Introductlon
ThlS report requests the City Councll to set a publ1C hearlng for
June 14, 1983 to hear protests or objectlons to the formatlon of
an assessment for gutter lnstal latlon and street resurfaclng on a
portlon of Slxteenth Street.
Background
In a concurrent report to Clty Councll ~ staff has requested an
approprlatlon of COBG funds for the resurfaclng and lnstallatlon
of gutters on Slxteenth Street from the Southern Pac1f1c Rallroad
(south of Colorado) and Olympic Boulevard.
The street has been
determlned to be one of those ln the worst condltlon ln the Clty.
In conJunctlon wlth the COBG proJect, staff requests the formation
of an assessment dlstrlct for gutter installation and street
resurfaclng on Slxteenth Street from Colorado Avenue to the
Southern Paclflc Rallroad. The resurfaclng would be added to the
1982-83 Street Resurfacing Distr1ct.
Staff proposes to assess Zwan Industries 100% of the cost of both
gutter installatlon and street resurfacing. Zwan Industrles as a
conditlon of development was required to resurface one-half the
street and install gutters. The electricity was released on the
promlse that Zwan would do thlS work. Desplte repeated requests
that Zwan complete thlS work, they to date have not begun the work

The other owner fronting thlS street,
F1sher Lumber, would be assessed approximately $7jfront foot for
gutter installatlon and $5.75jfront foot for street resurfaclng
based on past contracts.

Funds are available for thlS project ln the contlngencies of the
1982-83 Street Resurfacing proJect.
Recommendatlon
It lS recommended that the Clty Council adopt the attached
resolutlon
establishlng

lnstallation and street
resurfaclng proJect.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA SETTING A PUBLIC HEARING AND
INSTRUCTING THE SUPERINTENDENT OF STREETS TO
GIVE NOTICE TO PROPERTY OWNERS TO CONSTRUCT
GUTTERS AND TO RESURFACE THE STREET ON
SIXTEENTH STREET BETWEEN COLORADO AND THE
SOUTHERN PACIFIC RAILROAD, ALL WITHIN THE CITY
OF SANTA MONICA
WHEREAS, there is a need to construct concrete gutters
and to resurface the street on Sixteenth Street between Colorado
and the Southern Pacific Railroad, all within the City of Santa
Monica; and
WHEREAS, in accordance with Section 5860 et seq. of the
Streets and Highways Code procedures exist to notify property
owners of their duty to construct or cause to be constructed the
concrete
gutters and street resurfacing and to direct the
Superintendent of Streets to construct the concrete gutters and
street resurfacing if not constructed or caused to be constructed
by the property owners; and
WHEREAS, the City Council of the City of Santa Monica on
its own motion may order the construction of the concrete gutters
and the street resurfacing;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. Pursuant to Section 5875 of the Streets and
Highways Code, the City Council of the City of Santa Monica orders
the construction of concrete gutters and the street resurfaced on
Slxteenth
Street between Colorado and the Southern Pacific
Rail road.

SECTION 2. Pursuant to Section 5876 of the Streets and
Highways Code, the Superintendent of Streets shall notify, in the
manner required by law, the owners of property along Sixteenth
Street between Colorado and the Southern Pacific Rallroad to
construct or cause to be constructed concrete gutters and street
resurfaclng. The notice shall contain the information required by
Section 5879 of the Streets and Highways Code and shall also
specify the day, hour and place, as set forth in Section 3 of thlS
Resolution, where the City Council of the City of Santa Monica
will hear and pass upon objections or protests, if any, which may
be raised by any property owner or other interested persons.
SECTION 3.
That pursuant to Section 5878.1 of the
Streets and Highways Code, the City Council of the City of Santa
Monica does hereby order and declare that on the 14th day of June,
1983, at 7:30 P.M. in the Council Chambers of City Hall, it will
hear and pass upon objections or protests, if any, which may be
raised by any property owner or other interested person.
SECTION 4. The City Clerk shall certify to the adoption
of this Resolution and thenceforth and thereafter the same shall
be in full force and effect.
