SR-508-000 (55) e 5?J&'-oCJO 7-]) JUN - 9 1387 Santa Monica, California e GS:SES:JS:6/1/87 Council Meeting: June 9, 1987 TO: Mayor and City Council FROM: city staff SUBJECT: Public Hearing to Confirm Gutter Construction and street Resurfacing Assessments on Wilshire Boulevard from 21st street to Centinela Introduction This report recommends that the city council hold a public hearing to hear protests regarding the work and to confirm the assessments for gutter construction and street resurfacing on Wilshire Boulevard from 21st street to centinela. Background wilshire Boulevard was reconstructed in two phases with federal funds and City matching funds. The first phase, from Ocean Avenue to 21st street, was completed in June 1983. The second phase, 21st street to Centinela Avenue, was approved and budgeted for FY 1984-85. The project was delayed primarily due to the lengthy approval process required by Caltrans (the administrative agency for federal funds). On March 12, 1985, the City Council approved the formation of an assessment district and set a public hearing for April 9, 1985, for gutter installation and street resurfacing on Wilshire Boulevard from 21st street to centinela Avenue. Property owners were notified of the public hearing in accordance with state law. The public hearing was held and Council ordered the work to be done. Bids were received and a contract was awarded on May 13, 1986. The project is complete and assessments are dUe. ~_~ JUN - 9 1981 In . accordance Wi~ long-standing city POI~, commercial and industrial property owners will be assessed for a portion of the work. The recommended assessments are $9.50 per linear foot for gutters and $7.00 per linear foot for resurfacing. Budget/Financial Impact Approximately $135,420 will be generated from property owner assessments. Revenue will be deposited in Account No. 01-906-124-000-000. Recommendation It is recommended that the City Council: 1. Open the public hearing; 2. Close the public hearing and acknowledge any protests: and 3. Adopt the attached resolution confirming the gutter construction and street resurfacing assess- ments for Wilshire Boulevard from 21st street to Centinela. RESOLUTION NO. 7446 (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT OF STREETS REGARDING GUTTER CONSTRUCTION AND STREET RESURFACING ON WILSHIRE BOULEVARD BETWEEN 21ST STREET AND CENTINELA AVENUE WHEREAS, the Street Superintendent of the City of Santa Monica, pursuant to Section 5870 et seq. of the streets and Highways Code, commenced proceedings to cause gutter construction and street resurfacing on wilshire Boulevard between 21st street and centinela Avenue. WHEREAS, the Superintendent of streets served the notice required by Section 5876 of the Streets and Highways code and the City Council of the City of Santa Monica held the hearing required by section 5878.1 of the streets and Highways Code; and WHEREAS, sixty (60) days after the notice was served, the work had not been completed by the owners or persons in possession of the affected properties, and the Superintendent of Streets caused the work to be done; and WHEREAS, the Superintendent of Streets did file with the City Council of the City of Santa Monica his report of construction and cost as required by section 5882 of the Streets and Highways Code; and f WHEREAS, upon the day and hour fixed for hearing by Resolution No. 7430 (CCS), the city Council of the City of Santa Monica heard and passed upon the report of the Superintendent of streets together Jlth all objections and protttts as required by Section 5883 of the streets and Highways Code, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The report of the Superintendent of streets heretofore filed and the above-described be and the same hereby is confirmed. SECTION 2. All protests and objections of every kind and nature to the report of the Superintendent of Streets be and the same hereby are overruled and denied. SECTION 3. The cost of the construction, as set forth in the report of the Superintendent of Streets, shall be assessed against the properties therein described, which properties front upon the gutters and resurfaced streets so constructed. SECTION 4. If such assessment is not paid within the time permitted by law, the same shall constitute a special assessment against and lien on the properties therein described, in the amount set forth in the report of the Superintendent of Streets, which lien shall continue until the assessment and all interest thereon is paid or until it is discharged of record. SECTION 5. If the assessment is not paid within the time permitted by law, the superintendent of Streets, in ~ accprdance with Section 5893 of the Streets and Highways Code, shall deliver a Notice of Lien, prepared in the manner required by Section 5891 of the Streets and Highways Code, to the County Auditor who shall ~lect the assessment toqe~r with all other taxes against the property.
