ThlS report requests that the Clty Council hold a Public Hearlng
for the assessment of costs of gutter instal1atlon on Fourth
Street between Broadway and Arlzona Avenue and to adopt the
attached resolutlon conflrmlng the assessment of costs.
Background
On November 9, 1982, the Clty Council set a publlC hearing for
December 14, 1982, on the assessment of costs of concrete gutter
construct1on on Fourth Street between Broadway and Arizona Avenue.
IndlVldual letters stating estlmated cost of improvements and the
date of the publ1C hearlng were ma1led to each property owner 10
the dlstrlct on December 3, 1982. The public hearlng must be held
pursuant to Sect10n 5882 of the Callfornld Streets and Hlghways
Code.
The total proposed assessment to property owners 1S
$11,423.50 based on $6.50 per front foot. The proposed assessment
for a 50-foot lot would be $350. The construct1on work was done
In September as a part of the resurfaclng proJect on 4th Street
and a number of other streets.

COMPLETION OF GUTTER INSTALLATION ON FOURTH STREET
BETWEEN BROADWAY AND ARIZONA AVENUE
Pursuant to the provlSlons of Sectlon 5882 of the Streets and
Hlghways Code of the State of Callfornia, Resolutlon No. 6499
(CCS) adopted June 22, 1982. the followlng work was completed
prlor to December 1. 1982. to Wlt:
The constructlon of 1,674 lineal feet of
concrete gutter along Fourth Street. all
wlthln the Clty of Santa Monlca.
The construct1on of 155 square feet of
cross-gutter along Fourth Street, all within
the Clty of Santa Mon1ca.

The assessment was made on the bas1s of $6.50 per
llneal foot of replacement of asphalt gutter wlth Portland
Concrete Cement gutter and $3.50 per square foot of installatlon

real property 10 front of which the work has been done and the
assessment agalnst each lot or parcel of land proposed to be
leVled to pay the cost thereof.

pursuant to Section 5870 et seq. of the Streets and Hlghways Code.
commenced proceedlngs to cause the constructlon of concrete
gutters on Fourth Street between Broadway and Arlzona Avenue 1n
the Clty of Santa Monlca; and
WHEREAS, tne Superlntendent of Streets served the notlce
requlred by Sectlon 5876 of tne Str2ets and Hlghways Code and the
Clty Councll of the C1ty of Santa Monlca held the hear1ng requlred
by Sectlon 5878.1 of the Streets and Hlghways Code; and
WHEREAS, Slxty (50) days after the notlce was served,
the work had not been conpleted by the owners or persons 1n
posseSSlon of the affected propertles, and the Superlntendent of

NOW, THEREFORE. THE CITY COUNCIL OF THE CITY OF SANTA
MONIC~ DOES RESOLVE AS FOLLGWS.
SECTION 1.
That the report of the Superlntendent of
Stree~5 ~eretofore flied 3na above-descrlbed be ~nd the same 15
hereby conflrmed.
SECTION 2.
That all protests and objections of every
kind and nature to the report of the Superintendent of Streets be
and the same are hereby overruled and denled.
SECTION 3.
That the cost of the constructlon, as set
forth In the report of the Superlntendent of Streets, shall be
assessed
