INTRODUCTION
This report requests that City Counc~l hold a PUblic Hearing to
determine the conven~ence and necessity of constructing streetlights
on:
ARIZONA AVENUE - From Franklin street to Centinela Avenue;
CALIFORNIA AVENUE - From Twenty Fifth St. to Twenty sixth st.;
THIRTIETH STREET - From Pearl Street to Ocean Park Blvd.: and
YALE STREET - From Wilsh~re Boulevard to Washington Avenue
The report also recommends that Clty Caunell approve the replacement
of deteriorated streetlights on San vicente Boulevard from Fourth
street to Seventh Street and order the work to begin.
BACKGROUND
Procedure for Residential Streetlight Installation
On June 9, 1992, city Council adopted Resolution of Intention No.
8413 (CCS) setting a PUblic Hearlng for the purpose of determlning
whether public convenience and necessity require the construction of
streetllghting and declaring its intention to construct
streetlighting and replace deteriorated streetlights. In accordance
with city policy, residents desiring installation of streetlights on
their block, circulate a petition and information sheet prepared by

city staff. The information sheet briefly explains the process and
how each property owner will be assessed. Property owners are
assessed for streetlighting based on the property size. In
accordance w~th City policy, res~dent~al owners are assessed 50% of
their front footage and for corner lots, 20% of theJ.r side footage
costs, with the City paying the remaining 50% and 80%, respectively.
Commercial property owners are assessed 100% of the1r front footage
and 40% of the side footage costs, with the City paying the
remaining 60% of the side footage costs. Successful streetlight
petitions conta1n the signatures of a minimum of sixty percent (60%)
of each block's residents.
The petit10ns are presented to City Council and a time and date ~s
set for a publ ic hearing to hear protests. After consider1ng the
public testimony, the C1ty Council orders the work to begin. The
project 1S compet1tively b1d by private contractors, a contract is
awarded by city Council to the lowest responsible b~dder and bonds
are authorized to be sold. Owners may pay for the improvements over
ten (10) years at an 8.8% per annum interest rate.
The Pet~tions for streetlight Installation
At the request of residents, staff prepared streetlight petit10ns
for:

YALE STREET - From Wilsh~re Boulevard to washington Avenue
A minimum of sixty percent (60%) of residents of each street signed
the petitions indicat1ng their desire to have streetlights installed

on theJ.r street. Rent Control staff has reviewed the petitions and
determined that they conform with Rent Control Regulations for
pass-through of assessments.
city staff and petitioners met on April 1, 1992, to discuss the
location of the streetlights, types of streetlights (decorative vs.
standard) available and the apprOx1mate costs to the property
owners. Only the property owners on Yale street requested the more
expensive decorative streetlights for their street. Hence, their
share of assessments will be higher than the other streets that
requested the standard streetllghts. The city pays only 50% of the
cost for the standard streetlights and property owners choosing the
decorative streetlights will be required to pay the difference
between the standard streetlighting and the decoratJ.ve
streetlighting.
Notices were posted on July 9, 1992, residents and property owners
were notified by maJ.l on July 8 and 9, 1992, 15 days in advance of
the pUblic hearJ.ng and the Notice was advertised in The Outlook in
the manner prescribed by state Law.
Copies of the signed petitions, a map of the proposed assessment
district and a list of property owners and residents will be
ava1lable for review in the Council Chambers at the time of the
Public Hearing.
The Proposed Streetliqht Replacement on San vicente Boulevard
The Capital Infrastructure Needs Assessment study, completed in
February of 1984 and presented to City council, recommended that
deteriorated and energy-inefficient streetlights be replaced at

various locations throughout the city. Several streets needing
circuit and pole replacement were identified in the study and staff
has determined that the streetlight system on San Vlcente Boulevard
from Fourth street to Seventh Street 1S in most need of replacement.
This determination was based on the number of actual repairs made
and the number of repairs planned to malntain the 72 year old, badly
deteriorated system on San Vicente Boulevard.
Staff held a meetlng with property owners and residents on February
20, 1992 and they were in support of this project. Assessments for
San Vicente Boulevard are proposed to be the same as those on Yale
street, since decorat1ve streetlights wlll be installed. Staff is
recommending that streetlights be installed on these streets for the
safety and convenience of the residents.
Notices were posted on July 9, 1992, residents and property owners
were notified by mall on July 8 and 9 I 1992, 15 days in advance of
the public hearing and the Notice was advertised in The Outlook in
the manner prescribed by state Law.
BUDGET/FINANCIAL IMPACT
The total estimated cost for the project is $220,000.00. The total
estimated assessment is $26.80 per foot of property frontage for the
standard streetlights. The estimated prorated assessment for
residential property owners is $13.40 per front foot. Property
owners on Yale Street and San Vicente Boulevard will be assessed
approximately $17 per front foot.
City Council previously held public hearings and approved the
construction of streetlighting on Twenty Fourth street between

Wilshire Boulevard and Arizona Avenue and on sixth Street between
Santa Monica Boulevard and Arizona Avenue. These two streets ln
addl.tion to the streets mentioned in this report, will be combined
into a single construction contract.
The City's portion of the assessment costs will be financed through
the annual streetlighting Capital Improvement Project account. A
grant program w~ll be available for low to moderate income
households.
The estimated cost for a typlcal residentlal property owner is
approximately $690 for a 50 foot lot frontage wlth the City's share
bel.ng an equal amount. Yale street and San Vicente Boulevard
property owners will pay approximately $850 for a 50 foot lot and
the City's cost would be $690. The proposed breakdown is as
follows:
Estimated property owner assessments $119,300.00
Estlmated City contribution 100,700.00
Total project estimate $220,000.00
Appropriation authority for the City's contribution is available in
ClP Account No. 01-770-453-25491-8917-99155, "New Streetlight
Systems" in the amount of $68,800.00, for the new streetlights and
account no. 01-770-453-20092-8900-99154, "Streetlight Circuit
Replacement" in the amount of $46,100.00, for the streetlight
replacements. The remaining costs for the project w11l be paid
through property owner assessments. Assessments will be paid upon
completion of the work and will be held in a trust account
#80-000-000-00000-9750-04289 pending payment to the contractor who
installs the lights. Bonds are then issued for any unpaid

assessments. Bond proceeds are paid to the Contractor and the
property owner(s) then pay the bond holder(s) over time.
RECOMMENDATION
It is recommended that City Councll:
1. Open the Public Hearing on the conven~ence and necessity
of the proposed streetlight, as described in the Resolution of
Intention No. 8413 (eCS) on:
Arizona AVenue - from Franklin street to Centinela
Avenue;
California Avenue - from Twenty Fifth street to Twenty
sixth street:
Thirtleth street - from Pearl Street to Ocean Park
Boulevard;
Yale street - from Wilshire Boulevard to Washington
Avenue, and
San Vicente Blvd. - from Fourth Street to Seventh st.
2. Close the Public Hearing: and acknowledge any protests
and adopt the attached resolution finding that the public
convenience and necessity requires the construction and hereby
ordering the work to begin.

WHEREAS, the City Council of the City of Santa Monica, on
the 9th day of June 1992, passed and adopted its Resolution of
Intention, being Resolution No. 8413 ( CCS) , declaring its intention
to order work described therein to be done, which Resolution of
Intention duly and legally was published as required by law and
notice of said improvement has been given in the manner required by
law and all written objections and protests to the proposed work or
the extent of the distr2ct to be assessed were heard and considered
by the City Council; and
WHEREAS, a public hearing has been held duly and regularly
pursuant to Resolution No. 8413 (CCS) and the laws and constitution
of the State of california on the proposed construction of
streetlighting, replacement of deteriorated streetlighting and
appurtenance work thereto, as described in the Resolution No. 8413

Majority Protest Act of 1931" shall not apply to the making of said
improvement.
SECTION 3. Improvements shall be conducted under the
Improvement Act of 1911, which is Division 7 of the streets and
Highways Code of the state of California, and the Street
Superintendent and the city Attorney presented to the sa~d City
Council the Resolution of Intention required by said Improvement Act
to initiate the proceedings for said improvements.

This letter is a legal notice as required by Chapter 7 of the
Improvement Act of 1911 proceedings and provisions of section 5611 to
5614 under which the above work will be done.
You are hereby notified that the city Council of the City of Santa
Monica, california, adopted Resolution No. 8413 (eCS) on June 9,
1992, declaring its intention to construct streetlightl.ng, replace
streetlightinq and appurtanent work in the above named areas,
determining that bonds be issued to represent the cost therefore,
declaring the work to be of more than local ordinary public benefit,
and that the expense thereof shall be assessed upon a district.
Rent Control will work w~th property owners on the pass-through of
assessments. The amount charged to renters will be on a monthly
basis and spread over a ten year period. In most instances, monthly
charges will be less than $2.00 per apartment unit.

My across-the-street neIghbor, Carlo Genna, after the theft of his
girlfriend's car parked overnight on Arizona Ave. thought by havIng
additIonal lIght, car theft could be elimInated. The issue was later
token up by his next door neIghOOr. MIchele Pritchard. These peoples
oPJrtJrents face an interior courtyard whICh faces FranklIn St. Only
thei r back cbors open to Anzona Ave. They, therefore, can park thel r
cars In theIr garCJJes, walk through their back door and not be affected
by the mtense glare of an aelded light at FranklIn Alley. Others wi 11
have to face the glare of this bn II iont light. aOO I wi 11 have my

This sore petition has again resurfaced. Upon checkIng with Ms. Ramezani
was told that a staff lTt:2rLer of the RCB had detennined that these people
are I1IJt.l entitled to Sign this petition even though they live on Frmklin
St. property Cl'Id have Frrnkl in St. addresses.
Checkirg with the City Attorney's office, I spoke to Joe LCPtlrence for a
defInition of the F1.Imcipal Code ~ 7170. ". ..whever the occupants of f:11?o
of the residentIal units In any area..." Mr. LCI'Irence said that the ~rd
"area" is nomnlly mterpreted to rrean "street". [Meanirg the street on
whICh they live. J
ORIGINAl PETITION FORM: This form was flawed in that It provided Sp:Jce
ooly for sigratures. There was no space for a printed nare, phone I1tJ1'ber
or other IdentIficatlOn. This is requIred by the Dept of Traffic & ParkIng
Engineering . We learned thIS 'ftlen we petitioned for restricted parking on
FranklIn St. POSItive identifIcatIOn HAD to be on thot petItIOn. I brought
thIS to the attentIOn of Ms. Rarezam and subsequently the petition form
was later rrodl fied to include a space for printed ncrre only; no further
ID was requrIed. ThlS revised petition also came up flawed. The nUTbers
used to calculate the 60% were incorrect and 5 of the 11 signatures cOJld
not be verified. When this WJS brought to the attentIOn of Ms. RarezanC
the fIgures were recalculated and yet another petItion ~s CIrCulated; the
fIgUres supposedly verified by staff of the RCB.
eIlY HALL & LIBRARY "1EETING: I went to see STcn Scholl about the legalIty
of this petItion. As soon as Mr. Scholl learned what I was ther dxlIt,
he IntrodJced rre to Tony Antlch for"processingll. I was frustrated by the
blockage encountered at Ci tv Hall and wanted sore answers which I had been
unable to get from Lauren Ramezanl. Tony lIstened and seared genUinely
concerned about the petItion procedure used in this situatIon. But he
explOlned the schedJled rreeting at the SM LIbrary to discuss this was too
near to cmcel. If we ~ld attend the rreeting, all questIons ~uld be

answered. This 'tK]S a general rreeting with people fran all the other
distrIcts attending. This rreeting did not progress as expected. After
introductions, Mr. R on Cummings held up picture of 2 lIght flxtures and
asked the group at large 'II1ich they ~ted. That was It.
It was also disclosed at this rreeting that if approval is given for this
added light[Arizona Ave.], it will also be necessary to remove and replace
THE 00 CORNER LIGHTS at Centinela Ave and Frmkl in 5t. The reason given
~s that they all had to be alike. Therefore, approval for one added
lIght also rreans the replocerent for 00 eXisting 1 ights w,ich serve the
area extremely well!
There are 4 prirrory reason NOT TO APPROVE this lighting petition for
ArIzona Ave:
1. PETITION PROCEOORE: The ongiool petItIon ~ declared invalid In
1991 becwse the signers were not residents of the street petitioned for.
Through sore nlIsterioos and arcane process, there has been a radical
reversal of policy and these sore people are J1(}II pennitted to sign.

lIght IrTprOVEffents. Hcmever, the Intent of thIS rul ing should be
IF THESE PEOPLE ARE AFFEClED BY THE LIGHT for that street. These SIgners
are not! They rrerely happen to 11 ve on a parcel \ftlich has one boundry
line on Arizona Ave. Their signatures cannot be conSIdered valId.
This IS a misuse and abuse of the petition system. Same people will sign

I intervIewed 2 people fnan the 1301 Centinela sIte whIch makes the poInt.
One I^OTDn ~o SIgned, told rre It didn't rmtter to her. She struck her
SIgnature because she was not told In advance there Vl>uld be a rmnthly
charge added to her rent. A man at this same site told me that he signed
not because 1t ~ld affect him, but bec(lJse the petitioner was so Insistent.
And indeed, they needed the S 1 gnatu res f ran th is d istrnt buil i ng on Cent lnel a
Ave to achieve the 6CYZ requirerent. I've tried to contact the two other
signers at this site, roorning, noon, and evernng and never been able to find
anyone in residence. These 3 signatures from the 1301 Centinela SIte are
so far rErrOved fran the issue they might as well be in another county. And
yet, these are the very signatures that gave the pet it loners the requIred
60'70 to bn ng the rmtter before the Ci ty COJnc il.
The petitIon process serves a purpose, but It shoold also be fair and
square allOWIng only those people to SIgn who would be affected by the
outCaTe. This lS not the case With this Arizona Ave petitIon! To approve
IS contrary to the Intent of the regulations gJverning the petitIon process.
All other distrIcts [CALIFORNIA, 30TH ST., & YALE] are streets WIth SIngle
famIly reSIdences. These people undoubtedly need, want and are WIllIng to
pay for additionl lIght. This is not the case with ARizona Ave.!
2.NEED: There IS absolutely no need for additIonal lightIng at this
alley intersection. This area is flooded WIth light from two lntense
lights fran Franklin St and CentInela Ave. Additionally, light spIlls
to thIS area fran my own property, fran Mary Lightfoot's property ( at
thIS alley) and fran the parkIng lot of the Church of the Latter-Day
SaInts whIch has 3 brilllont lights flooding their parking area and whIch
is aImed in that dIrectIon. It IS possible to stand in the Intersection
where this light is proposed and read the srmll print fran a ncwspq:>er.
I have done It.
3. U~ANTED : This proposed l1ght IS unwanted by the pecple whose property
and lIves VtOuld be negatively affected by it. The SIgners of thIS petitIon
would not be affected In any way by this Intense lIght. All of these people
live In a 2 story apartTrent carplex bUilt In 0 "u" shape around a softly
lighted courtyard whICh faces Franklin St., out of sight and out of VIew.
The proposed light \\Ould In no way affect th6n. This has nothH~ to do
WIth reality but only how things look on paper with numbers!

thIS issue has such 0 long hIStOry and taken such mysterious turns, it
is diffIcult to give all the facts in a short space. Please bear with
it. You will want to know what's behind this petItIOn before giving

This petItion V'llS OrIginally initlOted over a year ago and denied.
My across-the-street neIghbor. Carlo Genna. after the theft of his
girlfriend's car parked overnight on Arizona Ave, thought by having
addItIOnal light, car theft could be elImmated. The issue was later
token up by his next door neighbor, MIchele Pn tchard. These peoples
apartments face an interior courtyard whICh faces Franklin St. Only
their back doors open to Anzona Ave. They, therefore, can park their
cars in their garages, walk through theIr back door and not be affected
by the intense glare of an added light at Franklin Alley. Others will
have to face the glare of this brIlliant lIght, and I WIll have my
outdoor patIO and garden ruined for evening use by this constant glare.

I interviewed 2 people fram the 1301 Centinela site which makes the point.
One lCIDfl M10 signed, told me it dIdn't rmtter to her. She struck her
