Introductlon
ThlS report requests that the Clty Council hold a PubllC Hearing
for the assessment of costs of gutter constructlon on Wilshire
Boulevard between Ocean Avenue and Twenty-flrst Street and to
adopt the attached resolutlon conflrmlng the assessment of costs.
Background
On June 28, 1983. the City Councll set a publlC hearlng for July
26,
1983,
on the assessment of costs of concrete gutter
construction on Wilshire Boulevard between Ocean Avenue and
Twenty-flrst Street. Indlvidual letters statlng estlmated cost of
lmprovements and the date of the public hearln9 were mal1ed to
each property owner in the district on July 15, 1983. The
construction of the concrete gutters was a part of the Wllshire
Boulevard reconstructlon proJect. In accordance with past polley.
staff is recommending that 100% of the cost be passed through to
the commerCl al property owners.

Revenues of $77,696.25 wlll be recelved from thlS assessment
dlstrict over the next two flscal years. (Any unpald assessments
must be placed on the December 1984 tax blll.) This revenue will
reimburse the General Fund for a portion of the $149,358.81 ln

matchlng funds used by the Clty to finance the Wilshlre Boulevard
reconstructlon proJect.
With recelpt of these funds, the City
wlll have been able to reconstruct Wllshlre Boulevard from Ocean
Avenue to Twenty-fl rst Street for a total cost to the General Fund
of $71,662.56; the remalnder of the cost $933,736.26 has been paid
wlth Federal Aid-Urban funds.
Recommendatlon
It 1 S recommended that the Cl ty Councll:
1. Open the public hearlng;
2. Close the pUblic hearing and acknowledge any protests;and
3. Adopt the attached resolutlon conflrming the assessments.

The Gutter Constructlon at the above descrlbed property has been completed, and the
cost is as shown above.
Pursuant to Streets and Highways Code Sectlon 5881, this letter lS notlfication that
the City Council, pursuant to Resolution No.6713 adopted on June 28,1983, has
scheduled a hearing to hear and pass upon the report of the Superintendent of Streets
of the cost of the gutter construction, ln connection wlth the above-described pro-
Ject, together wlth any objections and protests, lf any, WhlCh may be ralsed by any
property owner liable to be assessed for the cost of such gutter constructlon and
any other interested persons.

COMPLETION OF GUTTER CONSTRUCTION ON WILSHIRE BOULEVARD
BETWEEN OCEAN AVENUE AND TWENTY-FIRST STREET
Pursuant to the provlslons of Sectlon 5882 of the Streets and
Hlghways Code of the State of Californla, Resolution No. 6350
(CCS) adopted August 25, 1981, and Resolutlon Order1ng Work No.
6066 (CCS), adopted September 22, 1981, the followlng work was
completed prlor to July 1, 1983, to Wlt:
The constructlon of 10,359.5 llneal feet of
concrete gutter along Wilshlre Boulevard
between Ocean Avenue and Twenty-flrst Street,
all withln the City of Santa Monica.
The
total
proposed
assessment to the property owners is
$77,696.25.
The assessment was made on the basls of $7.50 per
11neal foot of replacement of asphalt gutter with Portland
Concrete Cement.
Reference 1S made to the attached sheets for a descr1ptlon of the
real property ln front of which the work has been done and the
assessment agalnst each lot or parcel of land proposed to be
leVled to pay the cost thereof.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING GUTTER
CONSTRUCTION ON WILSHIRE BOULEVARD BETWEEN
OCEAN AVENUE AND TWENTY-FIRST STREET ALL
WITHIN THE CITY OF SANTA MONICA
WHEREAS, the Clty Council of the Clty of Santa Monica,
pursuant to Section 5870 et seq. of the Streets and Hlghways Code,
commenced proceedings to cause the construction of concrete
gutters
on
Wllshlre
Boulevard
between
Ocean Avenue and
Twenty-first Street in the Clty of Santa Monica; and
WHEREAS, the Superlntendent of Streets served the notice
requl red by Section 5876 of the Streets and Hlghways Code and the
Clty Council of the Clty of Santa Monlca held the hearing required
by Sectlon 5878.1 of the Streets and Highways Code; and
WHEREAS, Slxty (60) days after the notice was served,
the work had not been completed by the owners or persons 1n
posseSSlon of the affected propertles, and the Super1ntendent of
Streets caused the work to be done; and
WHEREAS, the Superintendent of Streets gave the notlce
requlred by Section 5881 of the Streets and Hlghways Code; and
WHEREAS, the Superlntendent of Streets did fl1e with the
Clty
Council
of the Clty of Santa Monica hlS report of
construction and cost as requlred by Section 5882 of the Streets
and Hlghways Code; and
WHEREAS, upon the day and hour f1xed for hearlng by
Resolutlon Number 6713 (CCS) the City Council of the City of Santa
Monlca heard and passed upon the report of the Superlntendent of
