Introduction
This report requests City Council hold a Public Hearing for the
assessment of costs of Gutter District No. 2 on Colorado from
Ocean Avenue to Lincoln Boulevard and to adopt the attached
resolution confirming the assessment of costs.
Background
On November 26, 1980, City Council set a public hearing for
January 13, 1981, on the assessment of costs of concrete gutter
construction on Colorado from Ocean Avenue to Lincoln Boulevard
(Item 6G). Individual letters stating the estimated cost of this
improvement and the date of the public hearing were mailed to each
property owner in the district on December 30, 1980. Attached is
Resolution No. 6142 setting the date of the public hearing.
Recommendation
It is recommended City Council:
1. Open the public hearing;
2. Close the public hearing and overrule any protests;
3. Adopt the attached resolution confirming the assessments.

Pursuant to the provISIons of SectIon 5882 of the Streets and
HIghways Code of the State of CalIfornIa, ResolutIon of IntentIon
No. 5566 (GCS), adopted AprIl 22, 1980, and ResolutIon OrderIng
Work ~o. 6008 (CCS), adopted ~ay 28, 1980, the followIng work was
completed prlor to November 1, 1980, to WIt:
The constructIon of 3,043.61 lineal feet of
concrete gutter along Colorado between Ocean
Avenue and Llncoln Boulevard, all wIthIn the
CIty of Santa Monica.
The
total
proposed
assessment to the property owners IS
$25,870.73.
The assessment was made on the basIs of 58.50 per
lineal foot of ~eplacement of asphalt gutte~ wIth Portland Cement
Concrete gutter.
Reference IS made to the attached sheets for a descrIptIon of the
real prope~ty In front of WhICh the wo-k has been done and the
assess~ent agaInst each lot or parcel of land proposed to be
levIed to pay the cost the~eof.

WHEREAS, the CIty CouncIl of the City of Santa MonIca,
pursuant to SectIon 5870, et seq., of the Streets and HIghways
Code, commenced proceedIngs to cause the constructIon of concrete
gutte~s on Colo~ado from Ocean Avenue to LIncoln Boulevard In the
CIty of Santa MonIca,
WHEREAS, a publIC hearIng was held on saId ma~ters, and
thereafter'saId CIty CouncIl ordered the constructIon to be
accomplIshed; and
WHEREAS, SIxty (60) days after saId order was served,
the work had not been completed by the owners or persons In
possessIon of the affected propertIes, and the SuperIntendent of
Streets caused the work to be done; and
WHEREAS, the SuperIntendent of Streets did fIle wIth the
CIty CounCIl of the CIty of Santa MonIca hIS reports of such
work, and a hearIng thereon was called by ResolutIon No. 6142
(CCS); and
WHEREAS, the CIty CounCIl conducted a notIced hearIng to
conslde~ any protests or objectIons to the Report of Work;
NOW, THEREFORE, TYE CITY COUNCIL OF THE CITY OF SANTA
~ONIGA DOES RESOLVE AS FOLLOWS:
SECTION 1. That the Report of Work of the
SuperIntendent of Streets, heretofore flIed and above-desc~lbed,
be and the same IS hereby confIrmed.

SECTiON 2. That all of saId protests and obJectIons of
every kInd and nature to the constructIon or to the assessments
and all appeals the~efrom to saId CIty CounCIl be and the same
hereby are overruled and denIed.
SECTION 3. That the cost of the constructIon, as set
forth In the Report, shall be assessed agaInst the propertIes
hereIn descrIbed, WhICh propertIes front upon the Improvement so
planned.
SECTION 4. That if such assessment IS not paId WIthIn
the tIme permItted by law, the same shall constItute a speCIal
assessment and lIen agaInst the propertIes descrIbed thereIn, In
the amount set forth In the Report, WhICh lIen shall contInue
untIl the assessment and all interest thereon IS paId.
SECTION 5. That If the assessment IS not paId WIthIn
the tIme permItted, the CIty Clerk shall deliver a ~otIce of
LIen, SIgned by the SuperIntendent of Streets, as p~ovIded In
SectIon 5891 of the Streets and HIghways Code of the State of
CalIfornIa, to the County Assessor and Tax Collector, who, In
accordance WIth applIcable law, shall collect saId assessment
together wlh all other taxes relatIng to such property.
SECTION 6. That the CIty Clerk shall certlfy to the
adoptIon of thIS Resolutlon.
