Assessment of Costs to Repair Damaged
Sidewalks, Driveways, and Curbs at
Various locations (SR-82-37)
Introduction
This report requests the City Council set a public hearing for the
assessment of the costs to repair damaged sidewalks, driveways and
curbs.
Background
On October 9, 1979, the Ci ty Council approved a sidewalk repair
program wh i c h provided for property owner participation in the
cost of repairing damaged sidewalks (I t em 11- C) . Property owner
participation is 50% of the cost of the repairs if the damage is
related to tree roots; the City will pay the remaining 50% of the
cost of the repair. Property owners are assessed 100% of the cost
if the damage is not related to tree roots.
Certain repair work has been completed at the following addresses
and the prope rty owners' share of the costs are now due: 911
Marine, 1211 Marine, 1205 Marine, 1109 Marine, 1105 Marine, 1214
Marine, 1106 Marine, 1002 Marine, 1219 Marine, 1306 Marine, 1311
Marine, 1224 Marine, 1314 Marine, 1307 Marine and 909 Marine. A

Chapter 22. Sections 5600 to 5630, of the Streets and Highways
Code for the State of California. A resolution setting the public
hearing for November 23, 1982, is attached.
Recommendation
It ;s recommended the City Council adopt the attached resolution
setting a public hearing for November 23~ 1982, on the assessment
of costs of the subject sidewalk repairs.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA SETTING A HEARING DATE FOR ANY
PROTESTS OR OBJECTIONS TO THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIR OF
SIDEWALKS, DRIVEWAYS AND CURBS. (SR-82-37)
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION l. That the Superintendent of Streets will fll e
a repo rt of repair pursuant to Section 5617 of the Streets and
Highways Code of the S tate of California, rel ati n9 to the
construction of certain improvements to sidewalks and driveways at
911 Marine, 1211 Marine, 1205 Marine, 1109 Marine, 1109 Marine,
1105 Marine, 1214 Marine, 1106 Marine, 1002 Marine, 1219 Marine,
1306 Marine, 1311 Marine, 1224 Marine, 1314 Marine, 1307 Marine
and 909 Marine, all within the City of Santa Monica.
SECTION 2. That pursuant to Section 5600 et seq. of
said code, the City Council does hereby order and declare that on
the 23rd day of November, 1982,. at 7:30 P.M., in the Council
Chambers of the City Hall, it will hear and pass upon the report
by the Superintendent of Streets of the cost of repair, together
with any objections or protests, if any, which may be raised by
any property owner 1 i ab 1 e to be assessed for the cost of such r
repair and any other interested persons.

"- SECTION 3. That all protests or objections must be in
writing and filed with the City Clerk on or before the time set
for hearing of protests and objections.
SECTION 4. The Superintendent of Streets is hereby
directed to ma i1 notices, in the manner and form prescribed by
law, of the cost of repair and of the adoption of this resolution
to all persons owning real property affected by the sidewalk
assessment repair program, whose names and addresses appear on the
1 ast equalized assessment roll fo r the City taxes or as known to
the Ci ty Cl erk.
SECTION 5. The City Clerk shall certify to the adoption
of this resolution and thenceforth and thereafter the same shall
be in full force and effect.
