Set PubllC Hearing for December 9, 1980, for Assessment of
Costs for Gutter Assessment Distrlct No.1 on Broadway (G-80-1)
Introduction
This report requests the Clty Council set a Public Hearing for the assessment
of eosts of Gutter Assessment Dlstrlct No. 1 on Broadway between Ocean Avenue
and Lincoln Boulevard.
Background
On February 26, 1980, the City Council ordered the construction of concrete gutters
on Broadway from Ocean Avenue to Llncoln Boulevard (Item 76). The work has been
completed and property ownerls share of the costs wl1l now be due. A public
hearing must be held pursuant to Section 5882 of the California Streets and
Hlghway Code. A resolution settlng the publlC hearing lS attached. A Property
Map and Assessment Roll will be presented with the Staff Report at the tlme of
the Public Hearing.
Recommendatlon
It is recommended the City Council adopt the attached resolutlon setting a
public hearing for December 9, 1980, on the assessment of costs of Gutter
Assessment Distrlct 1.

RESOLUTION NO. 6128

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA SETTING A HEARING DATE FOR ANY PROTESTS
OR OBJECTIOHS TO THE CONFIRMATION OF ASSESSMENTS IN
GUTTER ASSESSMENT NO. 1 ON BROADWAY.
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE
AS FOLLOWS:
SECTION 1. That the Superlntendent of Streets will flle a report
of work pursuant to Section 5882 of the Streets and Highways Code of the State
of Callfornla, relating to the construction of certain improvements completed
on: Broadway between Ocean Avenue and lincoln Boulevard, all wlthln the
City of Santa Monica.
SECTION 2. That pursuant to Section 5870, et seq. of said Code, the
Clty Caunell does hereby order and declare that on the 9th day of December,
1980, in the Councll Chambers of the Clty Hall, it will hear and pass upon any
and obJections or protests to the report of work of the Superlntendent of
Streets, and the amount of the assessment assigned against the real property
described in said report.
SECTION 3. That all protests or objections must be in writing and
filed with the City Clerk on or before the time set for hearing of protests and
objectlons.
SECTION 4. The Clty Clerk is hereby dlrected to mail notices, in
the manner and form prescribed by law, of the adoption of this resolution to
all persons owning real property in the hereinbefore described assessment dlstriet
whose names and addresses appear on the last equalized assessment roll for
City taxes or as known to the City Clerk.

SECTION 5. The City Clerk shall cert1fy to the adopt1on of this
resolut1on, and thenceforth and thereafter the same shall be in full force
and effect.
