Introductlon
ThlS report requests the Clty Council to hold a publlC hearing on
the construction of concrete gutters and street resurfacing on
Sixteenth Street between Colorado Avenue and 50' south of the
Southern Paciflc Railroad.
Background
On May 10, 1983, the Clty Councll adopted Resolution No. 6681
(CCS) settlng a public hearlng for June 14, 1983, to hear any
protests concernlng the constructlon of concrete gutters and
street resurfacing on Sixteenth Street between Colorado Avenue and
50 feet south of the Southern Paclflc Railroad.
Notlces of the publlC hear1ng were mailed to property owners on
June 2, 1983, the notlces were posted on June 8, 1983, all ln
accordance wlth State law.
Staff proposes to assess the property on WhlCh Zwan Industrles lS
located 100% of the cost of both gutter lnstallation and street
resurfaclng. Zwan Industrles as a cond1tlon of development was
requlred to resurface one-half the street and lnstall gutters. The
electriclty was released on the promise that Zwan would do this
wo rk .

they to date have not begun the work. The remalning property
frontlng thlS street, would be assessed approxlmately $7jfront
foot for gutter installation and $5.75jfront foot for street
resurfaclng based on past contracts.

Recommendatlon
It 1 S recommended that the Cl ty Counci 1 :
1. Open the publlC hear1ng;
2. Close the publlC hearlng and acknowledge any protests;

3. Adopt the attached resolutlon establlshlng a gutter
constructlon and street resurfaclng dlstrlct on Sixteenth
Street between Colorado Avenue and 50' south of the
Southern Paci flC Rall road.

NOTICE TO IMPROVE
At a regular meeting held on May 10, 1983, the City Councll
adopted Resolution No. 6681 (CCS) WhlCh instructs the Street
Superintendent to order property owners to construct concrete
gutters and resurface the street along the property fronting
Sixteenth Street between Colorado Avenue and 50' south of the
Southern PaciflC Rallroad. The materlals and work shall be 1n
accordance with the standards of the City of Santa Monica. If
construction is not begun w1thin 60 days from the date of thlS
notlce and dilegently and without interruption prosecuted to
completion, the Street Superlntendent shall cause the constructlon
to be done and the cost shall be assessed against and a lien on
the property.
The City Councll will hear and pass upon obJections or protests
to the order to construct gutters and the resurface the street)
if any, by any property owner or other interested party at the
following date, time and place:

The estlmated assessment for the property on the east side of the
street 501 north of the railroad is 100% of the cost. The estimated
assessment for the remainder of the area for the gutter construction
is S7.00/front foot and for street resurfacing lS $5.75/front foot lf
you do not have the work done. You are under no obligation to do the work
yourselves. However, State law required that the City give you the
opportunity to do the work yourself.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA ORDERING THE CONSTRUCTION OF
CONCRETE GUTTERS AND STREET RESURFACING ON
SIXTEENTH STREET BETWEEN COLORADO AVENUE AND
50' SOUTH OF THE SOUTHERN PACIFIC RAILROAD,
ALL WITHIN THE CITY OF SANTA MONICA.
WHEREAS, the City Council of the City of Santa Monica,
on the lOth day of May, 1983, adopted Resolution No. 6681 (CCS)
setting a public hearing;
WHER~~~, written notices of said improvement have been
given in the manner required-by law~ and
WHEREAS~ any and all written objections and protests to
the work or the extent of the district to be assessed were heard
and considered by the City Council;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1.
That the public convenlence and necessity
requires
the
construction
of concrete gutters and street
resurfacing along Sixteenth Street between Colorado Avenue and 50'
south of the Southern Pacific Railroad, all within the City of
Santa Monica.
SECTION 2.
That all protests and objections of every
kind and nature to the construction of concrete gutters and the
street resurfacing along Sixteenth Street as described in Section
1. all within the City of Santa Monica, be and the same are hereby
overruled and denied.
SECTION 3. That pursuant to Streets and Highways Code
Section 5880, the Street Superintendent is directed to commence
the construction of concrete gutters and street resurfacing above
described after a 60-day period wherever the property owners have
not started the gutter construction and street resurfacing
themselves.
SECTION 4.
That the City Clerk shall certlfy to the
adoption of this resolution and thenceforth and thereafter the
same shall be in full force and effect.
