Introduction
The Ci ty Council set a Public Hearing for the assessment of costs
to repair damaged sidewalks, driveways and cur bs at various areas
within the Ci t Y . It is recommended that Council adopt the
at t ac he d Re sol uti 0 n confirming the assessment of costs.

November 9, 1982 , on the assessment of costs to repair damaged
sidewalks, driveways and cur bs within the City of Santa Moni ca.
Le t t e r s were mailed to each property owner informing them of the
public hearing on October 26, 1982.
Recommendation
It is recommended the City Council:
1 . Open the Public Hearl ng;
2. Close the Public He ari ng and acknowledge any protests; and
3. Adopt the Resolution confirming the assessments.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIRS TO
DAMAGED 51 DEW ALK5 , DRIVEWAY S AND CUR B S
(SR-82-36)
~vHEREAS , the Street Superintendent of the City of Santa
Monica, purs uant to Section 5600 to 5630 of the Streets and
Hi ghways Co de , commenced proceedings to cause the repair of
damaged sidewalks, driveways and cur bs in the City of Santa Monica
at 919 Marine, 929 Marine, 2132 - 21st Street, 2136 - 21st Street,
2128 - 21st Street. 1301 Marine, 101 B Mari ne , 917 Marine, 1101
Marine and 913 Marine; and
WHEREAS, sixty days after said order was served, the
work had not been completed by the owners or persons in possession
of the affected properties, and the Superintendent of Streets
caused the wo r k to be done; and
WHEREAS, the Superintendent of Streets gave the notice
req ui red by Section 5616 of the Streets and Highways Code; and
WHEREAS. the Superintendent of Streets did file with the
City Council of the C~ty of Santa Monica his report of repairs and
cost as req ui red by Sect ion 561 7 of the Streets and Highways Code;

I.JHEREAS , upon the day and hour fixe d for hearing by
Resolution Number 6565 (eCS), the City Council of the City of
Santa Monica heard and passed upon the report of the
Super.lutendent of Streets together with all obj ections and
protests as req ui red by Sect ion 5618 of the Streets and Highways
Code;
NOW, THEREFORE; THE CITY COUnCIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS F 0 L LOW S :
SECTION 1 . That the report of the Superintendent of
Streets heretofore filed and above-described be and the same is
hereby confirmed.
SECTION 2. That all protests and obj ections of every
kind and nature to the report of the Super.lntendent of Streets be
and the same are hereby overruled and de ni ed .
SECTION 3. That the cost of the repairs, as set forth
in the report of the Superintendent of Streets, shall be assessed
aga.lnst the properties therein described, which properties fr 0n t
upon the s.ldewalk upon wh.lch the repairs were made.
SECTION 4. That if such assessment i.s not paid within
the time permitted by law, the same shall constitute a speci a1
assessment against and lien on the propert1es therein described,
in the amO un t set fort h in the report of the Superintendent of
Streets, which lien shall con tin ue untl.l the assessment and all
interest thereon is paid or until it is discharged of record.

SECTION 5. That if the asssessment is not paid within
the time permitted by law, the Superintendent of Streets, in
accordance with Section 5628 of the Streets and Highways Code,
shall deliver a Notice of Li en, prepared in the manner r eq ui red by
Section 5626 of the Streets and Highways Code, to the County
Auditor who shall collect the assessment together with all o t he r
taxes aga~nst the property.
SECTION 6. That the City Clerk shall cert1fy to the
adoption of this resolut1on and thenceforth and t he rea f t e r the
same shall be ~n full force and ef feet.

Pursuant to Streets and Highways Code Section 5616, this letter is
notification that the City Council, purs uant to Re sol uti 0 n No.
6565 adopted on October 12, 1982, has scheduled a hearing to hear
and pass upon the report of the Superintendent of Streets of the
cost of the sidewal k repair, in connection with the
above-described proj ect , together with any obj ections and
protests, if any, which may be raised by any property owner liable
to be assessed for the cost of such sidewalk repair and any ot he r
interested persons.

Any protests or obj ections must be in writing and must be filed

as provided for in Streets and Highways Code Section 5618, the
cost of the sidewalk repair will be assessed against your
property, and you will be notified of the manner of payment.
The City will provide assistance for low-to-moderate income

HIGHWAY S CODE OF THE STATE OF CALIFORNIA

Pursuant to the provis10ns of Division 7 , Chapter 22,
Sections 5600 to 5630, of the Streets and Highways Code of the
State of California. the following work was caused to be done by
the Street Superintendent:
The removal and replacement of 2236 s q ua r e
feet of PC concrete on s idewal ks at $4.00 per
s q ua r e foot;
The removal and replacement of 11 s q ua r e feet
of PC concrete on driveways at $5.00 per
square foot; and
The removal and r ep 1aceme nt of 2 2 5 s q ua r e feet
of PC concrete on sidewalks at $3.00 per
square fo ot .
The tot a1 cost of the above work was $2,966.00.
The tot al proposed assessment for sidewalks and cur bs is
$1,483.00 or 50 percent of the total cas t . The ot her 50 percent
of the cost is be i ng pa1d by the C1ty as the above repairs were
caused by tree root damage.
