Introduction
This report recommends the reformation of an assessment district
to reconstruct First Court between Broadway and Colorado Avenue.
It also requests the City Council to set a public hearing for
November 9. 1982, and to direct the Street Superlntendent to order
the work done.
Background
In August 1982, as part of the Broadway Relief Sewer project,
staff recommended that First Court between Broadway and Colorado
be reconstructed with concrete after the installation of the
sanitary sewer line. This alley is heavily used and is badly in
need of repair.
At the September 22, 1981 Council meeting. the City Council
adopted a resolution forming an assessment district for the
resurfacing of First Court for which 50% of the cost of the
resurfacing was to be assessed to property owners. Staff believes
it would be in the City's interest to reform this assessment
district in order to assess 100% of the cost of alley resurfacing
to the property owner. Past policy has been to require developers
of new commercial projects to install new alleys at no cost to the
City.
In view of this previous practice, staff believes it would
be unwise to change this policy at the present time.

The Improvement Act of 1911 provides a method whereby all
improvements including resurfacing, street lights~ street trees,
etc., may be assessed to abutting property owners. Upon adoption
of the attached resolutlon~ a publiC hearing will be set for
November 9, 1982~ to hear any protests or objections regarding the
formation of an assessment dlstrict and to direct the Street
Superintendent to order the construction of the work by the
property owners pursuant to Chapter 27 of the Improvement Act of
1911.
Recommendation
It is recommended that City Council adopt the attached resolution
setting a public hearing for November 9~ 1982, and directing the
Street Superintendent to order the work to be done.

OF SANTA MONICA SETTING A PUBLIC HEARING AND
INSTRUCTING THE SUPERINTENOENT OF STREETS TO
GIVE NOTICE TO PROPERTY OWNERS TO RECONSTRUCT
FIRST COURT BETWEEN BROADWAY AND COLORADO
AVENUE, ALL WITHIN THE CITY OF SANTA MONICA
WHEREAS, there is a need to reconstruct First Court
between Broadway and Colorado Avenue. all within the City of Santa
Monica; and
WHEREAS, in accordance with Seetin ~5870 et. s~.q. of the
Streets and Highways Code procedures exist to notify property'
owners of their duty to reconstruct or cause to be reconstructed
First Court and to permit the Superintendent of Street to
reconstruct First Court if not reconstructed or caused to be
reconstructed by the property owners; and
WHEREAS, the City Council of the City of Santa Monica on

its own motion may order the reconstruction of First Court,
NOW, THEREFOR~, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. Pursuant to Section 5875 of the Streets and
Highways Code, the City Council of the City of Santa Monica orders
the reconstruction of First Court between Broadway and Colorado
,
Avenue.
SECTION 2. Pursuant to Section 5876 of the Streets and
Highways Code, the Superintendent of Streets shall notify, in the
manner required by law, the owners of property abutting First
Court between Broadway and Colorado Avenue to reconstruct or cause

information required by Section 5879 of the Streets and Highways
Code and shall a1 so spec; fy the day", hours, and p1 ace, as set
forth in Section 3 of this Resolution, where the City Council of
the City of Santa Monica will hear and pass upon objections or
protests, if any, which may be raised by any property owner or
other interested persons.
SECTION 3.
That Pursuant to Section 5878.1 of the
Streets and Highways Co de, the Ci ty Council of the City of Santa
Mo n i c a does hereby order and --A!'3c1are that on the 9th day of
November 9, 1982, at 7:30 P.M. , in the Ci ty Council Chambers of
Ci ty Hall, it wi 11 hear and pass upon objections or protests, iL
any, which may be raised by any property owner or other interested
person.
SECTION 4. The City Clerk shall certify to t,le adoption
of this resolution and thenceforth and thereafter the saMe shall
be in full force and effect.
