Introduction
ThlS report requests Clty Council hold a publlC hearlng on the
reformation of the assessment dlstrict for Flrst Court between
Broadway and Colorado Avenue.
Background
On October 12,1982, City Councll set a public hearlng on November
9, 1982, on the reformatlon of the assessment dlstr1ct for F1fSt

Court between Broadway and ~lrst cour~ As a part of the Broadway
Rellef Sewer proJect, staff recommended the reconstructlon of the
pavement ln Flrst Court between Broadway and Colorado Avenue wlth
Portland Concrete Cement.
Presently, the alley 1S in very bad
condlt1on. Due to the businesses and motels located on the alley,
there lS much heavy vehlcular trafflc. Concrete reconstruction
wlll prov1de a more durable and longer lastlng surface and reduce
future mdlntenance costs to the Clty.
Past POllCY w1th regard to reconstructlon of alleys has been to
requlre developers of new commerclal projects to install new
alleys at no cost to the City. In addltlon, when an alley is
approved for reconstructlon by the Clty Counc1l, eXlstlng property
owners have always been assessed 100% of the cost.

However. at the September 22. 1981, Council meetlng, the C1ty
Counc11 adopted a resolution forming an assess~ent district for
the resconstructlon of Flfst Court for wnlcn only 50% of the cost
of the reconstruct1on was to be assessed to property owners. ThlS
deClslon to change the amount of cost assessed to property owners
was based on the fact that the alley would be reconstructed after
lnstallatlon of the Broadway Relief Sewer and therefore the City
should absorb half the cost of the necessary reconstructlon.
Slnce the above declslon was made, funds ava11able for street
reconstructlon
have
decreased.
In
order
to
fund
the
reconstructlon proJect. 1t wlll be necessary to assess the
property owners 100% of the cost. If 100% of the cost 1S not
assessed to the property owners, then staff must eliminate the
proJect.
Oue to these flnanClal constralnts, staff belleves that
the dlstr1ct should be reformed to assess 100% of the cost of
alley reconstructlon to the property owners.
Notlces were malled on October 29, 1982, and posted ln accordance
wlth State law.

It 1S recommended that the Clty Councll;
1. Open the publlC hearing;
2. Close the publlC hearlng and acknowledge any protests;
and
3. Adopt the attached resolutlon orderlng the work.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA ORDERING THE RECONSTRUCTION OF
FIRST COURT BETWEEN BROADWAY AND COLORADO
AVENUE, ALL WITHIN THE CITY OF SANTA MONICA
WHEREAS, the City Council of the City of Santa MQn~ca,
on the
12th day of October. 1982,
adopted Resolution No. 6566
(ecs) setting a public hearing; and
WHEREAS. written notices of said lmprovement have been
glven ln the manner required by law; and
WHEREAS, any and all written objections and protests to
the work or the extent of the dlstrict to be assessed were heard
and considered by City Councl1;
NOW.
THEREFORE. THE CITY COUNCIL OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1.
That the public convenience and necessity
~equire the reconstructlon of First Court
between Broadway and
Colorado Avenue, all within the Clty of Santa Monica.
SECTION 2.
That all protests and objections of every
k~nd and nature to the reconstruction of First Court between
Broadway and Colorado Avenue. all within the C1ty of Santa Monica.
be and the same hereby overruled and denied.
SECTION 3.
That pursuant to Streets and H1ghways Code
Section 5880, the Street Superintendent is directed to commence
the reconstruction is not commended and prosecuted to completion
with due diligence by any property as required by Streets and
Highways Code Section 5879.

That the City Clerk shall certify to the
adoption of this resolution and thenceforth and thereafter the
same shall be in full force and effect.
