Introduction
ThlS report requests that Clty Council hold a public hearlng for construction
of concrete gutters on Maln Street between Pico Boulevard and Holl1ster Avenue
and to adopt the attached resolutlon under the provislons of Chapter 27 of the
Improvement Act of 1911.
Backgroun.d
The City Council at lts meetlng on July 8, 1980, adopted Resolutlon of Intentlon
No. 6037 for this gutter construction (Item 6-G). This resolution set a publ1C
hearlng for August 12, 1980. Notices were posted along Main Street between Pico
Boulevard and Hollister Avenue. Wrltten notlces were ma1led to the property
owners abutting the proposed proJect, deslgnating the tlme and date of the hear-
ing and the approximate cost to each owner.
The City wlll 1nvlte bids and award the contract for the construction to the
lowest responsible bidder. The estimated cost to the property owner is $8.50
per front foot.
The property o\"ners may do the cons tructi on themselves. Those property
owners who wish to perform their own work must commence the work within 60
days from the date of adoptlon of the resolution ordering the work. If the
work 15 done by any property owner, there will be no assessment to that property.

Recommendation
It is recommended that the Clty Council:
1. Hold the public hearing ln accordance with the Resolution
of Intention No. 6037 (CCS).
2. Close the public hearing; and
3. Adopt the attached resolutlon ordering the work.

At a regular meet~ng held on July 8, 1980. the City
Council adopted Resolutlon No. 6037(CCS) declaring the
intent to construct concrete gutters along Main Street
between Pi co Boulevard and Hollister Avenue in the City
of Santa Monica. (Gutter Construct~on DistrIct (G-80-4)).
The estimated assessment cost of the gutter constructIon
of $5.00 per front foot will be assessed to the dlstrict
benefIt~ng from the improvement. This Includes all of
the property abutting Maln Street between Pico Boulevard
and Hollister Avenue.
In order for any and all persons objecting to the proposed
gutter construct~on to have the opportunity to address the
City Council. a publIC hearing has been set for August 12.
1980, at 7:30 P.M. to be held In the Council Chambers.
City Hall, 1685 ~'1aIn Street, Santa \lonica, California. A
copy of Resolution No. 6037(CC5) is attached for your Infor-
mation.
This letter and resolution are being ~alled to all property

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA DECLARING ITS INTENTION TO CONSTRUCT
GUTTERS ALONG MAIN STREET BEn~EEN PICO BOULEVARD
AND HOLLISTER AVENUE IN THE CITY OF SANTA MONICA
WHEREAS, the City Council of the City of Santa Monica is
empowered by Section 5870, et seq. of the Streets and Highways Code
of the State of California to construct gutters at various locations
within the City of Santa Monlca;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ~ONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. That the public interest requires and it is the
intention af the City Council of the City of Santa Monica to order the
following work ta be done, to wit: The construction of concrete gutters
along Main Street from Pica Boulevard to Hollister Avenue all in the City
of Santa Monica. The estimated assessment cost of the improvement is $5.00
per front foot.
SECTION 2. That said proposed work or improvement in the
opinion of the City Council of the City of Santa Monica is of more than
local or ordlnary public benefit. and said Council hereby proposes that
the district in the City of Santa Mon1ca to be benefited by said work or
improvement and to be assessed to pay the cost and expense thereof,
includes all of the property abutting Main Street between P1CO Boulevard
and Hollister Avenue.
SECTION 3. Notice hereby is given pursuant to said Sectlon
5870 et seq. that on August 12, 1980. at the hour of 7:30 p.m. in the
Counctl Chambers in the City Hall of said City of Santa Monica, situated

at 1685 Main Street in said City, any and all persons having any objections
to the proposed work or improvement may appear befo~e the City Council and
show cause why the said proposed work or improvement should not be carried
out in accordance with said Resolution of Intentlon.
SECTION 4. The Superintendent of Streets immediately shall cause
to be conspicuously posted along the line of said contemplated improvement
notice of the passage of this Resolutlon of Intention in the manner and form
prescribed by law.
The City Clerk hereby is directed to mail notlce, in the manner
and form prescribed by law, of the adoption of this Resolution to all persons
owning real property in the hereinbefo~e described assessment district, whose
names and addresses appear on the last equalized assessment roll for city
taxes or as known to the City Clerk.
SECTION 5. The City Clerk shall certify to the adoptlon of this
Resolution and thenceforth and thereafter the same shall be ln full force and
effect.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA ORDERING THE CONSTRUCTION OF CONCRETE GUTTERS ON

WHEREAS, The City Council of the City of Santa r1onlca, on the
8th day of July, 1980, passed and adopted its Resolutlon of Intention, belng
Resolution No. 6037 (City Councll Series), to order the work described there.
in to be done, which in accordance with said Resolution of Intention duly and
legally notices were posted along the line of the proposed project and written
notices of said improvement have been given in the manner required by law and
any and all written objections and protests to the work or the extent of the
distr1ct to be assessed were heard and considered by the Clty Council.
NOW. THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
RESOLVE AS FOLLOWS:
SECTION 1. That the public interest reqUlres, and the City CounCll
of the City of Santa Monica hereby orders the constructlon of concrete gutters
described In said Resolution of Intention to be done along Main Street between
P1CO Boulevard and Hollister Avenue withln the City of Santa Mon1ca. That all
of sa1d protests and objections of every kind and nature to the proposed work
or to the extent of the d1strlct to be assessed be and the same hereby are
overruled and denied.
SECTION 2. That Street Superlntendent hereby is dlrected to commence
the construction of concrete gutters above described after a 60-day period
wherever the property owners have not started the gutter constructlon themselves.

SECTION 3. The City Clerk hereby is directed to post a notice
for five days on or near the door of the Council Chambers of the City Hall
inviting sealed proposals or bids for doing the work ordered and referring
to the speciflcations on file in the Office of the City Engineer and to
publlSh a notice inviting such proposals for two days in the Evening Outloook,
a newspaper publ1shed and circulated in said City.
SECTION 4. Reference hereby is made to said Resolut1on of Inten-
tion for a map of the assessment district, and for further particulars.
SECTION 5. The City Clerk shall certify to the adoption of
this resolution and thenceforth and thereafter the same shall be in full
force and effect.
