Introduction
The City Counc1l set a PubllC Hearing for the assessment of costs
to repair damaged sldewalks, dr1veways and curbs at various areas
w1thin the City. It lS recommended that Councll adopt the
attached Resolution conflrmlng the assessment of costs.
Background
On March 8, 1983, the Clty Counc1l set a public hearlng for April
12, 1983, on the assessment of costs to repair damaged sldewalks,
drlveways and curbs wlthin the C1ty of Santa Monlca. Letters were
mal led to each property owner in accordance w1th the legal
requ1rements of Chapter 22 of the Improvement Act of 1911
lnformlng them of the public hearlng on Apr11 1, 1983.
Recommendat1on
It is recommended the CIty Council:
1. Open the Pub11C Hear1ng;
2. Close the Pub11C Hearing and acknowledge any protests; and
3. Adopt the Resolut1on conf1rming the assessments.

REPAIR OF DAMAGED SIDEWALKS) DRIVEWAYS, CURBS,
AND/OR REMOVAL OF OBSTRUCTIONS, PERFORMED
UNDER PROVISIONS OF DIVISION 7 , CHAPTER 22,
SECTIONS 5600 TO 5630, OF TH E STREETS AND
HIGHWAYS CODE OF THE STATE OF CALIFORNIA
(SR-83-43)
Pursuant to the provls1ons of D1Vlslon 7, Chapter 22,
Sectlons 5600 to 5630) of the Streets and Hlghways Code of the
State of Callfornla, the followlng work was caused to be done by
the Street Su pe rl ntende nt :
The removal and replacement of 930 square feet
of PC concrete on sldewalks at $4.00 per
sq ua re foot;
The removal and replacement of 21 llneal feet
of PC curb at $10 per lineal foot;
The removal and replacement of 36 square feet
of PC driveway at $5 per square foot;
The removal of 90 square feet of PC driveway
at $2 per square foot; and
The total cost of the above work was $4,290.00.
The total proposed assessment for the above sidewalk and
curb da ma 9 e 1 S $2,145.00 or 50 percent of the total cost. The
at he r 50 percent of the cost i s being pald by the Clty as the
above repalrs were ca used by tree root damage.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIRS TO
DAMAGED SIDEWALKS, DRIVEWAYS AND CURBS
(SR-83-43)
WHEREAS, tne Street Superintendent of the C1ty of Santa
Mo n 1 c a , pursuant to Sectlon 5600 to 5630 of the Streets and
Hlghways Code, commenced proceedings to ca use the repair of

damaged sidewalks, drlveways and curbs 1n the C1ty of Santa Monica
at 1731 Pica, 1802 Delaware, 1847 18th Street, 1811 18th St reet,
1753 18th Street, 1807 18th Street, 1843 18th Street, 1837 18th
St r e e t , 1827 18th Street, 1833 18th Street, 1817 18th Street, 1823
18th St reet, 1726 Dela\-.rare, 1944 18th St reet , 2002 18th Street,
1902 18th Street, 1844 18th St reet, 1938 18th Street, 1838 18th
Street and 1822 18th Street; and
WHEREAS, Slxty days after sald order was served, the
work had not been completed by the owners or persons in possession
of the affected propertles, and the Superintendent of Streets
caused the work to be done; and
WHEREAS, the Superlntendent of Streets gave the notlce
requlred by Section 5616 of the Streets and Hlghways Code; and
WHEREAS, the Superlntendent of Streets did flle with the
Clty Councll of the City of Santa Monlca his report of repairs and
cost as required by Section 5617 of the Streets and Hlghways Code;

WHEREAS, upon the day and hour flxed for hearing by
Resolutlon Number 6639 (C CS) , the City Council of the City of
Santa Monlca heard and passed upon the r e port of the
Superi ntendent of Streets together with all objectlons and
protests as required by Section 5618 of the Streets and Highways
Code;
N01~ , THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION l. That the repo"rt of the Superlntendent of
Streets heretofore flled and above-described be and the same is
hereby conflrmed.
SECTION 2. That all protests and objectlons of every
ki n d and nature to the report of the Superintendent of Streets be
and the same are hereby overruled and denied.
SECTION 3. That the cost of the repairs, as set forth
in the report oft he Superintendent of Streets, shall be assessed
agalnst the properties therein described, which propertles front
upon the sldewalk upon II/hich the repairs were made.
SECTION 4. That if such assessment is not paid within
the time permitted by law, the same shall constitute a speclal
assessment agalllst and 11en on the properties there1n described,
in the amount set forth ; n the report of the Superintendent of
Streets, which 11 en shall continue until the assessment and all
interest the reon is pa i d 0 r untll 1 t i s dlscharged of record.

SECTION 5. That 1f the asssessment lS not pa1d with1n
the time permitted by law, the Superintendent of Streets, in
accordance with Section 5628 of the Streets and Highways Co de,
shall deliver a Notlce of Lien, prepared in the manner requlred by
Section 5626 of the Streets and Highways Code, to the County
Auditor who shall collect the assessment together with all ot her
taxes agalnst the property.
SECTION 6. That the Clty Clerk shall cert1fy to the
adopt1on of thlS resolution and thenceforth and thereafter the
same shall be 1 n fu 11 force and effect.
