SUBJECT: Recommendation to Hold Public Hearing for the
Confirmation of Gutter Construction and street
Resurfacing Assessments on Various City streets
Introduction
This report recommends that the city council hold a public
hearing to hear protests regarding the work and to confirm the
assessments for gutter construction and street resurfacing on
various streets as listed below.
Background
On March 25, 1986, the City Council approved the formation of an
assessment district and set a public hearing for gutter and
street resurfacing in conjunction with the 1985-86 street
Resurfacing Program for:
23rd street between Santa Monica and Broadway
Schader Drive between Cloverfield to west end
And those commercial,
portions of:
industrial or manufacturing
Pica Boulevard between Appian Way and 4th Street
Ocean Front from Pico Boulevard to Bay Street
Lincoln Boulevard from Montana to San vicente
19th street between Wilshire Boulevard and Montana
In accordance with long-standing city policy, commercial and
industrial property owners will be assessed for a portion of the
work. The recommended assessments are $9.50 per linear foot for
gutters and $7.50 per linear foot for resurfacing.

owners were notified in accordance with State law and the public

hearing was held on April 22, 1986. After closing the public
hearing, the Council ordered the work to commence.
The work has been completed and commercial and industrial
property owner assessments are now due.
A public hearing to
confirm the assessments must be held pursuant to section 5882 of
the California streets and Highways Code. On March 10, 1987, the
City Council set the public hearing for May 12, 1987. Notices of
public hearing were sent to commercial and industrial property
owners on April 27, 1987.
A list of property owners and
assessments will be available to Council at the time of the
public hearing.
Budget/Financial Impact
$40,789.24 will be generated from property owner assessments.
Revenue will be deposited in Account No. 01-906-124-000-000.
Recommendation
It is recommended that the City Council:
1. Open the public hearing~
2. Close the public hearing, and~
3. Acknowledge any protests and adopt the attached
resolution confirming the assessments.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA APPROVING THE ASSESSMENT
DIAGRAM AND CONFIRMING ASSESSMENTS FOR STREET
RESURFACING AND GUTTER CONSTRUCTION ON VARIOUS
CITY STREETS
WHEREAS, the Clty of Santa Monica, pursuant to Seetlon
5100 et seq. of the Streets and Hlghways Code, commenced
proceedlngs to resurface streets and install gutters on:
23rd Street between Santa Monlca and Broadway, and
Schader Drlve between Cloverfleld to west end.
And those commerclal, industrlal or manufacturlng
portlons of:
P1CO Boulevard between Applan Way and 4th Street;
Ocean Front from Plea Boulevard to Bay Street;
Llnco1n Boulevard from Montana to San Vlcentei
19th Street between Wllshlre Boulevard and Montana.
WHEREAS, the proceedIng lS more fully descrIbed 1n the
ResolutIon of IntentIon adopted by the CIty Councll on March 25,
1986, beIng ResolutIon Number 7183 (CCS); and
WHEREAS, the contract for the above descrlbed work has
been fulfilled to the satlsfaetlon of the Superlntendent of
Streets; and
WHEREAS, the Superlntendent of Streets has made an
assessment to cover the sum due for the work performed and
speclfled in the contract, and;
WHEREAS, the assessment has been filed wlth the Clty
Clerki and

WHEREAS, the City Clerk gave the notlce requIred by
Section 5362 and 5363 of the Streets and HIghways Code; and
WHEREAS, upon the day and hour f~xed for hearing by the
City Clerk, the CIty Council of the City of Santa MonIca heard
and passed upon any and all obJections, appeals, and protests,
NOW, THEREPORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. That all obJectIons, appeals, and protests
of every kind and nature be and the same are, hereby overruled
and denIed.
SECTION 2. That the diagram of property, affected and
benefIted by the street resurfacing and gutter constructIon on:
23rd Street between Santa MonIca and Broadway;
Schader Drlve between Cloverfleld to west end;
And those commercIal, industrIal or manufacturIng
portIons of:
Pico Boulevard between AppIan Way and 4th Street;
Ocean Front from PICO Boulevard to Bay Street;
LIncoln Boulevard from Montana to San VIcente;
19th Street between Wilshire Boulevard and Montana;
In the CIty of Santa Monica, as more fully descrlbed In
Resolution 7183 (CCS) and therein declared to be the property to
be assessed to pay the expense of the Improvements, 1S approved
and the CIty Clerk 1S d1rected to execute the certlflcate on the
diagram certIfying such approval and to dellver the diagram to
the Superintendent of Streets.
SECTION 3. That the assessment for the street
resurfacIng and gutter construction on:

And those commerc~al, ~ndustr~al or manufactur~ng

the same hereby lS, confirmed and approved.
SECTION 4. That the Superintendent of Streets shall
forthwith attach a warrant to saId assessment bearIng the date of
thIS conf1rmatlon.
SECTION 5. The assessment roll, warrant, and diagram
shall be recorded 1n the OffIce of the SuperIntendent of Streets,
and ~mmedlately thereafter the C~ty Clerk shall flle a copy of
the assessment d1agram In the OffIce of the County Recorder, and
thereafter shall record In saId Office of the County Recorder a
NotIce of Assessment, all ~n the manner and form prescribed by
Sect10n 3114 of the Streets and HIghways Code of the State of
CalIfornIa.
SECTION 6. That the City Clerk shall certIfy to the
adoptlon of thIS ResolutIon, and thenceforth and thereafter the
same shall be In full force and effect.

Dear City Council Members
Request assessment to the above properties be voided or reduced
for the following reasons:
I just paid $ 3, 840.00 for resurfacing and gutter work on
Broadway for the same properties. Broadway provides for enter-
ing and egress to subject properties.
One year ago before work commenced 1 called attention to
General Services about the good condition of the street adjoin-
ing these two properties. In the past aU developement activity
which required breaking into the pavement had occured at the
other end of the block. General Services repliedt le City could' ot
do a half block, but that I might get some relief.
My assessment cost for Broadway a 90' wide street for re-
surfacing was equal to 16.6 cents per square foot, wheras
the assessment for Brd street is 50 cents a square foot.

The building occupying the east end of 2225 Broaway facing
on 23rd street is a small house and rent controlled.
I believe this request is rational and since Ceneral Services is
not authorized to act on this matter because of existmg policy
for assessment that does not allow for relief on corner rots
that this City Council do so.
In view of the above circumstances I request the City Council
members concider waiving the assessment on the sides of the
properties allready assessed once when Broadway was resurfaced.
