Introduction
The City Council set a public hearing for construction of concrete gutters
on Broadway between Lincoln Boulevard and Eleventh Street. It 1S recommended
the Council adopt the attached Resolutlon ordering the work under the provi-
sions of Chapter 27 of the Improvement Act of 1911.
Background
The City Council at its meeting on July 22, 1980, adopted Resolution of In-
tention No. 6048 for this gutter construction (Item 6-L). This resolution
set a public hearing for August 26, 1980. Notices were posted along Broadway.
Written notices were mailed to the property owners abutting the proposed pro-
ject, designating the time and date of the hearing and the approximate cost
to each owner. The Publ1C Hearing was continued to September 9, 1980.
The estimated cost to the property owner is $8.50 per front foot.
The property owners may do the construction work themselves. Those property
owners who wish to perform their own work must commence the work wlthin 60
days from the date of adoption of the resolutlon ordering the work. If the
work is done by any property owner, there will be no assessment to that pro-
pe rty .

to construct concrete gutters on Broadway from Lincoln Boule-
vard to Eleventh Street in the City of Santa MonIca. (Gutter
ConstructIon District (G-80-5)).
The estImated assessment cost of the gutter constructIon of
$8.50 per front foot w~ll be assessed to the dIstrIct benefIting

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA DECLARING ITS INTENTION TO CONSTRUCT
GUTTERS ALONG BROADWAY BETWEEN lINCOL~ BOULEVARD
AND ELEVENTH STREET IN THE CITY OF SANTA MONICA
WHEREASt the City Council of the City of Santa 140nfca 1S
empowered by Section 5870t et seq. of the Streets and Highways Code
of the State of Californ1d to construct gutters at various locat1ons
within the City of Santa Monica;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ~ONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. That the Dublic interest requires and it is the
intention of the City Counc11 of the C1ty of Santa Monlca to order the
fol1owlng work to be done, to wit: The construct1on of concrete gutters
along Broadway from Lincoln 30ulevard to Eleventh Street all in the City
of Santa Monica. The estlmated assessment cost of the improvement is S8.50
per front foot.
SECTION 2. That said proposed work or lmprov~~ent 10 the
opinion of the City Council of the City of Santa Monica is of more than
local or ord1nary publlC benefit, and said Counc11 hereby proposes that
the distrlct in the City of Santa Monlca to be beneffted by sald wor~ or
imorovement and to be assessed to pay the cost and exoense thereof,
includes all of the property abutting Broadway between Llncoln Boulevard
and Eleventh Street.
SECTION 3. Notice hereby 1S given pursuant to said Section
5870 et seq. that on August 26t 1980, at the hour of 7;30 p.m6 in the
Council Chambers 1n the Clty Hall of sa1d C1ty of Santa Monica, sltuated

to the proposed work or lmprovement ~ay appear before the Clty Coune1l a~d
snow cause why the sald proposed work or lmprovement should not be carrled
out in accordance with sald Resolutlon of Intention.
SECTION 4. The Superlntendent of Streets lmmedlately shall cause
to be conspicuously posted along the 11ne of S31d contemplated i~~rovement
notice of the oassage of thls Resclut10n of Intent10n 1n the manner and for~
prescribed by law.
The C1ty Clerk hereby 15 dlrected to mall notlce, in the manner
and fo~ prescrlbed by law, of the adoptlon of thlS Resolutlon to all persons
ownlng real property in the herelnbefore descrlbed assessment district, whose
names and addresses a~pear on the last equal1zed assessment rcli for clty
taxes or as known to the City Clerk.
SECTION 5. The Clty Cle~k shall certlfy to tb-e adoptlon of thlS
Resolutlon and thenceforth and thereafter the same shal1 be 1n f~ll force and
effect.

WHEREAS, the City Council of the City of Santa Monlca, on
the 22nd day of JUlY, 1980. adopted Resolution Uo. 60.aS (City Counei1
Series), belng the Resolution of Intention, ~lch described the work to be
done; and
WHEREAS, in accordance with the Resolution of Intentlon notices were
posted along the line of the proposed project and written notices of the
improvement were mailed in the manner required by law; and
WHEREAS, any and all written objectior-s and protests to the work
or the extent of the district to be assessed were heard and cC1s1dered by
the City Council;
NOW, THEREFORE, THE CITY CC~~CIL OF ~E CITY OF SANTA MaNICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. That the public interest reqUlres, and the City Councll
of the City of Santa Monica hereby orders t~e construction of concrete
gutters described in said Resolution of Intertion to be done along Broaqway
between Lincoln Boulevard and Eleventh Street within the City of Santa Monica.
That all of said protests and objections of every klnd and nature to the
proposed work or to the extent of ~he distrlct to be assessed te and the
same hereby are overruled and denied.

SECTION 2. That Street Superintende~t rereby is dlrected to CD~ence
the construction of concrete gutters above descrlbed after a 60-day period
wherever the property owners have not started tre gutter construction
themselves.
