation of an assessment district to construct concrete
gutters, reconstruct the street and plant trees along Colorado
Avenue between 14th street and C1overfield.
It also requests
that the City Council adopt the attached Resolution of Intention
and set a public hearing for March 10, ~987, for the
establishment of the appropriate assessment district.
Background
The reconstruction of Colorado Avenue between 14th street and
Cloverfield was approved by the city Council in FY 1984-85 as a
Federal Aid Capital Project Improvement.
The reconstruction
includes widening the intersections at 17th and 14th to provide
left-turn pockets, changing the striping at 20th to provide a
left-turn pocket, upgrading traffic signals, improving drainage,
providing handicap ramps, and increasing radii at several
intersections to allow buses and trucks to turn without crossing
into other traffic lanes.
The overhead cables will be placed
underground and the poles will be removed within six months. The
reconstruction project, estimated at $750,000, is being financed
approximately 87% by Federal Aid Urban funds and 13% from the
city.s Gas Tax. The Federally funded portion of the project will

be a combination of City of Santa Monica and County of Los
Angeles FAU allocation.
staff is recommending that the city council approve an assessment
district whereby commercial property owners benefiting from the
street resurfacing and gutter construction would be assessed a
portion of the cost in accordance with previously established
pOlicy.
In addition, staff is recommending that commercial
property owners be assessed for a portion of the cost of planting
trees along Colorado. Residential property owerns will not be
assessed.
The proposed assessments, in accordance with City
policy, are as follows:
Gutter construction at $9.50 per front foot,
street resurfacing estimated $7.50 per front foot, and
Tree planting at $3.00 per front foot.
Commercial property owners will be assessed for trees and
concrete gutters if none exist. All commercial property owners
will be assessed for street resurfacing.
If all of the above
items are constructed along a property, the commercial property
owner will be assessed $20 per front foot.
Similar
assessment
districts
have
been
formed
for
the
federally-funded reconstruction of Wilshire Boulevard from Ocean
Avenue to Centinela Avenue and on commerical and industrial
properties in the city I s annual street resurfacing program for
the last three years.

The assessment district will be in accordance with the procedures
set forth in the Improvement Act of 1911 of the California
streets and Highways Code.
BUdget/Financial Analysis
A contract is proposed to be awarded in March 1987.
Budgeted
funds are available for this project. The street resurfacing and
gutter assessments will generate approximately $95,000 and tree
planting revenue will generate approximately $10,000 in revenue
for a total of $105,000 in FY 1987-88. A detailed breakdown of
assessments will be available upon confirmation of assessments
after the work has been completed.
Recommendation
It is recommended that the City Council approve the formation of
an assessment district to construct concrete gutters, reconstruct
the street and plant trees along Colorado Avenue between 14th
street and Cloverfield.
It is also recommended that the city
Council adopt the attached Resolution of Intention and set a
public hearing for March 10, 1987, for the establishment of the
appropriate assessment district.

SANTA MONICA SETTING A HEARING FOR THE PURPOSE OF
DETERMINING WHETHER OR NOT THE PUBLIC CONVENIENCE
AND NECESSITY REQUIRE THE CONSTRUCTION OF CONCRETE
GUTTERS, STREET RESURFACING, TREE PLANTING, AND
APPURTENANT WORK ON COLORADO AVENUE BETWEEN 14TH
STREET AND CLOVERFIELD AS SHOWN ON CITY DRAWING NO.
5617 IN THE CITY OF SANTA MONICA
WHEREAS, the City Councll of the Clty of Santa Monica
proposes to in~ tlate proceedlngs under the Improvement Act of
1911
for
the
construction
of
concrete
gutters,
street
resurfacing, and tree plantlng; and
WHEREAS, Section 19 of Ar tic1e XVI of the Cal i fornia
Constitution provides that certain specIfied debt limItation and
maJorIty protest provisions shall not apply If, after the giving
of such reasonable notice by publ ica tlon and posting and the
holding of such public hearIng as the CIty Counc~l of the C~ty of
Santa Monica shall have prescrIbed, the City CounCIl, by no less
than four-fIfths vote of all members thereof, fInds and
determines that the public convenIence and neceSSIty require the
proposed Improvements to be made~ and
WHEREAS, Streets and Highways Code SectIon 2804 provIdes
that the nSpeclal Assessment, Investlgatlon, Limitation and
MaJority Protest Act of 1931" shall not apply to any proceedIng
otherwise subJect thereto when said improvement proceeding is by
a charter Clty and said city has complled with the provisions of
SectIon 19 of Article XVI of the Callfornla Constltutlon~ and

WHEREAS, the City of Santa Monica is a charter city of.

NOW, THEREFORE, THE CITY COONCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. The CI ty Counc 11 proposes to 1n1 tla te
proceedIngs for the 1nstallatlon of concrete gutters, street
resurfacIng, planting trees and appurtenant work on Colorado
Avenue between 14th Street and Clover fIeld as shown on Dra'..;in3
No. 4617 on fIle in the OffIce of the CIty Engineer.
SECTION 2. The total estImated cost of the proposed
Improvements 15 $750,000.
SECTION 3. Improvements shall be conducted under the
Improvement Act of 1911, WhlCh is DlVlSlon 7 of the Streets and
Hl.ghways Code of the State of California.
SECTION 4. The proposed war k or improvements 1n the
oplnlon of CIty Councll of the Clty of Santa MonIca is of more
than local or ordlnary pub11c benefit, and the Cl.ty CounCil
hereby proposes that commerclal, industrlal or manufacturIng
property owners in the dlstrict in the Clty of Santa Monlca to be
benef 1 tted by sald work or lmprovement to be assessed to pay
approx lmately $9.50 per llneal foot for gutter s, approx ima tely
$7.00 per lineal foot for street resurfacing, and approx1mately
$3.00 per l1neal foot for tree plantlng, of the cost and expense

C1 ty CouncIl for the purpose of determIning whether the pub 1 ic
convenIence and necessity require the above descrIbed
Improvements and for the purpose of allowIng any and all persons
hav ing any obj ectlons to the proposed wor k or Improvements to
appear and show cause why the said proposed work or improvements
should not be carried out In accordance wIth saId Resolution of

saId dIstrIct, notIce of the passage of this Resolut1on of
Intent10n In the manner and form prescr1bed by law.
The CIty Clerk IS dIrected to mail notices, in the
manner and form prescribed by law, of the adoption of thIS
ResolutIon to all persons ownIng commercial, Industrial or
manufactu!:" Ing real property in the here1nbefore descrIbed
assess~ent dIstrict, whose names and addresses appear on the last
equalized assessment roll for the C1 ty taxes or as known to the
CIty Clerk.
SECTION 9. The Ci ty Cler k is dIrected to publIsh thIS
ReSOlution in the Evening Outlook on two successive dates; the
fIrst publIcation is to be made not less than fIfteen days prior
to the date of the above publ1C hearing.
SECTION 10. Pursuant to Public Contract Code SectIon
20433, the C1ty Council hereby states that the property owners
may not contract for the improvements and that the C1ty shall be
responSIble for letting and adm1nisterlng the constructIon
contract for this distrIct.

SECTION 11.
The CIty Clerk shall certify to the
adoptIon of this Resolution, and thereafter the same shall be In
full force and effect.
