Re: Sidewalk Repair at 1728-1730 Olympic Boulevard
Dear Council Members:
Th~s office represents Mr. Alexander Von Hessenste~n, the owner
of the property located at 1728-1730 Olympic Boulevard. Mr. Von
Hessenstein has requested that I make the follow.l.ng formal
protest and objection to the cost to be assessed to him for the
above-described project.
It was Mr. Van Hessenste.l.n's understand.l.ng that he would be as-
sessed 50% of the actual costs to remove and replace 500 square
feet of concrete sidewalk which had been damaged due to parkway
tree roots. It was also his understanding that the cost of the
above-described work was to be $2,000.00. He is now being told
that he will be assessed $1,900.00. Th~s lS clearly not a 50-50
split of the costs.
Further, my client .l.nforms me that parking meters were recently
lnstalled at that location. In light of the revenue that wlll be
derived from the meters, my cl.l.ent feels that the City should
bear a greater percentage of the cost of the work performed on
the sidewalk.
Please reconsider the assessment in this matter. Thank you for
your attention.

statement by President, Santa Monica Airport Association
Regarding SMAA position concerning
Reliance development ana SMAA lawsuit
The Santa Monica Airport Association believes that Reliance Project
supporters, in their zeal for pushing the project through, are
deliberately smearing the Association and its Directors by claiming
that the Association opposes the project because it wants to expand
the aviation activities onto the area of residual land proposed for
development. That is an untrue representation of the Association's
position.
The following information is provided to present the actual position
of the Association.
1) The previous communications to the City of Santa Monica from
the Association and from individuals state the Association's
concerns quite clearly, and show that the Association has presented
the following concerns consistently to the City over a period of
time.
2) The Association continues to support the 1984 Airport Agreement
between the FAA and the City in all provisions which were publicly
discussed and agreed to by the members of the Working Group convened
to negotiate the agreement. This group included representatives of
the City of Santa Monica, airport neighborhood groups, the City of
Los Angeles, many national aviation groups, the FAA, the Justice
Department, and the Association.

6) The Association also believes, withtthe airport neighbors, that
the plans for the development do not address adequately its
environmental consequences nor do they provide for a development
properly compatible with airport operations. Note that the Airport
commission has passed resolutions calling for the City to properly
address legitimate concerns about environmental and operational
aspects of the development.
7) In spite of the claims of development supporters, the
Association Board has not discussed nor has any plans for expansion
of the airport operations areas or construction of additional
runways. The Agreement and local ordinances clearly restrict the
level of operations to that which is handled well by the current

meant to discredit the Association and scare the neighbors,
8) This issue is really quite simple. The City staff in the
Planning Department apparently believed that they are wiser than the
community in deciding the future of the residual lands. This is
completely contrary to the spirit of the working Group which
represented a broad coalition of interested parties and which
developed a reasoned document regarding the future of the airport.
The city has failed to honor its verbal commitments to continue the
working group process in deciding the future of the residual land,
and has thus lost what could have been support and useful input from
the citizens most affected.
9) The Association has been forced to take a position parallel to
that of other critics of the development because the city has failed
to honor the spirit and the letter of the 1984 Airport Agreement.
The responsibility for the current sad state of affairs falls
squarely on those in city government who have failed to honor the
Agreement and their obligations to involve the community in decision
making.
