Subject: Setting a Public Hearing for February 10, 1981 to
Confirm the Assessments on Gutter District No.3 along
Second and Fourth Streets between Colorado and Broadway
Introduction
This report requests the City Council set a public hearing for
February 10, 1981 to hear protests regarding the work and confirm
the assessments on the gutter construction along Second and Fourth
Streets between Colorado and Broadway.
Background
On April 22, 1980, the City Council ordered the construction of
concrete gutters along Second and Fourth Streets between Colorado
and Broadway (Item 7B). The work has been completed and property
owners' share of the costs will now be due. A public hearing must
be held pursuant to Section 5882 of the California Streets and
Highways Code.
A resolution setting the public hearing is
attached. The Street Superintendent's Report/Assessment Roll will
be presented at the time of the public hearinQ.
Recommendation
It is recommended the City Council adopt the attached resolution
setting a public hearing for February 10, 1981 on the assessment
of costs of Gutter District No.3.

RESOLUTION NO. 6169
(CITY COUNCIL SERIES)
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA SETTING A
DATE TO HEAR ANY PROTESTS OR
OBJECTIONS TO THE CONFIRMATION OF
ASSESSMENTS IN GUTTER ASSESSMENT
DISTRICT NO. 3 ALONG SECOND AND
FOURTH STREETS FROM COLORADO TO
BROADWAY.
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. That the Superintendent of Streets will file
a report of work pursuant to Section 5882 of the Streets and
Highways Code of the State of California, relating to the
construction of certain improvements completed along: Second and
Fourth Streets between Colorado and Broadway, all
City of Santa Monica.
within the
SECTION 2.
That pursuant to Section 5870, et seq. of
said Code, the City Council does hereby order and declare that on
the 10th day of February, 1981, in the Council Chambers of the
.
City Hall, it will hear and pass upon any and all objections or
protests to the Report of Work of the Superintendent of Streets,
and the amount of the assessment assigned against the real
property described in said report.
SECTION 3. That all protests or objections must be in
writing and filed with the City Clerk on or before the time set
for hearing of protests and objections.
SECTION 4.
The City Clerk is hereby directed to mail
notices, in the manner and form prescribed by 1aw, of the adoption

proposed work or lmprovement may appear before the City Councll and show
cause why the said proposed wor~ or lmprovement should not be carried out
in accordance with said Resolutlon of Intentlon.
SECTION 4. The Superintendent of Streets-immedlately shall cause
to be conspicuously posted along the 11ne of said contemplated lmprovement
notice of the passage of thlS Resolution of Intentlon ln the manner and form
prescribed by law.
The City Clerk hereby is directed to mail notlce, in the manner
and form prescribed by law, of the adoptlon of this resolution to all
persons owning real property in the herelnbefore described assessment district
whose names and addresses appear on the last equalized assessment roll for
Clty taxes or as known to the Clty Clerk.
SECTION 5. The City Clerk shall certify to the adoption of thlS
resolutlon and thenceforth and thereafter the same shall be in full force
and effect.
