Subject: Public Hearing on Confirmation
Assessments on Gutter District No.3
of
Introduction
This report requests City Council hold a Public Hearinq for the
assessment of costs of Gutter District No.3 on Second and Fourth
Streets between Broadway and Colorado Avenue and to adopt the
attached resolution confirminq the assessment of costs.
Background
On January 14, 1981, City Council set a public hearinq for
February 10, 1981, on the assessment of costs of concrete gutter
construction on Second and Fourth Streets between Broadway and
Colorado Avenue (Item 6-L). Individual letters stating estimated
cost of improvements and the date of the public hearing were
mailed to each property owner in the district on January 30, 1981.
Attached is Resolution No. 6169 setting the date of the public
hearing.
Recommendation
It is recommended City Council:
1. Open the public hearina;
2. Close the public hearinq and overrule any protests;
3. Adopt the attached resolution confirming the assessments.

STREET SUPERINTENDENT'S REPORT
TO THE CITY COUNCIL
COMPLETION OF GUTTER CONSTRUCTION DISTRICT NO. 3
Pursuant to the provisions of Section 5882 of the Streets and
Highways Code of the State of California, Resolution of Intention
No. 5542 (CCS), adopted March 25, 1980, and Resolution Ordering
Work No. 5565 (CCS), adopted April 22, 1980, the following work
was completed prior to November 1, 1980, to wit:
The construction of 1,140 lineal
concrete gutter along Second and
Streets between Broadway and Colordo
all within the City of Santa Monica.

The total proposed assessment to the property owners is $8,415.
The assessment was made on the basis of $8.50 per lineal foot of
replacement of asphalt gutter with Portland Cement Concrete
gutter.
Reference is made to the attached sheets for a description of the
real property in front of whic~ the work has been done and the
assessment against each lot or parcel of land proposed to be
levied to pay the cost thereof.

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA SETTING A
DATE TO HEAR ANY PROTESTS OR
OBJECTIONS TO THE CONFIRMATION OF
ASSESSMENTS IN GUTTER ASSESSMENT
DISTRICT NO. 3 ALONG SECOND AND
FOURTH STREETS FROM COLORADO TO
BROADWA.Y.
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY
RESOLVE AS FOLLOWS:

SECTION 1. That the Superintendent of Streets will file
a report of work pursuant to Section 5882 of the Streets and
Highways Code of the State of California~ relating to the
construction of certain improvements completed along: Second and
Fourth Streets between Colorado and Broadway, all
City of Santa Monica.

That pursuant to Section 5870~ et seq. of
sa:d Code, the City Council does hereby order and declare that on
the 10th day of February, 1981, in the Council Chambers of the

City Hall, it will hear and pass upon any and all objections or
protests to the Report of Work of the Superintendent of Streets,
and the amount of the assessment assigned against the real
property described in said report.
SECTION 3. That all protests or objections must be in
writing and filed with the City Clerk on or before the time set
for hearing of protests and objections.
SECTION 4.
The City Clerk is hereby directed to mail
notices, in the manner and form prescribed by law~ of the adoption

of this resolution to all persons owninQ real property in the

addresses appear on the last eQualized assessment roll for City
taxes or as known to the City Clerk.
SECTION 5. The City Clerk shall certify to the adoption
of this resolution, and thenceforth and thereafter, the same shall
be in full force and effect.

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA CONFIRMING
THE REPORT OF THE SUPERINTENDENT OF
STREETS REGARDING GUTTER DISTRICT
NO.3 ON SECOND AND FOURTH STREETS
WHEREASt the City Council of the City of Santa Monicat
pursuant to Section 5870t et seQ.t of the Streets and Highways
Code, commenced proceedings to cause the construction of concrete
gutters on Second and Forth Streets between Broadway and Colorado
Avenue Boulevard in the City of Santa Monicat
WHEREAS, a pUblic hearing was held on said matterst and
thereafter said City Council ordered the construction to be
accomplished; and
WHEREAS, sixty (60) days after said order was served,
the work had not been completed by the owners or persons in
possession of the affected properties, and the Superintendent of
Streets caused the work to be done; and

WHEREAS, the Superintendent of Streets did file with the
City Council of the City of Santa Monica his reports of such
work, and a hearing thereon was called by Resolution No. 6169
(CCS); and
WHER[~S. the City Council conducted a noticed hearing to
consider any protests or objections to the Report of Work;
NOWt THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. That the Report of Work of the
Superintendent of Streets, heretofore filed and above-described,
be and the same is hereby confirmed.

SECTION 2. That all of said protests and objections of
every kind and nature to the construction or to the assessments
and all appeal s therefrom to said City Council be and the same
hereby are overruled and denied.
SECiION 3. That the cost of the construction, as set
forth in the Report, shall be assessed against the properties
herein described, which properties front upon the improvement so
planned.
SECTION 4. That if such assessment is not paid within
the time permitted by law, the same shall constitute a special
assessment and lien against the properties described therein, in
the amount set forth in the Report, which lien shall continue
until the assessment and all interest thereon is paid.
SECTION 5. That if the assesSment is not paid within
the time permitted, the City Clerk shall deliver a Notice of
Lien, signed by the Superintendent of Streets, as provided in
Section 5891 of the Streets and Highways Code of the State of
California, to the County Assessor and Tax Collector, who, in

accordance with applicable law, shall collect said assessment
together wih all other taxes relating to such property.
SECTION 6. That the City Clerk shall certify to the
adoption of this Resolution.
