SUBJECT: Recommendation to Hold a public Hearing to Confirm
Streetlight Assessments on Various streets.
Introduction
This report requests that the city council hold a public hearing
to confirm streetlight assessments for the following streets:
23rd Street between pico Boulevard and Pearl street
33rd street between Ocean Park Boulevard and Pearl
Street
19th street between Wilshire Boulevard and California
street
18th street between Wilshire Place North and
California street
5th street between Pacific street and Strand street
Alta Avenue between 4th street and First Court
11th street between Washington and Idaho
Stanford street between Wilshire Boulevard and
Washington Avenue
Marguerita Avenue between 4th street and First Court
5th Street between Wilshire Boulevard and Washington
Background
Streetlight petitions from the residents of the above streets
were accepted by the City Council in two groups.

The City Council ordered the projects to proceed. The projects
were combined and on September B, 1987 a contract was awarded to
construct the streetlights. The work is complete and assessments
are due. In accordance with state law, a pUblic hearing must be
held to confirm the assessments and on April 26, 1988, council
set the public hearing for June 28, 1988. A Notice of Public
Hearing with the amount of assessment was sent to each property
owner 15 days in advance (June 13, 1988) and the notice was
published in the Evening Outlook for two consecutive days at
least 15 days in advance of the (June 9 and 10, 1988) public
hearing.
Budget Financial Impact
The City'S cost for the project is $149,753.08 and $135,061.92
will be assessed to property owners.
Presently, there are
sufficient funds at Account Nos. 01-770-453-000-903,
01-770-453-000-905 and 01-770-453-000-907 for the City'S share.

A detailed assessment report will be presented at the public
hearing.
Recommendation
It is recommended that the City Council:
1. Open the public hearing;
2. Close the public hearing; and
3 . Acknowledge any protests and adopt the attached
Resolution confirming the assessments.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA APPROVING THE ASSESSMENT
DIAGRAM AND CONFIRMING AN ASSESSMENT FOR
VARIOUS STREETS IN THE CITY OF SANTA MONICA
WHEREAS, the City of Santa Monica, pursuant to section
5100 et seq. of the streets and Highways Code, commenced

proceedings to construct streetlighting and appurtenant work on:
23rd street between Pica Boulevard and Pearl street;
33rd street between Ocean Park Boulevard and Pearl
street;
19th street between Wilshire Boulevard and California
Street;
18th Street between Wilshire Place North and
California Street;
5th Street between Pacific Street and Strand street;
Alta Avenue between 4th Street and First Court;
11th street between washington Avenue and Idaho Avenue;
Stanford Street between Wilshire Boulevard and
Washington Avenue;
Marguerita Avenue between 4th street and First Court;
and
5th street between Wilshire Boulevard and Washington
Avenue,
All within the City of Santa Monica; and
WHEREAS, the proceeding is more fully described in the
following Resolutions of Intention:
Resolution of Intention Number 7392 (CeS) adopted March
24, 1987;
Resolution of Intention Number 7429 (CeS) adopted June
9, 1987; and
Resolution of Intention Number 7491 (eCS) adopted
October 13, 1987; and

WHEREAS, the contract for the above-described work
has been fulfilled to the satisfaction of the Superintendent of
Streets: and
WHEREAS, the Superintendent of streets has made an
assessment to cover the sum due for the work performed and
specified in the contract: and
WHEREAS, the assessment has been filed with the City
Clerk: and
WHEREAS, the City Clerk gave notice as required by
sections 5362 and 5363 of the Streets and Highways Code: and
WHEREAS, upon the day and hour fixed for hearing by the
City Clerk, the City Council of the City of Santa Monica heard
and passed upon any and all objections, appeals, and protests,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. That all objections, appeals, and protests
of every kind and nature be, and the same hereby are, overruled
and denied.
SECTION 2. That the diagram of property affected and
benefited by the construction of a high-pressure sodium street
lighting system and appurtenant work on:
23rd street between Pica BOUlevard and Pearl street:
33rd street between Ocean Park Boulevard and Pearl
street:
19th street between Wilshire Boulevard and California
Street:
18th street between Wilshire Place North and

California street;
5th Street between Pacific street and Strand Street;
Alta Avenue between 4th street and First Court;
11th street between Washington Avenue and Idaho Avenue;
Stanford street between wilshire Boulevard and
washington Avenue;
Marguerita Avenue between 4th street and First Court;
and
5th street between Wilshire Boulevard and Washington
Avenue,
and therein declared to be the property to be assessed to pay the
expense of the improvements, is approved and the City Clerk is
directed to execute the certificate on the diagram certifying
such approval and to deliver the diagram to the Superintendent of
streets.
SECTION 3. That the assessment for the replacement of
the streetlighting system and appurtenant work on:
23rd street between Pico Boulevard and Pearl street:
33rd Street between Ocean Park Boulevard and Pearl
Street;
19th street between Wilshire Boulevard and California
street;
18th street between Wilshire Place North and
California street;
5th street between Pacific street and Strand street:
Alta Avenue between 4th street and First Court:
11th Street between Washington Avenue and Idaho Avenue:
Stanford street between Wilshire Boulevard and
washington Avenue:
Marguerita Avenue between 4th street and First Court:
and
5th street between Wilshire Boulevard and Washington
Avenue,
as more fully described in Resolution Number 7392 (CCS),
Resolution Number 7429 (CCS), and Resolution Number 7491 (CCS),
be, and the same hereby is, confirmed and approved,

SECTION 4. That the Superintendent of streets shall
forthwith attach a warrant to said assessment bearing the date of
this confirmation.
SECTION 5. That the assessment roll, warrant and
diagram shall be recorded in the Office of the Superintendent of
streets, and immediately thereafter the City Clerk shall file a
copy of the assessment diagram in the Office of the County
Recorder, and thereafter shall record in said Office of the
county Recorder a Notice of Assessment, all in the manner and
form prescribed by section 3114 of the streets and Highways Code
of the state of California.
SECTION 6. That the city Clerk shall certify to the
adoption of this Resolution, and thenceforth and thereafter the
same shall be in full force and effect.

As a member of VIlla CalIfornIa Homeowners' ASSocIatIon I WIsh to
protest the specIal assessment beIng leVIed on the above
propertIes as well as the other homeowners of our assocIatIon.
The reason I am regIsterIng thIS protest IS due to the fact that
In 1986, under assessment #155, there was an assessment for
streetlIght Installations on CalIfornia Ave. between 18th and
20th streets. These propertIes have already paId for street
lIghts that were Installed at the southeast corner of CalIfornIa
and 18th streets and on the north SIde of CalIfornIa across the
street fromn 1806 CalIfornIa. I feel that thIS double assessment
on the corner propertIes IS InequItable.
