SUBJECT: Resolution to Set a Public Hearing for January 10,
1989, for the Confirmation of Gutter Construction and
street Resurfacing Assessments on Various city Streets
Introduction
This report recommends that the City council set a public hearing
for January 10, 1989, to hear protests regarding the work and to
confirm the assessments for gutter construction and street
resurfacing on various streets as listed below.
Background
On December 8, 1987, the city Council approved the formation of
an assessment district for street resurfacing and gutter
installation in conjunction with the 1987-88 Street Resurfacing
Program. The following streets were included:
1. 20th Street - pico Blvd. to Santa Monica Freeway
2. centinela Avenue - Wilshire Blvd. to Montana Ave.
3. Harvard Street - Santa Monica Blvd. to Wilshire Blvd.
4. Pacific Street - Lincoln Blvd. to 6th street
Only commercial and industrial property owners will be assessed
$9.50 per linear foot for gutters and $7.50 per linear foot for
resurfacing.
Property owners were notified in accordance with
State law and the public hearing was held January 12, 1988.
After closing the public hearing, the Council ordered the work to
commence.
The work has been completed and commercial and industrial
property owner assessments are now due.

The
attached
resolution sets the public hearing for January 10, 1989.
Commercial and industrial property owners will be notified of the
date and assessment amount fifteen days prior to the public
hearing.

Approximately $20,000 will be generated from property owner
assessments.

Recommendation
It is recommended that the city council adopt the attached
resolution setting a public hearing for January 10, 1989, to
confirm the assessments for gutter and street resurfacing on the
above-mentioned streets.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA SETTING A PUBLIC
HEARING FOR JANUARY 10, 1989, TO HEAR ANY
PROTESTS OR OBJECTIONS TO THE
CONFIRMATION OF ASSESSMENTS FOR GUTTER
INSTALLATION AND STREET RESURFACING ON
VARIOUS CITY STREETS
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The Superintendent of streets will file a
report of work pursuant to section 5882 of the Streets and
Highways Code of the state of California, relating to the
construction of certain improvements completed on:
1. 20th street - pico Blvd. to Santa Monica Freeway;
2. Centinela Avenue - Wilshire Blvd. to Montana Ave.;
3. Harvard Street - Santa Monica Blvd: to Wilshire Blvd.;
and
4. Pacific Street - Lincoln Blvd. to 6th Street,
all within the City of Santa Monica.
SECTION 2.
Pursuant to Section 5870 et seq. of said
Code, the City Council does hereby order and declare that on the
10th of January, 1989, at 7:30 p.m., in the Council Chambers of
City Hall, it will hear and pass upon the report by the
Superintendent of Streets, of the cost of construction together
with any objections or protests, if any, which may be raised by
any property owner liable to be assessed for the cost of such
construction and any other interested persons.
SECTION 3 .
All protests or objections must be in
writing and filed with the City Clerk on or before the time set
for the hearing of the protests and objections.
SECTION _
The Superintendent of_treets is hereby
directed to mail notices, in the manner and form prescribed by
law, of the cost of construction and of the adoption of this
Resolution to all persons owning commercial or industrial real
property in the hereinbefore described assessment district whose
names and addresses appear on the last equalized assessment roll
for the City taxes or as known to the City Clerk.
SECTION 5.
T~e City Clerk shall certify to the
adoption of this Resolution, and thenceforth and thereafter, the
same shall be in full force and effect.
