In addltion, thlS report requests the formatlon of an assessment dlstrict to construct concrete gutters and to resurface Broadway between Eleventh Street and Seventeenth Street. It also requests that Council set a public hearing for May 10, 1983, and dlrect the Street Superlntendent to order the work done by the property owners. Background During the 1982 budget hearings, staff indicated to Councll that Broadway between Eleventh Street and Seventeenth Street would be one of the streets resurfaced durlng the 1982-83 Street Resurfacing Program. At the same time, Council approved the concept of assess1ng commerclal property owners one-half the cost of street resurfacing. It is now necessary to form an assessment district for the resurfacing of Broadway. However, after closing the public hearlng held March 8, 1983, the Clty Councll contlnued the ltem to April 12 and requested staff to review the effect the Welton Beckett and Greenwood developments would have on the newly resurfaced street. After researchlng the issue, staff believes that whlle the construction w1l1 have m1nlmal lmpact on Broadway, lt would be best to halt the resurfacing at Seventeenth Street. StopPlng at Seventeenth Street wlll ensure that no large vehlcles wlll travel over the newly resurfaced street as the concrete plant and freeway entrance are at 20th Street and there lS no reason for the trucks to travel past Seventeenth Street. Broadway from Seventeenth Street to Cloverfield can be resurfaced 1n FY 1983-84 after the developments are substant1ally completed. Concrete gutters should be constructed as a part of the Broadway resurfaclng proJect. The asphalt paving at the gutter line is severly eroded and lS a contlnuous malntenance problem on these streets. Slnce 1965, the Clty has constructed concrete gutters on most streets as a part of the resurfacing program. The most recent streets where thlS was done are Broadway and Colorado from Ocean to Llncoln, and Maln Street from Pica to Holllster. The Improvement Act of 1911 provldes methods whereby all improvements lncludlng resurfaclng. street lights. street trees, curbs, sldewalks and gutters may be assessed to abutting property owners. Consistent wlth past POllCY for assessing commercial properties, this assessment wlll be a cash assessment and no bonds 2 GS:SES:ME:JAS Councll Meeting: Apnl 12, 1983 Santa Monlca, Callfornia w1l1 be issued and the commerclal property owner will be assessed the full cost for the constructlon of the gutters or approximately at $7 per llneal foot based on past contracts. Staff belleves that the property owner should be assessed one-half the cost of the street resurfaclng. It lS estimated that the assessment will be $5.75 per llneal foot for street resurfaclng. ThlS charge wlll be approximately 30-50% of the total cost of the resurfaclng dependlng on the wldth of the street. The proposed assessment TS designed so that each commerical property owner would pay the same unlt assessment cost regardless of the width of the street on Wh1Ch the1r property fronts. For a commerc1al property owner with a 50 foot lot, the total estlmated assessment would be $287.50 for resurfacing and $350 for gutters. ReS1dential propertles located with1n the d1strict wl1l not be assessed for elther gutter construction or street resurfacing. F1nanCTal Analysls Th1S proJect lS a part of the 1982-83 Street Resurfaclng ProJect and funds 1n the amount of $250,000 have been allocated for this purpose 1n Account No. 01-500-421-000-901. Pursuant to Sect10n 5875 of the Streets and Highways Code, the City Council of the City of Santa Monica orders the constructlon Of concrete gutters and the street resurfaced on Broadway between Eleventh Street and Seventeenth Street. \ SECTION 2. Pursuant to Section 5876 of the Streets and Highways Code, the Superlntendent of Streets shall not1fy~ 1n the manner requlred by law, the owners of property along Broadway from Eleventh Street to Seventeenth Street to construct or cause to be constructed concrete gutters and street resurfacing. The notice shall contain the information requlred by Section 5879 of the Streets and Highways Code and shall also specify the day, hour and place, as set forth in Section 3 of this Resolutlon, where the City Council of the City of Santa Monica will hear and pass upon obJectlons or protests, if any, which may be ralsed by any property owner or other interested persons. SECTION 3. That pursuant to Section 5878.1 of the Streets and Hlghways Code, the City Council of the City of Santa Monlca does hereby order and declare that on the 10th day of May, 1983, at 7:30 P.M., in the Council Chambers of City Hall, it will hear and pass upon objections or protests, if any, which may be ralsed by any property owner or other interested person. J SECTION 4. The City Clerk shall certify to the adoption of this resolution and thenceforth and thereafter the same shall be in full force and effect.
