SUBJECT: GANN LIMIT SITUATION FOR FY1985-B6 TO FY1988-89
This is to prov ide informatIon concerning the City's Gann LImit
s i tua tion to assist the council in determining the need fo rand
nature of possible Gann LimIt overrides for the period FY1985-86
to FY1988-89.
Policy Issues Before the Council
There are two policy issues before the CouncIl:
-- t-fuether or not to place on the November 1984 ballot a
measure which would contInue for four additional years the
City's ex i st i ng police and pr otecti ve services Gann LImit
overr ide.
-- Whether or not to place on the November 1984 ballot a
measure which would establish for four years an additional
Gann Limit override.
The folloWl ng IS a di SCUSSlon of each po 11 c Y issue. The
disc u s s ion is presented within the context of two proJection
scenarIOS. The low scenario represents rather small but plaUSIble
pr oj ec ted increases in proceeds of CIty taxes, the CPI rate~ and
pr oJ ec ted CIty staff salary, health/dental, and PERS increases.
The high scenar 10 represents rather large but also plausible
pr oj ec ted increases for the same fac to rs. In both cases, the
bounds of plausibility reflect the high and low lImIts of actual
recent CIty experience and CIty staff Judgement. These low and
hIgh growth rates are summarIzed below:

Continuation of Existing PolIce and protectIve Services OverrIde
The eXIsting polIce and protectIve serVIces Gann LimIt override
expires on June 30', 1985. De ta i1 of appropriations currently

charg ed to the
City must: a) have voter approval to continue the override for
four more years (FYl985-86 to FYl9 88-89) , b) termInate the program
by e1lml nating all associated approprIatIons for FY1985-86, or c)
abso rb the program within the city.s ongoing Gano Limit component
by eliminating sufficient other appropriations for FYl985-86.
If the police and protectIve services override is to be continued
for the per lod FY1985-86 to FY1988-89, voter approval should be
sought In November 1984 to provide City staff suffIcient plannIng
and budget preparation lead tIme for FY1985-86.
The follOWIng table shows the relatIonship between the proJected
magnitude of the existing po 1 ice and protectIve services overrIde
and proJected costs based on the FY1984-85 budget. All estImates
are in millions of current year dollars.

As the above table shows, under the low scenario proJected costs
for the pe r i od FYl985-86 to FYl988-89 will only require the
nonnally permi t ted increases in the override Gann LImit. Under
the high scenar io proJected costs WIll exceed the normally
inflated over ride Gann Lim 1 t by $.1 million by FY1988-89. If
these two proJections are averaged (SInce they represent the two
ex tremes of the range of probable outcomes) , the resultIng
relationship indicates no increase other than the normally
pe rrn t ted annual inflation in the override Gann LImi t for
FYl985-86 seems r equ Ired . However, to be prudent, City staff
recommends that the continua tion of the polIce and protective
services overr Ide Gann LimIt be set at $4.0' effective FY1985-86
rather than $3.8 or $3.9 mIllIon; thIS will allow some minor
margin for projection error.
Need for An AddItIonal Override
The following table shows the relationshIp between projected
proceeds of taxes subJect to limItatIon and the proJected City

As thIS table indicates, under both scenaJ:lOS In FY1988-89
projected proceeds of taxes subJect to limitatIon will exceed the
CIty'S to tal Gann Limi t. Under the low scenarIO, the FY1988-89
excess will be $5.3 mill ion and under the high scenaI: 10, the
excess will be $12.3 million. If the City wIshes to J:etaIn and/or
use these excess proceeds of taxes throughout thI s four year
period, an additIonal Gann overrIde of from $4.7 to $9.6 mIllion
needs to be approved by the voters effective FYI985-86.
Once again, averag ing the se two estimates yields a FY1985-86
addi tional overr ide figure of $7.2 million. However, to be
prudent, CIty staff recommends that if an additional override is
to be considered, It should be set at a 1 ev e 1 of $7.2 to $9.6
million.

Types of AdditIonal Gann Overr Id es
pr lor to the June 26, 1984 Council meeting staff WIll prOVIde the
Counc il a lISt of possible Gann overrides consistent with the
policy guidance provided to staff on June 12, 1984. The overr ide
ex amp1 es will reflect current and proJected budget needs of the
CIty for the next four years.

Cm EpsteIn: ... .Given this technical information which is
extremely valuable that the decision about what
if any override is put on the ballot is a
political one, I think the Council should make
that decision in enough time so the appropriate
documents can be drafted and I think we ought
to at least informally address the question of
how and when we are 90in9 to make that decision
with as much public 1nput as possible. Now, I
suppose if we put i~ on the July 10th agenda,
and made a decision, that would give the City
Attorney time to bring us back the appropriate
ballot language. It seems to me that is prob-
ably the best way to go.
em Reed: ....1 agree with David that we ought to have on
the public agenda at the earliest possible mo-
ment, the intent of the Councilor at least a
ser ies of recommendations so that the publ ie
knows the realm in which we are thinking. I
,personnally believe that we should in fact put
'the police override on just the way it is with
the amount the City Manager indicates would be
appropriate--the $4 million --put that one on
~ for sure~ by itself, word it the way it's wor-
nDfiv" . ded, because I would not want to take any risk
~j rt~ 1~ of it being defeated because it was attached to

OJ' into some large number that people did'nt feel
that they wanted to vote for. And that is my
personal preferance and I suspect that the
citizens are happy to support the pOlice over-
ride and that there may, in fact, be more de-
bate and comment on some of the other aspects
of it.
Manager: . . . . the Attorney may want to comment on this,
but the latest the Council can do this is the

Attorney: We are operating July 24th as the deadline for
adopting resoutions there is some additonal
time after the 24th if the Council were to have
a Special Council meeting but there is no regu-
lar Council meeting between July 24 and the
deadline for submitting documents to the County
of Los Angeles. And we therefore, would re-
quire direction on July 10th eo that we-would
nave two weeks to return aporo~ria~~ documents
te> the Clty council on this question.

em Epstein: On this item, you wouldn't have a great deal of
problems drafting since we have already done
one. Would that be" an adequate time table or
would you prefer ;that we made a decision
tonight.
Attorney: July 10th would be suffieient time, keeping in
mind the fact we are working on the rent con-
trol thing, it is going to be pretty tight but
it is going to be enough time.

Manager: 'Wel1, that is basically what I was going to ask
now. Wh i Ie di rection cannot be gi ven here, I
think we need some notion of what you would
like from us. Certainly we could take this
document and give you numbers. What it would
be my preference to do would be to give the
Council wording for number 1 or general direc-
tion--the kind of wording you could then adopt
and then send to the Attorney, in other words
to just maintain the protective services sec-
tion, wording for number 2 which would basical-
ly be along the lines that Counci Imember Ep-
stein and others suggested, which would be a
list of capital projects in th~ areas of
Ii brar ies, parks, streets, etc., capped at $3
million. So that there would be both a project
speci fie limi ta tion and a dollar Urni ta tion.
And undoubtedly so as not to preclude policy
judgements that might be made 4 or 5 years from
now, many, many more projects than the projeet
limit would allow. So that would govern would
be the dollar limit with a set of generic cat-
egories for projects; libraries, parks,
streets, etc., streetlights. So there would be
a list of capital expenditures and capital out-
lay items equal to $3 million and then we would
have a set of choices that if members of the
Counci 1 chose to deal wi th the potential of
service enhaneements, a variety of ways that

could be phrased too. Lay that out in the
same--or paralleling the structure we have here
and put that as a sort of menu in front the
Council for you to deal with with a firm recom-
mendation for you to do number 1 and you do
number 2 and some choices under number 3.

Councilmember Conn moved to request staff to publicize the matter

was duly seconded and, after further discussion, was approved by
the followIng vote.
