Proposed Concrete Gutter Construction on Fourth Street
between Broadway and Arizona
Introduction
ThlS report requests City Council hold a public hearing for the
construction of concrete gutters on Fourth Street between Broadway
and Arizona.
Background
On June 22, 1982, City Councll set a public hearing for July 13,
1982, on the assessment of costs of concrete gutter construct1on
on Fourth Street between Broadway and Arizona by adopting
Resolution No. 6499 (CCS). Indiv1dual letters notifying property
owners of the improvement and the date of the public hearing were
mailed to each property owner and posted 1n the district on June
25, 1982.
Recommendation
It is recommended City Council:
1. Open the public hearing;
2. Close the public hearing and acknowledge any protests;
3. Adopt the attached resolution confirming the
assessments.

NOTICE TO IMPROVE
At a regular meeting held on June 22. 1982. the City Council
adopted a Resolution No. 6499 (CCS) which instructs the Street
Superlntendent to order property owners to construct concrete
gutters along the property fronting Fourth Street between Arizona
and Broadway. The materials and work shall be in accordance with
the standards of the City of Santa Monlca. If construction 1S not
begun within 60 days from the date of this notice and diligently
and without interruptlon prosecuted to completion. the Street
Superintendent shall cause the construction to be done and the
cost shall be assessed against and a lien on the property.
The City Council will hear and pass upon object1ons or protests to
the order to construct concrete gutters. if any. by any property
owner or other interested party at the following date, time and
place~

A RESOL~TION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA ORDERING THE CONSTRUCION OF
CONCRETE GUTTERS ON FOURTH STREET BETWEEN
ARIZONA AND BROADWAY, ALL WITHIN THE CITY OF
SANTA MOWICA.
WHEREAS, the City Council of the City of Santa Monica,
on the 22th day of June, adopted Resolution No. 6499 (GeS) setting
a public hearing;
WHEREAS, written notices of said lmprovement have been
given in the manner required by law; and
WHEREAS, any and all written objections and protests to
the work or the extent of the district to be assessed were heard
and considered by the City Council;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1.
That the public convenience and necessity
requires the construction of concrete gutters along Fourth Street
between Arizona and Broadway, all within the City of Santa Monica.
SECTION 2.
That all protests and objections of every
kind and nature to the construction of concrete gutters on Fourth
Street between Arizona and Broadway, all within the City of Santa
Monica, be and the same are hereby overruled and denied.
SECTION 3. That pursuant to Streets and Highways Code
Section 5880, the Street Superintendent is directed to commence
the construction of concrete gutters above described after a
60-day period wherever the property owners have not started the
gutter construction themselves.

SECTION 4.
That the City Clerk shall certify to the
adoption of this resolution and thenceforth and thereafter the
same shall be in full force and effect.
