14, 1982, to Conf1rm the Assessments on Gutter

Introductlon
This report requests the C1ty CauneTl set a public hearing for
December 14, 1982, to hear protests regardlng the work and conf1rm
the assessments on the gutter construction along Fourth Street
between Broadway and Arizona.
Background
On July 13, 1982, after holdlng a notlced publlC hearlng. the City
Councll ordered the constructlon of concrete gutters along Fourth
Street between Broadway and Arizona Avenue. These improvements
were done in conJunctlon wlth the 1981-82 street resurfacing
program.
The work has been completed and property owners' share
of the costs wll1 now be due. A publlC hearing must be held
pursuant to Sectlon 5882 of the Ca1Tfornia Streets and Hlghways
Code. A resolut1on settTng the pub1ic hearing 1S attached.
Recommendatlon
It 1S recommended the Clty Council adopt the attached resolution
setting a publlC hearing for December 14, 1982, on the assessment
of costs of gutter lnstallatlon.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA SETTING A DATE TO HEAR ANY
PROTESTS OR OBJECTIONS TO THE CONFIRMATION OF
ASSESSMENTS FOR GUTTER INSTALLAtION ON FOURTH
STREET BETWEEN BROADWAY AND ARIZONA, ALL
~ITHIN THE CITY OF SANTA MONICA.
r~E CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1.
That the Superintendent of Streets will
file a report of work pursuant to Section 5882 of the Streets and
Highways Code of the State of California, relating to the
construction of certa~n improvements completed along Fourth Street
between Broadway and Arizona, all within the City of Santa Monica.
SECTION 2.
That pursuant to Section 5870 et seq. of
sa~d Code, the C~ty Council does hereby order and declare that on
the 14th day of December. 1982, at 7:30 P.M., in the Council
Chambers of the C~ty Hall, it will hear and pass upon the report
by the
Superintendent of Streets, of the cost of construction
together w~th any objections or protests, if any, which may be
ra1sed by any of the property owners liable to be assessed for the
cost of such construction and any other 1nterested persons.
SECTION 3.
That all protests or obJect~ons must be in
wr1ting and filed with the C1ty Clerk on or before the time set
for hear1ng of protests and objections.
SECTION 4.
The Superintendent of Streets 1S hereby
directed to mail notices, in the manner and form prescribed by
law, of the cost of construction and of the adoption of this
~
resolution to all persons owing real property in the hereinbefore
descr1bed assessment d1strlct whose names and addresses appear on
the last equalized assessment roll for
City taxes or as known to
the City Clerk.
SECTION
5.
The
City Clerk shall
certify
to the
adoption of thlS resolutiont and
thenceforth and thereafter, the
same shall be ~n full force and effect.
