Reconstructlng the Alley known as Flrst Court betwee~
Broadway and Colorado Avenue
IntroductlOn
ThlS report recommends the reformation of an assessment district to reconstruct
Flrst Court between Broadway and Colorado Avenue. It also requests the City
Councll to set a publlC hearlng for August 24, 1982, and to direct the Street
Superlntendent to order the work done.
Ba,ckground
In August 1982, as part of the Broadway Relief Sewer proJect, staff recommended
the existlng deteriorated concrete pavement be removed and Flrst Court between
Broadway and Colorado be reconstructed wIth seven inches of concrete after the
installation of the sanitary sewer line. This alley is heavily used and is baQly
In need of repalr.
At the September 22, 1982 Council meeting, the City Councll adopted a resolution
formlng an assessment dlstrlct for the resurfacing of Flrst Court for WhlCh 50%
of the costs was to be assessed to the property owners with the City paYlng the
remalnlng 50% of the cost. At this tlme, staff believes lt would be In the
Clty's interest to reform this assessment dlstrict ln order to assess 100% of
the cost of alley resurfacing to the property owner as this year there are
severe flnanclal llmltatlons ln the Street Divlslon budget which require staff
to maintain the funds solely for street resurfaclng. A further factor to

reformlng thlS distr1ct lS that past policy has been to assess commerical property
owners 100% of the cost of alley resurfacing and to require developers of new
prOjects to install new alleys at no cost to the City. In view of the flnanc1al
limitations on the City, staff belleves it would be unwise to change this policy
at the present time.
The Improvement Act of 1911 provides a method whereby all improvements includlng
resurfacing, street llghts, street trees. etc., may be assessed to abuttIng
property owners. Upon adoption of the attached resolut1on, a public hearing
will be set for August 24, 1982, to hear any protests or objections regard1ng
the formation of an assessment d1strict and to dlrect the Street Superlntendent
to order the constructlon of the work by the property owners pursuant to Chapter
27 of the Improvement Act of 1911.
Recommendatlon
It 1S recommended that C1ty Coune1l adopt the attached resolutlon sett1ng a public
hearing for August 24, 1982, and dIrectlng the Street SuperIntendent to order the
work to be done.

A RESDlUTIO~ OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA SETTING A PUBLIC HEARING AND
INSTRUCTING THE SUPERINTENDENT OF STREETS TO
GIVE NOTICE TO PROPERTY OWNERS TO RECONSTRUCT
FIRST COURT BETWEEN BROADWAY AND COLORADO
AVENUE, All WITHIN THE CITY OF SANTA MONICA
WHEREAS, there 1S a need to reconstruct Flrst Court between
Broadway and Colorado Avenue, all Wlt~in the Clty of Santa Monica; and
WHEREAS, 1n accordance wlth Section 5870 ~. seq. of the
Streets and Hlghways Code procedures exist to notlfy property owners of thelr
duty to reconstruct or cause to be reconstructed First Court and to permlt
the Superlntendent of Streets to reconstruct First Court lf not reconstructed
or caused to be reconstructed by the property owners, and
WHEREAS, the Clty Council of the City of Santa MOnlca on lts
own motion may order the reconstructlon of Flrst Court.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOllOWS:
SECTION 1. Pursuant to Sectlon 5875 of the Streets and Hlghways
Code, the Clty Council of the Clty of Santa Monlca orders the reconstructlon
of Flrst Court between Broadway and Colorado Avenue.
SECTION 2. Pursuant to Sectlon 5876 of the Streets and Hlghways
Code, the Superlntendent of Streets shall notify, In the manner reqUlred by
law, the owners of property abutting First Court between Broadway and Colorado
Avenue to reconstruct or cause to be reconstructed First Court. The notice
shall contaln the infornation requlred by Sectlon 5879 of the Streets and

Hlghways Code and shall also spec1fy the day, hours, and place, as set forth
in Sectlon 3 of thlS Resolut1on, where the C1ty Counel1 of the Clty of Santa
Monica wlll hear and pass upon objections or protests, If any, WhlCh may be
raised by any property owner or other interested persons.
SECTION 3. That Pursuant to Sectlon 5878.1 of the Streets and
Highways Code, the C1ty Council of the C1ty of Santa Monlca does hereby order
and declare that on the 24th day of August, 1982, at 7:30 P.M., in the City
Councll Chambers of City Hall, it will hear and pass upon objectlons or
protests, If any, WhlCh may be ralsed by any property owner or other interested
pe rson.
SECTION 4. The C1ty Clerk shall certify to the adoption of
thlS resolution and thenceforth and thereafter the same shall be in full
force and effect.
