Subject: Public Hearing on Confirmation of Assessment
on Gutter Districts No.4 and 5
Introduction
This report requests City Council hold a Public Hearing for the
assessment of costs of Gutter District No.4 on Main Street
between Pica Boulevard and Hollister Avenue and Gutter District
No, 5 on Broadway between Lincoln Boulevard and Eleventh Street
and to adopt the attached resolution confirming the assessment of
costs.
Background
On May 12, 1981, City Council set a public hearing for June 9,
1981, on the assessment of costs of concrete gutter construction
on Main Street between Pico Boulevard and Hollister Avenue and
Broadway between Lincoln Boulevard and Eleventh Street (Item 6-C).
Individual letters stating estimated cost of improvements and the
date of the public hearing were mailed to each property owner in
the dlstrict on May 27, 1981.
Attached is Resolution No. 6252
setting the date of the public hearing.

in accordance with said Resolutlon of Intentlon.
SECTION 4. The Superintendent of Streets-immedlately shall cause
to be conspicuously posted along the 11ne of said contemplated lmprovement
notice of the passage of thlS Resolution of Intentlon ln the manner and form
prescribed by law.
The City Clerk hereby is directed to mail notlce, in the manner
and form prescribed by law, of the adoptlon of this resolution to all
persons owning real property in the herelnbefore described assessment district
whose names and addresses appear on the last equalized assessment roll for
Clty taxes or as known to the Clty Clerk.
SECTION 5. The City Clerk shall certify to the adoption of thlS
resolutlon and thenceforth and thereafter the same shall be in full force
and effect.

COMPLETION OF GUTTER CONSTRUCTION DISTRICTS NO.4 AND 5
GUTTER DISTRICT NO.4
Pursuant to the provisions of Section 5882 of the Streets and
Highways Code of the State of California, Resolution of Intention
No. 6037 eCeS), adopted July 8, 1980, and Resolution Ordering Work
No. 6066 eeCS), adopted August 12, 1980, the following work was
completed prior to March 1, 1981, to wit:
The construction of 2,664.73 lineal feet of
concrete gutter along Main Street between PieD
Boulevard and Hollister Avenue, all within the
City of Santa Monica.
The
total
proposed
assessment to the property owners is
$22,650.21.
The assessment was made on the basis of $8.50 per
lineal foot of replacement of asphalt gutter with Portland
Concrete Cement gutter.
GUTTER DISTRICT NO.5
Pursuant to the provisions of Section 5882 of the Streets and
Highways Code of the State of California, Resolution of Intention
No. 6048 eCeS), adopted July 22, 1980, and Resolution Ordering
Work No. 6071 eCeS), adopted September 9, 1980, the following work
was completed prior to March 1, 1981, to wit:
The construction of 1,793 lineal feet of
concrete gutter along Broadway between Lincoln
Boulevard and Eleventh Street, all within the
City of Santa Monica.

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA SETTING A
DATE TO HEAR ANY PROTESTS OR
OBJECTIONS TO THE CONFIRMATION OF
ASSESSMENTS IN GUTTER ASSESSMENT
DISTRICT NO. 4 ON MAIN STREET
BETWEEN PICa BOULEVARD AND HOLLISTER
AVENUE AND GUTTER ASSESSMENT
DISTRICT NO. 5 ON BROADWAY BETWEEN
LINCOLN BOULEVARD AND ELEVENTH
STREET.
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. That the Superintendent of Streets will file
a report of work Dursuant to Section 5882 of the Streets and
Highways Code of the State of California, relating to the
construction of certain improvements completed along: Main Street
between Pi co Boulevard and Hollister Avenue and Broadway between
Lincoln Boulevard and Eleventh Street, all within the City of
Santa Monica.
SECTION 2.
That pursuant to Section 5870 et seq. of
said Code, the City Council does hereby order and declare that on
the 9th day of June, 1981, at 7:30 P.M., in the Council Chambers
of the City Hall, it wlll hear and pass upon the report by the
Superintendent of Streets, of the cost of construction together
wlth any Objections or protests, if any, which may be raised by
any of the property owners liable to be assessed for the cost of
such construction and any other interested persons.
SECTION 3. That all protests or objectlons must be in
writing and filed with the City Clerk on or before the time set
for hearing of protests and objections.

directed to mall notices, in the manner and form prescribed by
law, of the cost of construction and of the adoption of this
resolution to all persons owning real property in the hereinbefore
described assessment district whose names and addresses appear on

Re: Construction of Concrete Gutters on Main Street
from Pica Boulevard to Eollister Avenue(G-80-~)
Dear City Counell Members:
Last August I addressed the City Council on the then proposed
gutter construction along Main Street from Pico Boulevard to
Hollister Avenue. During that time I questioned the necesslty
of the concrete gutters, and was given a number of legitimate
answers. My response was to proceed with construction before
the costs went up.
In a letter dated July 25, 1980, the city estimated assessment
costs of the gutter construction at $5.00 per front foot. I
received only one letter with an estimated $510.00 assessment
stamped on a sticker. I own two lots facing Main Street, 2021
and 2029, with a total front footage of 120 feet.
Upon completion of construction I received two letters, one
for each of the lot addresses; 2021 and 2029 Main Street,
but each with a $510.00 assessment. The total now raises to
51020.00 the cost of 120 feet of gutter construction, or ~8.50
per front foot. This represents a 70% miscalculation on
estimate~ costs. Instead of oWing the city 5510.00, I now
find the bill to be $l020.00! Going tram $5.00 per front
footage to $8.50 per front footage seems to be quite an
increase to accapt.
Marsha Hafkemeyer of the City's General Services Department
informed me that the street ~as posted ~th an $8.15 notice,
stating the other $.35 was added as administrative costs.
