SUBJECT: Resolution Setting PubllC Hearlng for July 13, 1982, on the
Constructlon of Concrete Gutters on Fourth Street between
Broadway and Arizona
Introduction
This report recommends the formatlon of an assessment distrlct to construct
concrete gutters on Fourth Street between Broadway and Arlzona. It also
requests that Council set a publlC hearing for July 13. 1982, and dlrect
the Street Superlntendent to order the work done.

Concrete gutters should be constructed as a part of the Fourth Street re-
surfaclng proJect. The asphalt paving at the gutter llne 1S severly eroded
and 1S a contlnuous malntenance problem on these streets. Slnce 1965, t~e
C1ty has constructed concrete gutters on most streets as a part of the
resurfaclng program. The most recent streets where thlS \'/aS done are Broad\'1ay
and Colorado from Ocean to Lincoln, and Maln Street from P1CO to Hollister.
The Improvement Act of 1911 provldes methods whereby all lmprovements 1n-
cludlng resurfaclng. street llghts, street trees. curbs, sidewalks and gutters
may be assessed to abutt1ng property owners. As thlS wlll be a commercial
assessment distrlct, Staff recommends thlS be a cash assessment and no bonds
be lssued.
In addit10n, property owners should be assessed the full cost for the
construct1on of the gutters.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA SETTING A PUBLIC
HEARING AND INSTRUCTING THE SUPERINTENDENT
OF STREETS TO GIVE NOTICE TO PROPERTY OWNERS
TO CONSTRUCT GUTTERS ON FOURTH STREET BETWEEN
BROADWAY AND ARIZONA, ALL WITHIN THE CITY OF
SANTA MONICA
WHEREAS. there 1$ a need to construct concrete gutters along Fourth
Street from Broadway to Arizona. all within the Clty of Santa Monica. and
WHEREAS. 1n accordance w1th Section 5860 et seq. of the Streets and
H1ghways Code procedures exist to not1fy property owners of thelr duty to
construct or cause to be constructed the concrete gutters and to dlrect the
Super1ntendent of Streets to construct the concrete gutters if not constructed
or caused to be constructed by the property owners; and
WHEREAS, the City Counc1l of the Clty of Santa Mon1ca on lts own motion
may order the constructlon of the concrete gutters.
NOW, THEREFORE. THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
RESOLVE AS FOLLOWS'
SECTION 1. Pursuant to Sectlon 5875 of the Streets and Highways Code.
the Clty Coune1l of the Clty of Santa Mon1ca orders the construction of con-
crete gutters along Fourth Street from Broadway to Arizona.
SECTION 2. Pursuant to Sectlon 5875 of the Streets and H1ghways Code,
the Superintendent of Streets shall notify, in the manner required by law.
the owners of property along Fourth Street from Broadway to Arizona to
construct or cause to be constructed concrete gutters. The notlce shall
contain the 1nformation required by Section 5879 of the Streets and H1ghways

Code and shall also speclfy the day, hour and place, as set forth ln Section
3 of thlS Resolutlon, where the City Councll of the Clty of Santa Monlca
wlll hear and pass upon objections or protests, lf any, WhlCh may be
ralsed by any property owner or other interested persons.
SECTION 3. That pursuant to Section 5878.1 of the Streets and Hlgh-
ways Code, the City Council of the City of Santa Monlca does hereby order
and declare that on the 13th day of July 1982, at 7:30 P.M., ln the Council
Ch ambe rs 0 f C 1 ty Hall, it Wll1 hea rand pass upon obJ ect 1 ons or pro tes ts ,
lf any, WhlCh may be ralsed by any property owner or other interested person.
SECTION 4. TIle City Clerk shall certify to the adoption of this reso-
lution and thenceforth and thereafter the same shall be in full force and
effect.
