SUBJECT: Resolut1on Setting January II, 1982, as the Date
for Publ1C Hearlng on the Assessment of Costs to
Remove and Repair Abandoned Driveways
Introductlon
This report requests that the City Council set a publlC hearlng
for the assessment of the costs to remove and repa1r abandoned
drl veways.
Background
Sect10ns 7400 - 7411 of the Santa Monlca Munlclpal Code provides
procedures by which the Clty can not1fy a property owner to remove
and repa1r an abandoned drlveway and, If the work 1S not done by
the property owner, do the work and assess the property owner the
cost of the repair.
The purpose beh1nd orderlng abandoned drlveways replaced 1S
twofold. Flrst, 1t presents a hazard to both pedestr1ans and
cars. The abandoned dr1veway presents a trlpp1ng hazard to
pedestr1ans due to 1ts slop1ng nature. Motorlsts are presented
wlth a hazard as one canlt tell where the curb lS and could back a
car up the driveway. Secondly, abandoned driveways reduce the
amount of on-street parklng as motorists are not always aware that
they can park 1n front of the abandonded driveway.
Pursuant to Sections 7402 through 7406 of the Mun1cipal Code, the
street 1nspectors clte a property owner for an abandoned driveway.
The owner, if he disagrees with the cltatlon, can appeal in

Wrltlng to the Clty Manager within 10 days of the date of the
notlee. The Clty Manager's declSlon shall be flnal and
concluslve. Upon completlon of the work, if done by the Clty, the
property owner 1 S notlfled of a publlC hearlng to be held at WhlCh
any protests may be heard concernlng the proposed assessment. If
the assessment is eonflrmed by the Coune i 1 , the property owner i s
then bllled. If the assessment 1 s not pald withln 10 days, then
the amount of the assessment i s sent to the County Assessor to be
lncluded on the next annual property tax blll.
Certain removal and repalr work has been completed at the
f 01 1 ow i n 9 addresses and the costs are now due from the property
owners: 170 Pier Avenue, 1414 6th Street and 702 Wllshlre
Boulevard. A publlC hearlng to confl rm the assessments must now
be held pursuant to Sectlon 7407 of the Munlclpal Code. A
resolutlon settlng the public hearing for January 11, 1983, 1 S
attached.
Recommendatlon
It 1 S recommended that the Clty Counell adopt the attached
resolutlon settlng a PUblC hearlng for January 11. 1983, on the
assessment of costs of the subject abandoned drlveway removal.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA SETTING A PUBLIC HEARING DATE
FOR ANY PROTESTS OR OBJECTIONS TO THE REPORT
OF THE SUPERINTENDENT OF STREETS REGARDING
REMOVAL OF ABANDONED DRIVEWAYS.
WHEREAS~ the Superlntendent of Streets has determined
that drlveways located at 170 Pier Avenuet 1414 6th Street and
702 W11shlre Bouleva have been abandoned; and
WHEREASt the Super1ntendent of Streets has given not1ce
1n the manner required by Mun1c1pal Code Section 7403 to remove
the abandoned drlveway aprons and to restore or install curbingt
parkway and sidewalk in conformity with the curbingt parkway and
sidewalk adJoinlng the abandoned drlveway aprons; and
WHEREASt following the fallure to perform the work
requ1red by the notices~ the work was performed by the
Superlntendent of Streets in accordance with Munlclpal Code SeClon
7406. and
WHEREASt the Superintendent of Streets will flle a
report of repa1r pursuant to Municipal Code Section 7408,
NOWt THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. Pu rsua nt to Mun1clpal Code Sectlon 7407
